Mayor Van Nest: Our ordinances protect this property as a wetland area. Mayor Van Nest moved, Pesek seconded, to reject the offer of the Eberhardt Company for property at Eagerness Point and to inform Mr. Nelson that the existing docks are illegal structures, noting that there is no record of a multiple use dock license application. Motion, Ayes (3) - Nays (0). Mr. Robert Bothe of Edina Realty requested Council discussion on the McCleary matter. Mayor Van Nest moved, Butler seconded, to reconsider and open for discussion the Stubbs Bay Marina construction request of .Tares McCleary. Motion, Ayes (3) - Nays (0) . Councilmember Massengale arrived at 8:45 P.M. Discussion followed concerning the proposed building and if it had to be completed within 120 days. Mr. Alan Olson, City Planner, commented that active construction has to start within this time period. Mr. Olson noted that there has been some new construction but inspections were not called for. Mayor Van Nest: There are two issues: 1. Rezoning 2. Building permit Let's address ourselves to the rezoning matter first. Mr. Ro' Bothe reviewed his letter of August 11, 1978 whicL _.-es : "At the request of Mr. James McCleary who now resides in Oregon, I have been asked to act in his behalf regarding the upgrading of the Stubbs Bay Marina. Since I am unable to be present at the Council meeting scheduled for next Tuesday, August 15, 1978, it is requested that consideration be given to the following: (a) It is our intent to fully improve the entire marina facility in terms of appearance and services.
