REGULAR MEETING OF THE ORONO COUNCIL, AUGUST 15, 1978 <br />Page 14 <br />Council Meeting - August 15, 1978 <br />Mr. Richard Breckwald, 1825 Fagerness Point Road, <br />commented that he had not been contacted by the <br />Eberhardt Company and he felt that he had rights <br />to the property, docks and the lake. <br />Mayor Van Nest: Our ordinances protect this <br />property as a wetland area. <br />Mayor Van Nest moved, Pesek seconded, to reject <br />the offer of the Eberhardt Company for property <br />at Eagerness Point and to inform Mr. Nelson that <br />the existing docks are illegal structures, noting <br />that there is no record of a multiple use dock <br />license application. Motion, Ayes (3) - Nays (0). <br />Mr. Robert Bothe of Edina Realty requested <br />Council discussion on the McCleary matter. <br />Mayor Van Nest moved, Butler seconded, to reconsider <br />and open for discussion the Stubbs Bay Marina <br />construction request of .Tares McCleary. Motion, <br />Ayes (3) - Nays (0) . <br />Councilmember Massengale arrived at 8:45 P.M. <br />Discussion followed concerning the proposed building <br />and if it had to be completed within 120 days. <br />Mr. Alan Olson, City Planner, commented that active <br />construction has to start within this time period. <br />Mr. Olson noted that there has been some new <br />construction but inspections were not called for. <br />Mayor Van Nest: There are two issues: <br />1. Rezoning <br />2. Building permit <br />Let's address ourselves to the rezoning matter first. <br />Mr. Ro' Bothe reviewed his letter of August 11, 1978 <br />whicL _.-es : <br />"At the request of Mr. James McCleary who now resides <br />in Oregon, I have been asked to act in his behalf <br />regarding the upgrading of the Stubbs Bay Marina. <br />Since I am unable to be present at the Council meeting <br />scheduled for next Tuesday, August 15, 1978, it is <br />requested that consideration be given to the following: <br />(a) It is our intent to fully improve the entire <br />marina facility in terms of appearance and <br />services. <br />FAGERNESS MARSH OFFER <br />(Continued) <br />RECONSIDER MOTION <br />Stubbs Bay Marina <br />James McCleary <br />(Continued) <br />
