NO
NOTE:e law requires that the conditions set forthn the
following three items 14, 15, and 16 HUST be established
before a variance can be granted. Exp an in detail after
each statement wherein your case conforms to the requirements.
yirric, tea or narganip to gyner. strict application or
if a provisions o eZoning Ordinance would result in
peculiar and practical difficulties or exceptional or undue
hardship upon the owner of the lot in developing or using
such lot in a manner cust wary and legally permissible
within the zoning district in which said lot is located.
Granting of the variance is necessary for the preservation
and enjoyMent of a substantial property right of the appli-
k;agnt and to alleviate demonstrable hardship or difficulty
and will not merely serve as a convenience to the applicant.
Explain in detail.
15. Excentional Conditions of the o ere are special condi-
tions narrowness, shallowness or shape of a lot, exceptional
topographic or water conditions or other extraordinary and
exceptional conditions of such lot) applying to the structures
or land in question that are peculiar to the property involved
or immediately adjoining property and do not apply generally
to other land or structures in the district in which said land
is located. Explain in detail.
The lot, as it now exists, has a frontage of 26.8 feet on Fagerness Pt. Rd.
and is 5-aided. We propose to split it equally with the adjoining lot which
has 185 frontage on Fagerness Pt. Rd. and is 3-aided. If split as we propose,
there will be two equal lots with a straight line from Fagerness Pt. Rd. to
Webb Street, thus creating, we feel, two more practical lots with access s4
both roads on both lots. We would also fill in the existing driveway which
now divides the two lots.
sea i vu u on PaiMpgrizoaq ana c: renens a Plan: Granting the
variance will not Impair an adequate supply of light and air
to adjacent property, unreasonably increase the congeatibn..
in the public streets, increase the danger of fire, endanger
the public safety, unreasonably diminish or impair established
property values in this surrounding area, or in any other way
impair health, safety, comfort, morals, or in any other respect
be contrary to the intent of the Zoning Ordinance Fnd any
applicable comprehensive plan. Explain in detail.
Should increase the value of both lots
NOTE: TFe following material must be attached o this application.
17. A majo or plat showing the property affected and all lands
within 150 feet of the boundaries of the property affected
by proposed change. (_copies)
