HomeMy WebLinkAboutResolution 9190 C� 439"411 RESOLUTION NO. 919 A RESOLUTION VACATING A PORTION OF IVY PLACE WITHIN THE CITY OF ORONO, MINNESOTA WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City of Orono has received a petition to vacate a portion of Ivy Place, platted in Spring Park Addition; Lake Minnetonka, Hennepin County; and WHEREAS, after due published and posted notice, a Public Hearing regarding said vacation was held before the Orono Planning Commission on June 26, 19781, and all interested persons were given an opportunity to be heard; NOW, THEREFORE, BE IT RESOLVED, that the Orono City Council, after due study and consideration, hereby makes the following findings of fact: 1. That the road to be vacated is in fact not open to the public but is and has for many years been a portion of the yard area of Lot 57, Spring Park Addition. 2. That the road to be vacated has for many years been shown on the official plat map of Hennepin County as a vacated road. 3. That the request for this vacation stems from a title search by Richard Putnam, owner of Lot 57, Spring Park_ Addition, which search failed to show proper recording of this vacation in previous years. 4. That the remaining portions of Ivy Place have been vacated by Hennepin County District Court, Case No. 321350, Order of the Court entered on November 3, 1931, and filed on December 1, 1931, in Book 306 of Miscellaneous Documents page 297. 5. That all other properties which may have been affected by this vacation have recorded private easements providing for access to the public road and all owners of said properties have signed the petition in favor of this vacation. That this vacation request is therefore merely a request to clear title to Lot 57, Spring Park Addition and to enable proper recording of a vacation which has been assumed completed since 1931. AND, BE IT FURTHERMORE RESOLVED, that based upon the above findings of fact, the Orono City Council does hereby vacate the following legally described portion of Ivy Place, Spring Park Addition, Lake Minnetonka, Hennepin County: Beginning at the Northeast corner of Lot 57, Spring Park Addition, thence along a straight line between the Northeast corner of Lot 57 and the Southeast corner of Lot 78 in a Northwesterly direction 30 feet to the center of Ivy Place; thence in a Westerly direction along • the center line of said street to a point on said line 25 feet beyond the point where said line intersects a line between the southwest corner of Lot 78 and the northwest corner of Lot 57, said Addition; thence in a Southerly direction parallel to the West line of Lot 57 and 25 feet distant from said line to a point where said line intersects with the Southerly line of said Lot 57,- as extended to the center of Ivy Place; thence in a Southeasterly direction along said South line of Lot 57 as extended to the Southwest corner of Lot 57; thence in a Northerly direction to the Northwest corner of Lot 57; thence in an Easterly direction to the point of beginning.
