A RESOLUTION APPROVING A VARIANCE FOR JACK SAFAR
AND GEORGE JOHNSON, 925 PARTENWOOD ROAD
WHEREAS, the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono had adopted
zoning regulations for the orderly, economic and safe development of
land within the City; and
WHEREAS, Sections 34.440 and 31.310 of the Orono Zoning
Code prohibit the construction of boat docks upon property not
occupied by a single family dwelling; and
WHEREAS, the Planning Commission and City Council have
reviewed an application by Jack Safar and George Johnson, owners of
Lots 1 and 2, Block 3, Partenwood, to erect a private boat dock upon
Outlot A in the Partenwood Subdivision; and
WHEREAS, when the Partenwood Subdivision was approved by
the Orono City Council on June 14, 1972, Outlot A was created for
the sole purpose of allowing the construction of private docks for
• the benefit of the owners of Lots 1 and 2, Block 3, Partenwood; and
WHEREAS, the use of Partenwood Outlot A is also restricted
by certain private covenants filed in the chain of title of the
Partenwood Subdivision,
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the
City of Orono hereby approves a zoning code variance from Sections 34.440
and 31.310 authorizing the construction of a boat dock on Outlot A,
Partenwood Subdivision, subject to the following conditions:
1. The use of Outlot A shall be as regulated in the
covenants of title to the Partenwood Subdivision.
2. There may be erected only one dock, not to exceed
4.0 ft. wide by 100.0 ft. long in a location meeting
all Lake Minnetonka Conservation District setback
requirements.
3. There may be kept at the dock, upon Outlot A or in the
water abutting Outlot A, no more than four "watercraft"
as defined by the LMCD Code, Section 3.01, Subdivision 13,
and those watercraft must be owned by the owners of Lots 1
• and 2, Block 3, Partenwood.

4. The owners of Lots 1 and 2, Block 3, Partenwood,
must execute and file in the chain of title of the
property an open space conservation easement over
Outlot A listing the requirements of 1, 2 and 3 above.
5. The initial construction of a dock, whether permanent
or seasonal, is subject to a standard building permit
which may be issued only upon execution and filing of
the conservation easement.
