HomeMy WebLinkAboutResolution 907RESOLUTION #907 A RESOLUTION VACATING ALL OF PARTENWOOD LANE IN THE CITY OF ORONO, MINNESOTA WHEREAS, a majority of the owners of the property abutting on Partenwood Lane in the Development of Partenwood, all within the City of Orono, have requested the City Council in a Petition, dated November 11, 1977, to vacate such street in accordance with law; and WHEREAS, after due published and posted notice a public hearing was held before the City Council on February 23, 1978, regarding the Petition to Vacate Partenwood Lane, and all persons interested were given an opportunity to be heard; and WHEREAS, after due study and consideration, the City Council of the City of Orono finds that it will be for the best public interest to approve such vacation;' NOW, THEREFORE, BE IT RESOLVED, that such Petition is hereby granted and the said Partenwood Lane, as described on that certain Plat of Partenwood, filed of record under date of December 22, 1972, is hereby vacated subject to the following conditions and reservations: 1. That the said City of Orono reserves for itself an easement for ingress and egress over the entire area vacated for the purpose of installing, maintaining, inspecting, repairing, replacing or servicing any public utility now or hereafter located within such area; including but not limited to, public sanitary sewer, storm sewer, water mains, gas, electric power or telephone, and that the owners of lots 4, 5, and 6, block -2, Partenwood and lot 2, block 3, Partenwood grant to the City and file in the chain of title of said lots an easement to this effect. 2. That the City of Orono reserves the right to, at some future time, reopen the said Partenwood Lane, providing there is at that time a showing of public need and that all of the procedures required by law for the establishment of streets shall be followed. 3. The preservation of any presently existing utility easements. 4. Preservation of any sewer assessments presently outstanding against any property fronting or abutting said Partenwood Lane. 0 5. That a declaration of covenants be entered into by . the owners of lots 4, 5, and 6, block 2, Partenwood, and lot 2, block 3. Partenwood, wherein the owner of each said lot shall have created an easement for ingress, egress and driveway purposes over the entire vacated Partenwood Lane, and wherein the owner of each said lot shall be equally responsible for maintenance of the driveway, said declaration shall be filed in the chain of title of said lots concurrent with the filing of this resolution.
