CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />I► 6Y <br />A RESOLUTION <br />APPROVING VARIANCES FROM <br />MUNICIPAL ZONING CODE <br />SECTION 6.12.6240 & 6.12.9110 <br />AND <br />GRANTING A CONDITIONAL USE PERMIT <br />PURSUANT TO MUNICIPAL ZONING CODE <br />SECTION 6.12.6240 <br />FILE NO. LA25-000043 <br />WHEREAS, on September 17, 2025, Takka Day Design (hereinafter the "Applicant") <br />on behalf of John Erickson (hereinafter the Owner), applied for variances from the City Code and <br />a conditional use permit for the property addressed 865 Partenwood Road, Orono and legally <br />described as: <br />Lot 1, Block 2, Partenwood, Hennepin County, State of Minnesota <br />(hereinafter the "Property"); <br />WHEREAS, the Applicant has made an application to the City of Orono for a <br />variance from Orono Municipal Zoning Code Section 6.12.6240 for expansions to the existing <br />principal building within the 75400t lakeshore setback; and <br />WHEREAS, the Applicant has made an application to the City of Orono for a <br />variance from Orono Municipal Zoning Code Section 6.12.9110 for new hardcover within the 75- <br />f6ot lakeshore setback; and <br />WHEREAS, the Applicant has made an application to the City of Orono for a <br />conditional use permit pursuant to Orono Municipal Zoning Code Section 6.12.6240 for new <br />retaining walls within the 75400t lakeshore setback; and <br />WHEREAS, on October 20, 2025, after published and mailed notice in accordance <br />with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br />which time all persons desiring to be heard concerning this application were given the opportunity <br />to speak thereon; and <br />WHEREAS, on October 20, 2025, the Planning Commission voted 7 to 0 in favor <br />of a motion to recommend approval of the variance as recommended by staff; and <br />WHEREAS, on November 10, 2025, the City Council reviewed the application and <br />the recommendations of the Planning Commission and City staff; and <br />
