City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2062 <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.25, SUBDIVISION 6 (B) <br />FILE #1069 <br />WHEREAS, James A. Williams (hereinafter "the applicant") is <br />the owner of the property located at 2725 Ethel Avenue within the City <br />of Orono (hereinafter "City") and legally described as follows: <br />Lot 3, Block 3, Casco Heights, Hennepin County, Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.25, Subdivision 6 (B) to <br />permit the construction of a second story addition to the existing <br />house which is only 4.2' from the side lot line where a 10' side <br />setback is normally required, and for a variance to Section 10.22, <br />Subdivision 2 to allow hardcover in excess of the 30% hardcover <br />normally allowed in the 250-500' lakeshore setback zone in which the <br />property is located. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1069. <br />2. The property is lccated in the LR-lC Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on <br />September 15, 1986, and recommended approval of she proposed <br />setback variance and a 36.4% hardcover percentage based upon the <br />following findings: <br />A) The pre-existing hardcover (prior to issuance of a <br />permit for the detached garage currently under construction) <br />was 36.4% or 2,729 r.f. <br />B) The garage permit was issued subject to applicant <br />removing excessive hardcover in order to meet the 30% hard- <br />cover limit. <br />Page 1 of 4 <br />
