RESOLUTION'NO. 892 <br />A RESOLUTION APPROVING <br />A JOINT USE DOCK.PERMIT AND LICENSE <br />FOR KELLY AVENUE HOLDING COMPANY <br />WHEREAS, the City of Orono is a municipal corporation organized and <br />existing under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono has adopted zoning <br />and lakeshore regulations for the orderly, economic and safe development <br />of land within the City; and <br />WHEREAS, the Planning Commission and City Council have considered <br />the application of Kelly Avenue Holding Company for Joint Use Dock <br />construction and use of six (6) slips on their property known as 2505 <br />Kelly Avenue; Tract A, RLS 1428; and <br />WHEREAS, Tract A. RLS 1428 is occupied by 3 duplex structures <br />containing 6 residential units as authorized by Conditional Use Permits <br />issued October 11.51977; and <br />WHEREAS, Tract A, RLS 1428 contains approximately 400 lineal feet <br />�f Lake Minnetonka shoreline; and <br />WHEREAS, the Orono Zoning Code Section 34.440 authorizes private <br />docks subject to the requirement of -the Orono Municipal Code Chapter 74, <br />Joint Use of Lake Facilities. <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City <br />of Orono hereby approves a Joint Use Dock Permit and 1978 license for <br />Kelly Avenue Holding Company subject to the following conditions: <br />1. Maximum of 6 boats to be moored at this property. <br />2. Maximum of 3 dock structures, each structure a maximum size <br />of 5' 6" x 25' 0", as shown and located on Exhibit A attached. <br />3. Installation and use of more than one dock structure on this <br />property will be subject to a Joint Use Dock License which must <br />be renewed annually and which renewal may be subject to revised <br />conditions according to then current dock regulations. <br />4. Issuance of this permit and license is subject to the approval <br />.of all other agencies having jurisdiction, including the Lake <br />Minnetonka Conservation District and the MN Dept. of Natural <br />Resources. <br />5. Issuance of this permit and license does not vest any permanent <br />rights for multiple dock or moorage on this property. <br />
