HomeMy WebLinkAboutResolution 889RESOLUTION NO. 889 A RESOLUTION APPROVING THE PRELIMINARY SUBDIVISION OF • ROGER FAZENDIN 2700 SIXTH AVENUE NORTH WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City bf Orono has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the Planning Commission has reviewed this subdivision application for conformity with the zoning regulations and the comprehensive guide plan, has held a public hearing and has made recommendations.to the City Council; NOW, THEREFORE, BE IT RESOLVED, that based upon all of the information presented by the applicant, reports by the City staff, consultants and Planning Commission, and the record of the public hearing held February 27, 1978, the -City Council of the City of Orono, after due consideration, hereby approves the preliminary subdivision for Roger Fazendin with the following requirements, changes and conditions: 1. The final subdivision may be submitted in the form of a certificate- of ertificate-of survey for metes and bounds division and need not be submitted in the form of record plat drawings provided --both parcels exceed 5.00 •acres- and 300 ft. lot width. 2. The certificate of survey, Exhibit A, must be revised to show the following requirements: 3. The applicant shall indicate the proposed access locations from each parcel to CSAH 6 and shall provide proof of approval of said access by the Hennepin County Public Works Department. 4. The applicant shall execute a quit claim deed to Hennepin County dedicating a 50.0 ft. right -of --way (10.0 ft. more than existing) for CSAH 6. 5. The applicant shall execute an access easement.to Hennepin County for a 40 ft. by 150 ft. area in the southwest corner of the property for.future extention of Old Crystal Bay Road north of CSAH 6. 6. The applicant shall execute an open space and flowage conservation • easement over the wetlands on Lot 1. 7. The applicant shall execute drainage and utilities easements 10 ft. wide along all lot lines. 8. The proposed dividing line shall be relocated west to retain at least 5.00 acres within Lot 2 exclusive of road right-of-way:,; or the applicant shall submit record plat drawings for final subdivision approval. 9. The applicant shall provide a septic system site evaluation report evidencing at least one acceptable primary and alternate drain field area within each lot. 10. The applicant shall provide a title opinion addressed to the City. 11. The applicant shall pay a park dedication fee based upon the standard City schedule, $250.00 per lot, $500.00 total. 12. The applicant shall agree to the requirements and conditions of this resolution and so signify by signing the resolution where provided. This resolution will expire on April 17, 1978 if the applicant has not signed his agreement by that date, and shall also expire on August 16, 1978 if the above required information has not been submitted to the City for final approval. In that event, it will be necessary for the applicant to file a new subdivision application with the City. Adopted this 16 day of ATTEST: March 1978.
