A RESOLUTION APPROVING THE PRELIMINARY PLAT OF
• PAUL KASTER

WHEREAS, the City of Orono is a municipal corporation organized
and existing under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono has adopted subdivision
regulations for the orderly economic and safe development of land within
the City; and
WHEREAS, the Planning Commission has considered this subdivision
application, has held a public hearing and has made recommendations to
the City Council;
NOW, THEREFORE, BE IT RESOLVED, that based upon all of the information
presented by the applicant, reports by the City staff, consultants and
Planning Commission, and the record of the public hearing held February 6,
1978, the City Council of the City of Orono, after due consideration,
hereby approves the preliminary plat for Paul Kaster with the following
changes and requirements and conditions:
01. The final subdivision must be submitted in the form of a record plat,
with at least 2 reproducible mylar copies, 3 hardshell mounted copies, 10
paper copies and one copy reduced to a scale of 1" = 200 ft.
2. The record plat survey shall locate the centerline of traveled Casco
Point Road and shall establish a right-of-way line 30.0 ft. easterly
thereof.
3. The applicant shall execute and deliver a quit claim deed to the
City of Orono for that portion of his property west of the right-
of-way line as established above.
4. Access to the east lot shall be by a "private easement of width as
determined by the City Engineer after review of construction plans".
5. A drainage easement shall be established across the lots as approved
by the City Engineer.
6. The applicant shall provide complete drainage, sewer, lot access and
erosion control plans for approval by the City Engineer.
7. The applicant shall execute and deliver road and utilities and
• drainage easement documents.
8. The applicant shall pay one additional water unit assessment of $580.00.
9. Sewer connection unit charges of $225.00 will be due with each new
residential building permit issued.
10. The applicant shall provide a title opinion addressed to the City.
�11. The applicant shall pay a park dedication fee based upon the standard
City schedule, $1000.00 per lot, $2000.00 total. .
12. No filling or development shall be permitted at MSL elevation 931.5 ft.
or below.
13. The western lot is not riparian and shall have no access to Lake
Minnetonka.
14. The applicant shall agree to the requirements and conditions of this
resolution and so signify by signing the resolution where provided.
This resolution will expire on April 17, 1978 if the applicant has not
signed his agreement by that date, and shall also expire on August 16, 1978
if the final plat drawing and above required information have not been
submitted to the City for final approval. In that event, it will be
necessary for the applicant to file a new subdivision application with
the City.
