I have enclosed the application for such a vacation, along with the appropriate fee schedule. The City's review of such an application would have to address the following concerns: 1. The City would certainly reserve an underlying utilities and access easement for the municipal water lines in the alley. 2. Your surveyor would have to determine which adjacent property owners would gain which portions of the land. Normally when alleys are vacated, they are split between properties within the original plat on each side of the alley. If, however, the alley was at the edge of the original subdivision, the entire vacated portion may go to the owner on one side. It is possible that you would gain the entire 14' if the alley is vacated. Your surveyor would have to confirm this. 3. If you gain a l l 14' , then Kauf fmann' s prope- ty will only abut a public roadway at a point, reducing Kaufmann's required frontage on a public road to practically nothing, since the continuation of Ethel Avenue north of the alley is actually within property owned by Gordon Amundson at 2697 Ethel Avenue. Also, vacation of the alley further eastward would reduce or eliminate the road frontage for the residence at 2691 Carolii.e Avenue. Because of the above issues related to access and lot standards, vacation of the alley is not necessarily a "sure thing". The Planning Commission and Council might find there are compelling reasons to not vacate the alley, hence you and/or your neighbors who join in the application, would be risking the $250.00 application fee plus your costs of having the necessary survey work completed.
