HomeMy WebLinkAboutResolution 883RESOLUTION NO. 883 A RESOLUTION APPROVING 40 THE PRELIMINARY PLAT AND REZONING REQUEST OF SIDNEY REBERS, 2060 WAYZATA BOULEVARD WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono has adopted zoning and subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the Planning Commission and City Council have considered the application for a subdivision plat by Sidney Rebers the subdivider; and WHEREAS, the Planning Commission and City Council have considered the rezoning request for the same property; NOW, THEREFORE, BE IT RESOLVED, that based upon all of the information presented by the applicant and reports by the City staff, consultants and the Planning Commission, the City Council of the City of Orono hereby approves the preliminary plat for Sidney Rebers with the following changes and requirements and conditions which are to be met by the subdivider prior to final plat approval by the City: 1. Drainage and erosion control plans shall be approved by the City Engineer. 2. Drainage and utility easements are to be approved by the City Engineer.and shown on the final plat drawing. 3. Access to Outlot A shall be from North Brown Road at a location approved by the City Engineer at the time of any subsequent subdivision or building permit application. 4. Access locations and traffic control plans at and to Lot 1 and Outlot B shall be approved by the City Engineer and the Minnesota Department of Transportation prior to final plat approval. - 5. The subdivider shall present engineering information regarding proposed sewer and water requirements for Lot 1 and Outlot B for review by the City Engineer. If these requirements involve connection to the Long Lake system(s), the subdivider shall provide evidence of approval of such connection by the Long Lake City Council. • 6. The subdivider shall execute and deliver a drainage and utilities easement on the standard City form. h 7. 8. 9. If utility connections to the Long Lake system, or access lane paving and/or frontage road construction is proposed by the subdivider, he shall execute and deliver a Developer's Agreement on the standard City form. The subdivider shall provide a title opinion addressed to the City; dated within 6 weeks of the final plat application. The final plat shall be in the form of at least two reproducible plastic copies and three hardshell mounted copies, all to be in the form acceptable to the County recorder, fully executed by the surveyor, owner and all others with property interest, and one paper copy reduced to a scale of .1" = 200'. 10. No park dedication fee will be required. 11. The applicant shall agree to the requirements and conditions of this resolution and so signify by signing the resolution where provided. AND BE IT ALSO RESOLVED, that the City Council of the City of Orono, hereby conceptually approves the rezoning request of Sidney Rebers subject to the following conditions: 1. The zoning district line will be adjusted approximately 60 ft. north of the existing zoning district boundary line, and recording of this subdivision. 2. The subdivider shall furnish to the City along with the final plat application, a legal description of the property to be rezoned and a legal description of the final zoning district boundary line location. 3. The City Council has considered this rezoning application because the existing zoning district boundary line was mistakenly located so as to bisect a lot of record. 4. The proposed rezoning is consistent with the Comprehensive Guide Plan of the City of Orono. 5. The Subdivider/Applicant shall reimburse the City for all legal and engineering -expenses incurred on account of the rezoning. This resolution will expire onGAprl 16:; 1978 if the applicant has not signed his agreement by that date, and shall also expire on August!T6j9 1978 if the final plat drawing and above required information have not been submitted to the City for final approval.
