RESOLUTION OF THE CITY COUNCIL

B. There is no other reasonable and feasible location for the addition meeting
the code requirements, the hardship being the existing house location and
Lie lot width in relation to the required side street and side yard setback.
C. With appropriate vegetative screening and removal of an encroaching
fence along the north side of the garage, the additions will have no
detrimental impact on the neighborhood.
4. This application is a renewal of variances previously granted via Resolution #2852
(Application File #1566) on August 13. 1990.
The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff, comments
by the applicants and the effect of the proposed variance on the health, safety and
welfare of the community.
6. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the applicants, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial property
right of the applicants; and would be in keeping with the spirit and intent of the
Zoning Code and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
grants a variance to Municipal Zoning Code Section 10.24, Subdivision 5 (B) to permit the
construction of a second story addition and westerly extending room addition to the existing
residence, such additions being 6.5 feet from the side street lot line where a 35 foot side street
setback is normally required, subject to the following conditions:
Applicants shall remove the existing fence area located on the north side of the
garage, prior to footing inspection for the additions.
