RESOLUTION APPROVING BUILDING EXPANSIGN PLANS FOR NAVARRE 11ARDIOM 3400 SHORELINE DRIVE W11REAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of 'Minnesota; and WEREAS, the City Council of the City of Orono has adopted zoning use district regulations for orderly and safe development and the protection of the public health and welfare; and WHEREAS, Mr. S. C. Johnson has presented plans of a proposed building expansion for Navarre Hardware including a requested side yard setback variance; and 10-fEREAS, the Orono Planning Commission and City Council have reviewed said plans for conformity with the intent of the zoning code, for affects upon neighboring properties, and for affects on public access to the rminicipal parking lot and various Navarre area businesses; NOW, TfIEREFORE, BE IT RESOLVED that the City Council of the City of Orono hereby approves a side yard setback variance for construction of this proposed addition subject to the following: 1. A minimum west side setback dimension of 4.0 feet shall exist between the property line and the building wall. 2. The building addition shall be constructed according to all applicable •building code requirements. 3. The property owner, Mr. S. C. Johnson, agrees to grant to the City of Orono, and to file in the chain of title of his property, a public access easement over this four foot side yard, legally described as the westerly four feet of Lot 27, Block 6, Navarre Heights, Hennepin County, Minnesota, for purposes of providing free public access between Shoreline Boulevard and the municipal parking area north of this property. Said access shall be improved with a concrete sidewalk and stairs built to all building code requirements. Said access shall be completed and open for public use prior to the time the building addition is certified for occupancy. 4. The property owner, Mr. S. C. Johnson, agrees to perpetually maintain said access easement including stairs and sidewalk keeping them clean and free of defects, litter and accumulation of snow. 5. The required access easement must be granted and filed in the chain of title, and a building permit must be issued prior to November 14, 1978, or this resolution shall expire on that date.
