A RESOLUTION CONCERNING THE USE OF LONG
LAKE BOULEVARD FIRE LANE 1535-1545 LONG
LAKE BOULEVARD (OTHERWISE KNOWN AS THE
IVY LANE ACCESS)
WHEREAS, the City Council and Planning Commission have
reviewed the petition of eighteen families in the area of Ivy
Lane to use Ivy Lane as a public recreation area, and
WHEREAS, the City Council and Planning Commission have
reviewed the petition of the two neighbors abutting Ivy Lane,
which petition has asked that Ivy Lane be closed for public
use, and
WHEREAS, the Park Board and City Staff have reviewed
this matter at length,
, NOW, THEREFORE, the City Council makes the following
findings of fact: `
• l. The Ivy Lane access has �never been opened as a
public road.
2. The Ivy Lane access consists of a steep wooded
slope to Long Lake.
3. In the past, the citizens in the area have failed
to clean up the Ivy Lane access after use, have placed boats
and other structures on the property, and have conducted them-
selves in such a way as to interfere with the enjoyment of the
private property on both sides of the Ivy Lane access.
4. TYie City will not open this Ivy Lane access
for public access to the lake. The City Staff shall clean
up the Ivy Lane access and remove all structures and other
unnatural material from the Ivy Lane access.
5. The City Staff will remove any structures placed on
the access and any boats beached on the access in the future.
6. The City prohibits the use of Ivy Lane access for
any placement of structures, burning of fires, erection of
docks, placement of trash or other litter, installation or
use of diving docks, swimming raft, or buoys in the lake, and any
use of the access other than incidental use of the access.

7. The City is not opening Ivy Lane access as a public
swimming-or swater skiing area. � �
8. The status of the Ivy Lane access will be reviewed
in October of 1977, to determine whether or not the neighbors
in the area have been able to observe the restrictions set
forth in this resolution and have been able to cooperate with
the private property owners on ,both sides of Ivy Lane access.
9. In the event that i:t appears to the City Council
that the neighbors have been unable to police the Ivy Lane
access on their own, that there is trash or other materials
left in the access and/or that the use of Ivy Lane access
by the neighbors has resulted in the interference with the
enjoyment of the grivate property owned by individuals on
both sides of the access, the City Council will then consider
closing Ivy Lane access for all purposes and arresting any
people using the a.ccess for trespassing on pr.ivate and/or
public property.
10. By this action, the City Council is not vacating
or abandoning any of the previously vested rights of ,the City
• in the Ivy Lane access.
This resolution was adopted by the City Council of Orono,
Minnesota on May 9, 1977, and reviewed by the Council on
May 23, 1977. This resolution was adopted by the City Council
of Orono by a vote of 4� .ayes and 0 nays on May 23, 1977.
