SUBJECT: Subdivision - John Burger - 3700 Bayside Road
John Burger, 3700 Bayside Road, is applying for a subdivision to divide
two acres from his 16 acre parcel and homestead. He will give this to
his son for the purpose of constructing a residence thereon.
The lot meets the requirements of the new zoning for that area.
His survey does not show any easement to the property. He felt they were
going to share a common driveway. I explained it could not legally be
divided that way. He will have this in before the Planning Commission
meeting.
I also explained he would have to have a percolation test approved by the
Village engineer. They hesitate to do this until approval is given.
I charged $102 for this application. He felt this was exhorbitant for
a simple division as this, but I could find nothing in 39.021 to except
this from that fee.

ide Road, be referred to the Planning
Zomission. Motion, Ayes (5) - Nays (0).
Mr. Bill Dickey and Mr. Jack Lynch, of DiCon
Corporation, presented a preliminary plat
showing a site analysis, vegetation analysis,
and drainage analysis of. the Farview sub-
division.
Searles moved, Massengale seconded, to table
until August 27, 1974 any further decisions
on the Farview property when further studies
and specific information on Riparian Rights,
outlots,WA conditions relating to the
development can be discussed. Motion,
Ayes (5) - Nays (0).
The final plat approval for Kermit Knutson,
3640 Bayside Road, was deferred until
August 27, 1974.
Searles moved, Butler seconded, to accept
the preliminary plat of the Roy Starkey
division at 3546 Sixth Avenue worth. Any
further approval will be conditioned on the
Engineer's review. Motion, Ayes (5) -
Mays (0).
Paurus moved, Searles seconded, to table the
Mexican Restaurant on -sale 3.2 beer license
until a report frog the Police Department is
submitted. Motion, Ayes (5) - Nays (0).
Butler moved, Searles seconded, to approve
she building permit for John Keller, 975 North
Arm Drive. Motion, Ayes (5) - Nays (0).

Kullberg moved, Hake seconded, that the
addition be allowed 8' from the front
property line in alignment with the present
residence, conditioned on reeucing any
excessive hard cover on both sides of the
road due to proximity to the lake. Notion,
Ayes (6) - Nays (0).
Members studied the preliminary plat for a
simpla subdivision as presented by John
Burger to divide off a parcel from his
16-acre homesite to contruct a residence
for his son. Since the lot met the require-
ments of the proposed zoning and showed an
adequate 50' easement to the property and
there was no need for future streets in the
area,
Pesek moved, Curtis seconded, that appcoval
be recommended contingent on approved
percolation tests. Motion, Ayes (7) -
Nays (0).
T19%,33 Investment was represented by Frank
Berman in a presentation of a preliminary
plat to divide Parcels 1185, 1525, 4520,
4510, 3500 i 2500 in Sec. 30 i 31 into
54 lots and one outlot. The engineer's
report was read recommending:
1. All preliminary plats should be in accord
with the Comprehensive Plan for the City.
2. Preliminary street showing present grade,
proposed grade (every 1001) complete with per-
c-_nt of grade and showing satisfactory disposition
of storm water.
". Proposed building setback line on all lots.
4. Names of adjacent property owners.
5. The maximum length of a cul-de-sac has been
set by the City's building Code. Preliminary
street layouts must comply with this code.
A further study of the plat, and also site
reviews by members showed there was much marsh
area being divided. Van Nest explained the
r4t:i;;nale behind Ordinance No. 125 and a copy
was given to Mr. Berman along with a check list
for requirements for a preliminary plat.
Discussion now centered around the proposed
five -acre zoning for this area versus the one -
acre platti g proposed by TMG. Van Nest

drafting of a resolution providing for the
transfer of funds and an annual tax levy
schedule for the Navarre water construction
project. Motion, Ayes (4) - Nays (0).
Walsh moved, Paurus seconded, to table the STREET VACATION
Lake Street vacation request until the Lake Street
September 10, 1974 Council meeting. At
that time, the legal department will submit
a review of the request. Motion, Ayes (4) -
Nays (0).
!utler moved, Walsh seconded, to approve VARIANCE
the variance requested by William Dolder, 3505 Livingston Avenue
3505 Livingston Avenue, as documented and
recommended by the Planning Commission.

the Planning Commission and to approve the
transmittal of the Comprehensive Guide Plan
to the Itetro Council for their commentary

The Council at this time wished to express APPRECIATION
their deepest sincere thanks to tor. John Planning Commission
Guthrie, chairman of the Planning Commission,
and Mr. Brad Van Nest, tnd to all the members
who dedicated and contributed so much of their
time to the formulation of thc. Comprehensive
Guide Plan.

ditioned by the Planning Commission August 19,
