The Planning Commission will hold a public hearing in the Council
Chambers at 1275 South Brown Road on Monday, September 15, 1986,
on the matter of the following Land Use Applications:

Discussion:
The applicants are requestl;;g a side setback variance in
order to construct an addition to their existing home. They note
that steep grades uphill and downhill from the house, the
location of existing trees, drainage, and well location are
factors that present hardships resulting in the lc--ation of the
proposed addition.
The addition is for a new kitchen. Note that applicants
installed a new septic system in 1981 which is working well.
The impact of the variance on the only prop.rty affected,
immediately west of the house, appears to be very minimal. The
neighboring lot is vacant, and based on the topography the likely
place for a house on it would be centrally located, hence no
significant encroachment on sunlight or air is apparent. Nor
would the addition have any effect on the development on the
vacant lot.
This house was constructed many years prior to the plat of
"Riede I'a Stubbs Pay Addition" in 1975, which created a
conforming setback but did not anticipate future additions.

Staff Reccamendation:
Staff recommends approval based on the following findings:
1. Location of the proposed addition to the west side of
the existing house as a result of hardships to other
locations due to steep slt as, existing trees, drainage,
location of the well.
?. Tie house way constructed pric, to the recent "Riedel's
Stubbs Bay Addition" subdivision which did not anticipate a
westward expansion of this mouse, and which created the lot
line just west of the house to maintain a 2 acre lot size in
the westerly lot.

Eileen M. Oleen, 1305 North Arm Drive, was present for
this matter.
Assistant Zoning Administrator Gaffron explained that
Ms. Oleen is cr)is -erned about the run-off from the
existing garage onto her property.
Ms. Oleen noted that applicant's property is almost
twice as high as hers and she receives all the run-off
from their property and is opposed to any additional
hardcover being allowed creating more run-off onto her
property.
Chairman Kelley and Goetten recommended draintile or
Arither alternative to correct the drainage problem.
Planning Commission unanimously agreed that the 7.7'
setback variance would be no problem with no additional
hardcover.
No one was present from the public regarding this matter
and the public hearing was closed.
It was moved by Chairman Kelley, seconded by Goetten, to
recommend approval of tt•- side setback variance of 7.7'
subject to:
1) Applicant work with staff to correct drainage
problem.
2) Remove plastic allowing no additional hardcover.

was noted.
Assistant Zoning Administrator Gaffron explained the
request for a 19.9' side setback variance to construct a
kitchen addition noting topography problems as well as
the drainage and well location as hardship factors in
the location of the proposed addition.
Jane Olson was present for this matter and stated that
due to _.he dining room location, and this being a
kitchen addition, the location is most practical without
having to do extensive interior remodeling. In
addition, they would like to take advantage of the lake
view.

recommend approval noting staff's recommended findings.

The Affidavit of Publication and Certificate of Mailing
was noted.
Assistant Zoning Administrator Gaffron explained the
request to allow a guest apartment within the princi-Al
structure. It was noted that the proposed additions
meet all setback requirements. The northwesterly wing
addition is to contain kitchen/bath/living room/bedroom
connected to house only through garage, has its own
separate outside entrance - proposed only for guest
apartment use and "staging" area for catered affairs.
Representing the applicant, was their architect Dale
Mulfinger. He showed the Planning Commission a scale
model of the proposed additions. He noted that the
apartment will be used for guests, mother-in-law, and
possible live-in employees. The purpose of the
additions are to provide more square footage for
entertaining.
Assistant Zoning Administrator Gaffron noted that there
are no hardcover or area problems. He also noted that
the variance would be filed in the chain of title
and would not be transferrable to a different owner.
No one was present from the public regarding this matter
and the public hearing was closed.
It was roved by Goetten, seconded by Bellows, to
recommend approval per staff's recommended conditiLns.

This is a request for a side setback variance to construct a
kitchen addition. Please review the memo and exhibits of 9/9/86.
Planning Commission recommended 6-0 to approve, finding that
the proposed location for the addition on the west side is a
result of hardships to other locations due to topography,
drainage, existing trees, and the layout of the house, and that
the lot line to the west was created recently as part of the

A VARIANCE TO
MUNICIPAL ZONING CODE
SECTION 10.23, SUBDIVISION 6 (B)
FILE 11067
MHBRRAS, Herbert T. Olson (hereinafter "the applicant") is
the owner of the property located at 3640 Bayside Road within the City
of Orono (hereinafter "City") and legs lly described as follows:
Lot 1, Block 1, Riedel's Stubbs Bay Addition, Hennepin County,
Minnesota (hereinafter "the property"); and
WHEREAS, the applicant has applied to the City for a
variance to Municipal Zoning Code Section 10.23, Subdivision 6 (B) to
permit the construction of a room addition to be located 19.9 feet
from the side lot line where a 30' side yard setback is normally
required.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #1067.
2. The property is located it the LR-lA Single Family Lakeshore
Residential Zoning District.
3. The Orono Planning Commission reviewed this application on
September 15, 1986, and recommended approval of the proposed
variance based upon the following findings:
A) Location of the proposed addition to the west side of
the existing house is a result of hardships to other
locations due to steep slopes, existing trees, drainage,
location of the well, and the existing room layout `n the
house.
B) The house was constructed prior to the recent "Riedel's
Stubbs Bay Addition" subdivision which did not anticipate a
westward expansion of this house, and which created the lot
line just west of the house to maintain a 2 acre lot size in
the westerly lot.
4. The proposed addition will not in any way limit the
development of the adjacent Lot 2, Block 1 Riedel's Stubbs Bay
Addition.

5. The City Council has considered this application including
the findings and recommendations of the Planning Commission,
reports by City staff, comments by the applicant and the effect
of the! proposed variance on the health, safety and welfare of the
community.
6. The City Council finds that the conditions existing on this
property are peculiar to it and do not apply generally to other
property in this zoning district; that granting the variance
would not adversely affect traffic conditions, light, air nor
pose it fire hazard or other danger to neighboring property; would
not merely serve as a convenience to the applicant, but is
necessary to alleviate a demonstrable hardship or difficulty; is
necessary to preserve a substantial property right of the
applicant; and would be in keeping wit;, the spirit and intent of
the Zoning Code and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby
grants a variance to the Municipal Zoning Code Section 10.23,
Subdivision 6 (B) to permit the construction of a room addition to be
located 19.9 feast from the side lot line where a 30 foot side yard
setback is normally, subject to the following conditions:
1. The applicant is advised that the currently proposed room
addition may not be constructed or mo9ified to be higher than the
peak height of the roof of the existing house, without an
additional variance review.
2. Authorities granted by this variance run with the property
not with the applicant, but are permissive only and must be
exercised by application for a building permit within one year of
the date of Council approval, or this variance will expire on
that gate (October 13, 1987).
3. Violation of or non-compliance with any of the terms and
conditions of this variance shall constitute a violation of the
zoning cc>de, shall automatically terminate any authority granted
hereir►, and shall be punishable as a misdemeanor.
4. TI•e undersigned applicant has read, understood and hereby
agree[; to the terms of this resolution and on behalf of himself,
his heirs, successors and assigns, hereby agrees to the recording
of this resolution in the chain of title of the property.

Mr. Derby stated that he fully intends to eliminate the
rock beds and replace with grass.
It was moved by Councilmember Callahan, seconded by
Mayor Butler, to adopt Resolution #2059 amending
resolution to read "Applicant must remove all of
plastic from existing rock beds to maintain existing
31.06% hardcover". Motion, Ayes 3, Nays 0.

City Administrator Bernhardson explained the request for
a side setback variance to construct a kitchen addition
19.9' from the lot line.
Councilmember Frahm asked if the the addition could not
be placed elsewhere due to the large area of property.
Assistant Zoning Administrator Gaffron Mated that
Planning Commission had asked that same question,
however applicant pointed out that the proposes' location
for the addition is a result of hardships to other
locations due to topography, drainage, existing trees,
and the layout of the house.
It was moved by Mayor Butler, seconded by Councilmember
Frahm, to adopt Resolution 12060 as drafted approving
the variance. Motion, Ayes 3, Nays 0.

Dr. Glen Nelson and his architect Dale Mulf.inger were
present for this matter.
City Administrator Bernhardson explained the request for
a variance for temporary guest apartment use of an
addition to the residence. He noted that the apartment
may be entered only from outside the house or through
the garage area. Due to the layout of the house, an
entrance to the apartment from ti, main house is not
possible and an outside entrance is required to meet
fire code because the apartment is surrounded by
concrete walls on three sides.
