A RESOLUTION ORDERING SETTLEMENT OF A.CQUISITION,BY
CONDEMNATION OF -THE FRENCH LAKE. SEWAGE TREATMENT
_PLANT'SITE AND APPROVING A SCHEDULE OF PAYMENT
�wHEpAS condemnation, proceedings in the acquisition of the.
French•Lake sewage.treatment plant site have been completed and
: *hd award having been set at $27,800,
NOW BE IT RESOLVED that the Village Attorney be instructed
to .finalize the acquisition of the site -by agreement with the
owner for payment of $8000 now and $19,800 right after January
1 196 in return for a deed conveying a marketable title and
' satisfactory easement.
Adopted by the Village Council at a regular meeting held
October 14,1963.

;... A RESOLUTION ORDERING ACQUISITION OF PERMANENT
AND CONSTRUCTIONAEASEMENTB FOR CERTAIN SANI3'ARY
SEWER IMPROVEMENTS
WHEREAS, in 1962 and 1963'in accordance with the Statutes
_., of .'the State of .Minnesota,the Village Council of "Orono gave
" notic�e.of a public hearing conducted a public hearing giving
} i#terested persons an.opportunity to be heard, and ordered the
corstruct.on of certain sanitary sewer improvements designated
as follows;
'63 TS -Trunk ewer -from on or near County Road 51 from
County Road 84 to County Road 19
63 TS 2 Trunk'sewer on or near County Road 19 from the
terminus of 63 TS 1 to Togo Road.
63'1S 1 .Lateral sewer service on or near County Road 19
+� from Togo Road to County Road 15.
~s 63.LS 2 Lateral sewer service'on or near County Road 15
from County Road 19 to Dunwoody Avenue.
63 .TLS - Trunk line sewer service along the routes as
designated in 63 TS 1 and 63 TS 2.
63_IS;1 Interceptor sewer on County Road 84 from County
Road 51 to sewage treatment plant.
, That for -the purpose of this resolution the above sewer improve-
ments-will

ments will be hereinafter called the Trunk,Lateral and Intercep-
t:or.SS;e Villaanitary-Sewer Improtements of 1963.
WHEREA'thge Council by resolution adopted May 13,1963
approved the detailplans and specifications prepared by William

T. Mills dor construction of certain sanitary sewer improve e-

;.ments designated as.the Trun.k,Lateral and Interceptor Sani-
tary Sewer Sewer. Improvements of 1963; and
WHEREAS, these approved plans indicate that certain pe-r-
manent utility easements,temporary construction .easements and
roadway easements must be acquired in order to complete con-
struct and operate the Trunk,Lateral and Interceptor Sanitary

Sewer Improvements of 1963,accordingly the Village of Orono
has commenced certain condemnation proceedings in the District
.�
Court of Hennepin County,Minnesota,as Condemnation Case #330
for t'he purpose of acquiring said easements,that the easements
sought in said proceedings are necessary and incidental to the
construction of the Trunk,Lateral and Interceptor Sanitary
Sewer Improvements of 1963; and that the easements sought in
said proceedings are those easements designated and set forth
in said approved plans; and
WHEREAS, the Village of Orono hds•previously enacted cer-
tain resolutions authorizing the acquisition of the easements
described above by purchase or condemnation, and that such re-
solutions need clarification for the purpose of indicating that
the easements sought;_in the above described condemnation pro-

ceedings are the same easements that are :set forth in said ap-`
proved plans;
1T61 , THEREF0RE',BE IT RESOLVED by the Village Council of the
Village-of Oron.o,Minnesota,as,follows:
1. Those. permanent utility.easements,temporary constrution
easements and roadway easements required for the comple-r
tion and construction and operation of the Trunk,Lateral
and Interceptor Sanitary Sewer Improvements of 1963',as:,''
such are set forth in the approved plans referred to
above and for the acquisition of which the condemnation °...
proceedings referred to above have been.commenced,shall
, hereby be acquired by purchase or condemnation'.
2. That the acquisition of said eaaementa by said condem-..'`
nation proceedings is necessary and incidental to
completion,construction and operation of the Trunk.,
Lateral and Interceptor Sanitary Sewer Improvements of .,
1963, and that such acquisition is for public-use as

provided for and authorized by law.
