RESOLUT I O N OF T H E C ITY CO U NC I L
N O. 2903
A RESOLUTION APPROVING THE PLAT OF
BAYSIDE RIDGE
FILE NO. 1475
WHEREASr the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota;
and
WHEREASr the City Council of the City of Orono has
adopted subdivision regulations for the orderly, economic and
safe developm~nt of land within the City; and
WHEREASr the City . Counci 1 has considered the
application for a subdivision by John McDowell and Charles N.
Hayssen, the subdividers; and
WHEREASr on February 26, 1990, the City Council
approved Resolution #2762 granting preliminary approval for a
plat at 4045-4135 Bayside Road; and
WHEREASr the proposed plat contains four lots, each
exceeding the 2.0 acre minimum lot area requirement. Lots 1 and
4 contain existing residences, and are included in the plat to
accommodate rearrangement of lot lines. Lots 2 and 3 are created
as two new building sites. Lot 3 requires a variance by virtue
of it being a newly created lot without frontage on a public
roadway. Lot 3 requires a variance to the 200' lot width
standard; and
WHEREASr proposed Lots 2 and 3 are intended to access
to Bayside Road via an easement shared driveway over the
neighboring abutting property between Lots 2 and 3 and Bayside
Road. This shared driveway shall be constructed as a private
driveway and will not be subject to a City Road and Utility
Easement; and
WHEREASr a 25' wide driveway outlot platted as Outlot A ·
is intended to remain in the same ownership as Lot 2 and is
intended to provide legal access to the westerly existing private
easement road should access for Lot 2 become available to that
roadway in the future. It is further intended that until such
time that Lots 2 and 3 gain legal access to Bayside Road via the
existing private road across the neighboring White property, at
that time Lots 2 and 3 shall be required to access to such
private road and all direct access or easement driveway access to
Bayside Road at that time shall be eliminated; and

WHEREAS, the two newly created building lots and the
two existing homestead lots all have been demonstrated to contain
suitable sites for primary and alternate drainfields to serve the
existing or proposed single family residences; and
WHEREAS, except for the variances noted above, the
subdivision has been found to meet all other standards of the LR-
lA zoning district, finding that each lot is of a size and '
configuration that will allow its use as a single family
residence to be fully developed without the need of further
variances; and
WHEREAS, the subdivider has completed all requirements
of the platting regulations of the City, including:
1. Completion of all the requirements of Resolution 12762.
2. Creation of a private driveway outlot shown on the plat
as Outlot A.
3. Applicant has obtained the necessary private driveway
access easement across the adjacent White property, in order
to gain access to Bayside Road for Lots 2 and 3.
4. Payment to the City of a Park Dedication Fee of $2 oq.oo
each for Lots 2 and 3 totaling $400.00.
5. Payment to the City of final plat administrative fee of
$150.00 and legal review and filing fees of $75.00.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Orono hereby approves the plat of Bayside Ridge,
Hennepin County, Minnesota, subject to the following condition:
1. A variance is hereby granted for Lot 2 to the 200' lot
width standard and for lack of frontage on a public roadway.
2. Access to Lots 2 and 3 shall be via the private driveway
easement across the White property to the north. At such
future time that an alternative access becomes legally
available to Lots 2 and 3 via the existing private road near
the westerly boundary of Lot 3 and Outlot A, Lots 2 and 3
shall be required to access to such private road and all
direct access or easement driveway access to Bayside Road
shall at that time be eliminated.
3. Lots 1 and 4 will continue to use and maintain their
private driveway accesses as currently exist.

4. Outlot A shal 1 remain in the same ownership as Lot 2 and
shal 1 serve as future private driveway access to the
existing pr±vate easement road located just west of Lot 3
and Outlot A.
5. The owner of Lots 2 and 3 sha 11 take positive measures
to avoid disruption of the tested and approved primary and
a 1 ternate drain£ ie ld sites within those properties, unti 1
such time as those sites are used for drainfield systems.
6. The aforesaid plat shal 1 be filed by the City of Orono
with the Hennepin County Recorder's Office on or before June
10, 1991 together with a certified original copy of this
Resolution and executed copies of the Private Driveway Acces
Easement as noted above.
The approval granted by this Resolution shall expire if
the plat has not been filed by the date specified above. In that
event, it will be necessary to file a new application with the
City of Orono for subdivision review.
