VOTE: Ayes 4, Nays 0. 8. #04-3021 CITY OF ORONO, ZONING CODE REVISIONS -ORDINANCES NO. 9, 10, 11, 12 and 13 White questioned whether there were a number of current entrance monuments that might be affected by this amendment requiring a 40' setback. Gaffron indicated that these monuments would be non-conforming by this new standard. He pointed out that it would be the City's intent to allow the ability for 1-2 cars stacking at the entrance to be off the traveled roadway. McMillan asked if administrative approval for lot area/width variances would require additional fees. Gaffron stated that they had not established a separate fee for this and likely would not, as it involves minimal staff time. A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTION 78-395 SUBDIVISION B AND SECTION 78-1435 FILE NO. 04-3011 WHEREAS, Thad Douglas Steele and Danielle Rae Steele, husband and wife (hereinafter "the applicants") are the owners of the property located at 4050 Bayside Road within the City of Orono (hereinafter the "City") and legally described as follows: Lot 2, Block 1, Popov Addition, Hennepin County, Minnesota (hereinafter the "property"); and WHEREAS, the applicant has made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-395 Subdivision B to allow a detached garage to be located 75' from the front lot line where a 100' setback is required; and WHEREAS, the applicant has made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-1435 to allow a detached accessory structure to be located nearer to the front lot line than the principal structure. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #04-3011. 2. The property is located in the RR-IA, which requires a minimum lot area of 5 acres and minimum lot width of 300'. The property is 12.7 acres in area and has a lot width of 500'+. 3. The Planning Commission reviewed this application at a public hearing held on May 17, 2004 and recommended approval of the variance based on the following findings: Page 1 of 4 a. The location of the proposed detached garage far removed from the developed portion of adjoining large-lot properties is such that the garage will have little or no visual impact on the adjacent properties or from Bayside Road. b. Existing vegetation will screen the garage from neighboring properties in all seasons. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicant and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Section 78-395 Subdivision B to allow construction of a detached garage 7 5' from the front lot line where a 100' setback is required, and a variance to Orono Municipal Zoning Code Section 78-1435 to allow a detached garage to be constructed closer to the front property line than the principal structure subject to the following conditions: 1. Council approval is based on the site plan submitted by the applicant and annotated by City staff, attached to this Resolution as Exhibit A. Any amendments to the site plan which are not in conformity with City codes will require further Planning Commission and City Council review. 2. Authorities granted by this resolution run with the property not with the applicant, but are permissive only and must be exercised by obtaining a building permit for Page 2 of 4 the new construction within one year of the date of Council approval, or the variance will expire on that date (May 24, 2005). 3. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 4. The undersigned applicants have read, understood and hereby agree to the terms of this resolution and on behalf of the applicants and the applicants' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property. They are requesting variances from City Code Sections 78-395(b) and 78- 1435 in order to construct a detached garage nearer to the front property line than the existing home and at a 75' setback rather than 100' as required by Code. Front Yard Setback Variance & In Front of the Principal Building The applicant has proposed to construct a 24' x 32' detached garage 75' from the front property line and 160' closer to the front property line than the existing home. The rear 4.6 acres of the property is wetland and protected by a drainage easement. The topography of the lot near the home and the location of the existing well and septic system make locating a detached garage difficult in this area. The applicants wish to utilize the existing driveway for access to the proposed garage. The location of the proposed garage will have little or no impact on the adjacent properties. The existing dense vegetation will screen the neighboring properties and Bayside Road from views of the proposed garage in all seasons. Hardship Statement Applicant has completed the Hardship Documentation Form attached as Exhibit B, and should be asked for additional testimony regarding the application. 2 Hardship Analysis FILE #04-3011 May 11, 2004 Page 3 of 3 In considering applications for variance, the Planning Commission shall consider the effect of the proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. The Planning Commission shall consider recommending approval for variances from the literal provisions of the Zoning Code in instances where their strict enforcement would cause undue hardship because of circumstances unique to the individual property under consideration, and shall recommend approval only when it is demonstrated that such actions will be in keeping with the spirit and intent of the Orono Zoning Code. Staff finds that due to the existing vegetation, the orientation of the existing driveway and the location of wetlands to the rear of the property there is a hardship to justify granting the front yard setback variance as well as the variance to be nearer the front lot line than the principle structure. Should the applicants be required to meet the 100' front yard setback significant tree removal would be needed. There is an existing clearing at the location where the detached garage is proposed and little vegetation removal would be required. Issues for Consideration Are there any other issues or concerns with this application? Staff Recommendation Planning Staff recommends approval of the variances as requested. An application will not be considered complete or placed on any meeting agendas until this form is complete and submitted to the City. Minnesota State Statue Section 394.27, Subdivision 7 requires that a hardship be demonstrated in order for a variance to be granted. The hardship must be unique to the property as variances run with the land and not the land owner. Personal and economic situations are not considered valid hardships. In order for an application to be heard by the Planning Commission and City Council a hardship having merit must be demonstrated. HOW DO I PROVE A HARDSHIP? This form has 12 points outlining the basis City staff uses to determine if a hardship exists and how the variance will affect the surrounding community. To prove a hardship, address all the relevant points listed below and answer them as clearly as possible. Since you are requesting the code exception, you have the burden of proving that the variance is justified. The information the City receives is what is used in determining a denial or approval recommendation. If you leave something out it will not be considered. The rights of individual on whom the data is stored or to be stored shall be as set forth in this section. · Subd. 2. Information required to be given individual. An individual asked to supply private or confidential data concerning himself shall be informed of: (a) the purpose and intended use of the requested data within the collecting state agency, political subdivision, or statewide system; (b) whether he may refuse or is legally required to supply the requested data; (c) any known consequence arising from his supplying or refusing to supply private or confidential data; and (d) the identity of other persons or entities authorized by state or federal law to receive the data. This requirement shall not apply when an individual is asked to supply investigative data, pursuant to section 13.82, subdivision 5, to a law enforcement officer. The commissioner of revenue may place the notice required under this subdivision in the individual income tax or property tax refund instructions instead of on those forms. Subd. 3. Access to data by individual. Upon request to a responsible authority, an individual shall be informed whether he is the subject of stored data on individuals, and whether it is classified as public, private or confidential. Upon his further request, an individual who is the subject of stored private or public data on individuals shall be shown the data without any charge to him and, if he desires, shall be informed of the content and meaning of that data. After an individual has been shown the private data and informed of its meaning, the data need not be disclosed to him for six months thereafter unless a dispute or action pursuant to this section is pending or additional data on the individual has been collected or created. The . responsible authority shall provide copies of the private or public data upon request by the individual subject of the data. The responsible authority may require the requesting person to pay the actual costs of making, certifying, and compiling the copies. The responsible authority shall comply immediately, if possible, with any request made pursuant to this subdivision, or within five days of the date of the request, excluding Saturdays, Sundays and legal holidays, if immediate compliance is not possible. If he cannot comply with the request within that time, he shall so inform the individual, and may have an additional five days within which to comply with the request, excluding Saturdays, Sundays and legal holidays. Subd. 4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or private data concerning himself. To exercise this right, an individual shall notify in writing the responsible authority describing the nature of the disagreement. The responsible authority shall within 30 days either: (a) correct the data found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or incomplete data, including recipients named by the individual; or (b) notify the individual that he believes the data to be correct. Data in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data.
