Planning Commission Recommendation On June 15th, the Planning Commission voted 5 to O (Thiesse abstained) to recommend approval o f lot area, lot width, s ide street setback and front yard setback variances resulting in the proposed setbacks tabl ed above, consiste nt with the s taff recommendation. #15-3748 9 July 2015 Page 2 of 2 No one spoke in support or opposition to the request, though 5 letters in support have bee n recei ved. The Planning Commission recommended approval of the variances as proposed. The Planning Commission report prov ides the full ana l ys is of the project. Properties served by City sewer have a required 75-foot setback requirement from the OWHL (929.4'); The house was constructed in 1958, before the establishment of the lot size criteria outlined in the current code . The existing structure is setback from the water 83 feet, and from the north and south property lines 10.3 and 10.2 feet, respectively. The average lakeshore line clips the existing structure, a small portion of the house and the deck encroach into the setback area. The existing detached garage sits 6.5 feet from the street front line, and 10.8 and 6.9 from the north and south side property lines. The proposed project will be clipped by the line in approximately the same area . The project attempts to mitigate the encroachment by trading house encroachment for approximately 58 s.f of deck on each of the top two floors. The neighboring property most subject to impa ct is the property to the south, this structure is 90 feet away. Hardcover Variance F ILE# 15-3748 15 June 2015 Page 3 of 4 The existing improvements exceed allowable limits for both the structure and hardcover. The proposed improvements reduce the hardcover by over 350 s.f., and increase the structural coverage by a marginal amount. Side yard setbacks. Maintaining the required 30' side yard setbacks renders the property unbuildable . The proposed improvements center the garage on the lot, and move the living portion of the house marginally closer (2 inches) to the north neighbor. Pertinent Authority In reviewing applications for variance, the Planning Commission shall consider the effect of the proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. The Planning Commission shall consider recommending approval for variances from the literal provisions of the Zoning Code in instances where their strict enforcement would cause practical difficulties because of circumstances unique to the individual property under consideration, and shall recommend approval only when it is demonstrated that such actions will be in keeping with the spirit and intent of the Orono Zoning Code. Economic considerations alone do not constitute practical difficulties. Practical difficulties also include but are not limited to inadequate access to direct sunlight for solar energy systems. Variances shall be granted for earth-sheltered construction as defined in Minn. Stat. § 216C.06, subd . 2, when in harmony with this chapter. The board or the council may not permit as a variance any use that is not permitted under this chapter for property in the zone where the affected person's land is located. The board or council may permit as a variance the temporary use of a one-family dwelling as a two-family dwelling. According to MN §462.537 Subd. 6(2) variances shall only be permitted when: 1. The variance is in harmony with the general intent and purpose of the Ordinance . 2. The variance is consistent with the comprehensive plan. 3. The applicant establishes that there are practical difficulties a. The property owner proposes to use the property in a reasonable manner not permitted by the official controls; b. There are circumstances unique to the property not created by the landowner; and c. The variance will not alter the essential character of the locality. Additionally City Code 78-123 provides additional parameters within which a var iance may be granted as follows: 4. The specia l conditions applying to the structure or land in question are peculiar to such property or immediately adjoining property. 5. The conditions do not apply generally to other land or structures in the district in which the land is located. 6. The granting of th e application is nece ssary for the preservation and enjoyment of a substantial property right of the applicant. 7. The granting of th e proposed variance will not in any way impair hea lth, safety, comfort or morals, or in any other respect be contrary to the intent of this chapter. 8. Th e granting of such variance will not merely serve as a convenience to the applicant, but is necessary to alleviate demonstrable difficulty. Practical Difficulties Statement FILE# 15-3748 15 June 2015 Page 4 of 4 Applicant has completed the Practical Difficulties Documentation Form attached as Exhibit B, and should be asked for additional testimony regarding the application. Practical Difficulties Analysis The lot size and area are preexisting conditions, not changed by the applicant. As noted previously, the side yard setbacks overlap; respecting the setbacks would not allow any construction, or enlargement of the existing structure. Staff finds that the proposed improvements are consistent with the character of the neighborhood, and the applicant has made an attempt to mitigate or minimize negative impacts to the adjoining properties. Further, it does not appear that the adjacent property owners will be adversely impacted by the redevelopment of the property. Staff finds that there are special conditions relating to the existing home and property which support granting the requested average lakeshore, side yard, lot size and lot area variances. Issues for Consideration 1. Does the Planning Commission find that that the second level deck negatively impact views from the property owner to the south? 2. Does the Planning Commission find that the variances, if granted, will not alter the essential character of the neighborhood? 3. Does the Commission find it necessary to impose conditions in order to mitigate the impacts created by the granting of the requested variances? 4. Are there any other issues or concerns with this application? Staff Recommendation The Planning Commission should evaluate the practical difficulty criteria against the requested variances and make a recommendation to the City Council. Planning Staff recommends approval of the variances to allow the redevelopment of the property for a new two story residential structure with attached garage. Reasonable manner: under the present official zoning controls, the present lot size is conforming, the lot width is conforming only from the front (lakeside) of the existing home (located approximately 15 ' in back of the average lakeshore setback on the north side) to the lake, and the present hardcover overall is non-conforming; despite being permitted under less restricfo,:e zoning controls.at some past dates. 3855 -Bayside Road has unique to itself P,roperty configurations that inhibit and prevent reasonable use under present day official controls: a. The property will undergo additional development with a replacement structure including a new home & garage structure which replaces the existing home & garage. The proposed new construction will be essentially located in the same place as the existing home & garage structure to be revised to meet or improve present setbacks, meet maximum height requirements, and structural coverage requirements , preserving and improving the essential character of the locality. · . 4. "Economi~ considerations alone shall not constitute an undue hardship if reasonable use for the property exists under'the terms of the Zoning Chapter." Economic considerations are not any significant reason for redevelopment and the granting of variances . The primary reason for this request are: a. Deteriorated structural , energy efficiency, construction and functional obsolescence. 5. "Practical difficulties include, but is not limited to, inadequate access to direct sunlight for solar energy systems. Variances shall be granted. for earth sheltered construction as defined in Minnesota Statutes, Section 116J.06, Subd. 2, when in harmony with this Chapter." This is not a reason for the variances requested or some of the existing non-conformities to be continued. 6. "The Board of Appeals and Adjustments or the 'Council may not permit as a variance any use that is not permitted under this Chapter for property in the zone where the affected person's land is \ . located." . This request is consistent with the present allowed uses under the ordinance. 7. "-The Board or Council may permit as a variance the temporary use of a one-family dwelling as a two-family dw-elling." Does not apply. 8. The proposed project will be clipped by the line in approximately the same area. The project attempts to mitigate the encroachment by trading house encroachment for approximately 58 square feet of deck on each of the top two floors. The neighboring property most subject to impact is the property to the south. Maintaining the required 30-foot side yard setbacks renders the property unbuildable. The proposed improvements center the garage on the lot and move the living portion of the house marginally closer to the north neighbor. Staff finds the lot size and lot area are pre-existing conditions and not caused by the applicant. In addition, Staff finds that the proposed improvements are consistent with the character of the neighborhood and the applicant has made an attempt to mitigate or minimize negative impacts to the adjoining properties. Further, it does not appear that the adjacent property owners will be adversely impacted by the redevelopment of the property. Staff finds there are special conditions relating to the existing home and property which support granting the requested average lakeshore, side yard, lot size and lot area variances. Planning Staff recommends approval of the variances to allow redevelopment of the property as proposed. Landgraver asked if the applicant is staying within the portion that clips the average lakeshore setback and not expanding it. Lemke noted they are moving it back slightly. Leskinen stated there is a reduction in the encroachment. John Thiesse, Applicant, stated they did pull the house back and that the original deck was actually ten feet back from the existing deck. Thiesse indicated they have worked hard to fit the structure in with the area that is left and that it is a very difficult site. Mike Sharratt, Designer, stated they have worked very hard on this project and that they did not want to ask for anything more than what is absolutely necessary. Sharratt pointed out where the deck has been pushed back ten feet further. Sharratt stated they also connected the garage to the house and left the existing footprint of the house in the location it was . Sharratt stated the dimensions are the same for the house and garage. The garage has been pulled further away from the street to 12 feet where it is presently at approximately 6.5 feet. Sharratt stated given the constraints of the site, this is a very reasonable proposal. Chair Leskinen opened the public hearing at 9:53 p.m. There were no public comments regarding this application. An application will not be considered complete or placed on any meeting agendas until this form is complete and submitted to the City. Minnesota State Statutes Section 462.357, Subdivision 6(2) requires that practical difficulties be demonstrated in order for a variance to be granted. The difficulties must be unique to the property as variances run with the land and not the land owner. Personal and economic situations are not considered valid practical difficulties. In order for an application to be heard by the Planning Commission and City Council practical difficulties having merit must be demonstrated. HOW DO I PROVE A PRACTICAL DIFFICULTY? This form has 12 points outlining the basis City staff uses to determine if practical difficulties exist and how the variance will affect the surrounding community. To prove practical difficulties, address all the relevant points listed below and answer them as clearly as possible. Since you are requesting the code exception, you have the burden of proving that the variance is justified. The information the City receives is what is used in determining a denial or approval recommendation. If you leave something out it will not be considered. Please address each of the twelve practical difficulties criteria as they relate to the request, if they do not apply, write NIA in the space provided: 1.
