Additiona1 Comments and P1anning Commission Recommendation
December 4, 1992
It was the general consensus of the Planning Commission that
the proposed improvements appear intense in consideration of the
severely substandard property but the project will result in a 5%
reduction of hardcover and improvements will not expand beyond
the existing building envelope. The enclosure of the existing
open deck area will intensify the existing average lakeshore
setback encroachment but there is no visual impact on lakeshore
views because of the curved shoreline.
The Planning Commission recommended approval of the
application as proposed subject to the residence being connected
to sewer when it is made available. The applicant has advised
that it is his intention to connect to the sewer as soon as it is
available to his property. Staff has been advised by the Public
Works Director that the Thiesse's property is located within the
first area to receive sewer and it should be available sometime
in January. Staff would recommend that approval be conditioned
on sewer being connected to the property prior to the Building
Inspector's final inspection for the proposed structural
improvements of the existing residence. The enclosed approval
resolution has been drafted per the Planning Commission's
approval recommendation.

A RESOLUTION GRANTING
VARIANCES TO
MUNICIPAL ZONING CODE
SECTION 10.22, SUBDIVISION 2 AND
SECTION 10.23, SUBDIVISION 6 (B)
FILE #1529
WHEREAS, John Thiesse (hereinafter "the applicant") is
the owner of the property located at 3 8 4 5 Bayside Road within the
City of Orono (hereinafter "City") and legally described as
follows:
Lot 62, Auditors Subdivision #203, Hennepin County,
Minnesota (hereinafter "the property"); and
WHEREAS, the applicant has applied to the City for a
variance to Municipal Zoning Code Section 10.22, Subdivision 2
and Section 10.23, Subdivision 6 (B) to permit the construction
of an attached garage located 24' from the north side lot line,
and 9.3' from the south side lot line, where 30' side setbacks
are normally required, and located 6.7' from the street lot line
where a 50' setback is normally required, and increasing the
hardcover in the 75-250' setback zone to 50.4%, where only 25%
hardcover is normally allowed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
Orono, Minnesota~
FINDINGS
1. This application was reviewed as Zoning File #1529.
2. The property is located in the LR-lA Single Family
Lakeshore Residential Zoning District.
3. The Orono Planning Commission reviewed this application
on May 21, 1990, and recommended approval of the proposed
variance based upon the following findings:
a) This is the only feasible location for a garage on
the property.

b) Hennepin County has given.the applicant a verbal
approval of the driveway layout proposed.
c) The proposed garage and driveway location will
leave adequate room for parking vehicles off the
traveled roadway.
d) Other possible garage configurations would require
additional variances but provide less functional access
to the garage.
e) Because the adjacent property to the northeast is
an outlet required to be maintained for lake access
purposes for properties within the plat of Bayside
Landing, this area which the applicant currently
maintains appears visually a part of applicant's yard
area and reduces the impact of the additional structure
on visual density in the neighborhood.
f) There is no excess hardcover on the property which
can be feasibly removed to reduce the hardcover
percentage on the property. There is no hardcover in
the 0-75' zone. The extremely small size of the lot
(approximately 8,000 square feet) and the fact that
there ,is no additional land available to be purchased,
are hardships to the property which help justify
granting of the variances.
4. The City Council has considered this application
including the findings and recommendations of the Planning
Commission, reports by City staff, comments by the applicant
and the effect of the proposed variance on the health,
safety and welfare of the community.
5. The City Council finds that the conditions existing on
this property are peculiar to it and do not apply generally
to other property in this zoning district; that granting the
variance would not adversely affect traffic conditions,
light, air nor pose a fire hazard or other danger to
neighboring property; .would not merely serve as a
convenience to the applicant, but is necessary to alleviate
a demonstrable hardship or difficulty; is necessary to
preserve a substantial property right of the applicant; and
would be in keeping with the spirit and intent of the Zoning
Code and Comprehensive Plan of the City •. · , ._··_

CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the findings noted above, the
Orono City Council hereby grants a variance to Municipal Zoning
Code Section 10.22, Subdivision 2 to allow 50.4% hardcover in the
75-250' setback zone where only 25% hardcover is normally
allowed, and grants variances to Section 10.23, Subdivision 6 (B)
to allow construction of the proposed attached garage located
9. 3' from the south side 1 ine, 2 4' from the north side lot 1 ine,
and 6.7' from the street lot line, subject to the following
conditions:
1. Hardcover on the property sha 11 be 1 imi ted to 2,230
square feet or 50.4%, in the areas shown on the attached
survey (Exhibit A). The applicant is advised that any
future proposal to increase hardcover on the property will
not be approved, but might be approved only in conjunction
with concurrent removals of existing hardcover, resulting in
no net hardcover increase.
2. Authorities granted by this resolution run with the
property not with the applicant, but are permissive only and
must be exercised by application for a building permit
within one year of the date of Council approval, or this
variance will expire on that date (May 29, 1991).
3. Violation of or non-compliance with any of the terms and
conditions of this variance shall constitute a violation of
the zoning code, shall automatically terminate any authority
granted he~ein, and shall be punishable as a misdemeanor.
4. The undersigned applicant has read, understood and
hereby agrees to the terms of this resolution and on behalf
of himself, ~is heirs, successors and assigns, hereby agrees
to the recording of this resolution in the chain of title of
the property.

HELD NOVEMBER 16, 1992
ZONING FILE #1775 -CONT.
It was moved by Be I I ows, seconded by Ke I I ey, to recommend approva I
of Application #1775 for Robert D. Luesse, 3249 Casco Circle, for
variances to al low a 22 x 24' attached garage. Ayes 3, nays 3.
Rowlette, Johnson and Peterson voted nay. Motion failed .
Luesse indicated he would be wi 11 ing to remove the existing deck
on the side of the house in I isu of the addition to the front of
the home. The deck is 8 1/2 x 24' or 204 s.f. He added, he would
have to retain a smal I access to the side of the house because of
the grade change.
It was moved by Schroeder, seconded by Bel lows, to recommend
approval of Application #1775 for Robert D. Luesse, 3249 Casco
Circle, approving variances to construct an attached 22x24' garage
and an addition to the front of the house, subject to the removal
of the side deck exc I us ion of a sma I I I anding area. The motion does
not include approval of the greenhouse addition. ·Ayes 5, nays 1.
Rowlette voted nay. Motion carried.

VARIANCE -PUBLIC HEARING 10:45 -11:03 P.M.
The Affidavit of Publication and Certificate of Mai I ing were noted.
John Thiesse was present.
Mabusth explained the property abuts the riparian outlot for the
Bayside plat. A neighbor to the north claims encroachment of entry
steps into the out lot, which staff has determined to be incorrect.
The proposal reduces 75-250 ' hardcover from 50% to 45%. She
reviewed the proposed changes: part of the existing deck on the
east side wi 11 be enclosed, the remainder of the deck structure
wi 11 remain open deck area, an intensification of the structure
with the addition of a second story and a second story entry
addition. She noted a s Ii ght encroachment of the average I akeshore
setback, but stated it wi 11 not impact views of neighbors because
of the curved shore I ine.
Thiesse said he has tried to purchase the property adjacent to his,
but it would not help the situation as the property is totally
within the 0-75' zone . He added, because the out lot is unbui ldable,
there wi 11 be no v i sual change in the area.
Bel lows stated she is sympathetic to the situation, but cannot
consider doub Ii ng the size of a structure on a sub-standard I ot.

there wasn't much difference once the roof is on the structure.

for variances to construct additions to his existing residence,
subject to the property connecting to sewer when available. Ayes
6, nays 0.

Description of Request
The applicant proposes a second story addition over the existing
24 X 34' building envelope. A 12' X 14' three season porch is
proposed in the northeast corner of the present lakeside deck
area and a two story 5 X 5' entry addition is proposed to the
street side of the existing residence. Refer to Exhibits E, Hl-
3, I and J.
Applicant proposes a 5.4% reduction in hardcover by removing
approximately 233 sq ft of non-structural hardcover.
There is a slight encroachment of the average lakeshore setback
but because of the curved shoreline there is no impact on
neighbor to south's view of lake.
Setback variances are required for the intensifation of the
structure where ever a substandard setback is shown. This would
include both north and south side yards and street yard. There
is no hardcover within the 0-75' setback area.
Please refer to ExhibitsD and G, the Harren's letter. It appears
the side entry steps are located 7' from the side lot 1 ine rather
than encroaching Outlot A jointly owned by both Harrens and
Evans. Outlot A is a riparian access outlot created in the
Bayside Landing Plat for shared access for the owners of Lots 1
and 2. Mrs. Harren has advised both staff and the applicant of
their concern for the potential liability as joint owner of

property. Staff has asked Mr. Thiesse to provide additional
survey information to clarify the actual location of the north
lot line. At a site inspection staff met with Mr. Thiesse who
located the iron markers shown on survey. Mr. Thiesse advises he
is in the process of reviewing the County's records to determine
if there is any problem. Applicant has advised that he would be
willing to purchase additional land from the owner. Staff has
also advised of the limitations on such an acquisition because of
the need to maintain specific areas of the property to allow for
continued shared use of the riparian outlot. Staff has reviewed
the preliminary survey prepared for the Bayside Landing
application and note there is no encroachment of the Thiesse
steps shown in the Gronberg surveys. Mr. Thiesse has also
advised that he will agree that there will be no use or
encroachment by builders of the adjacent outlot at the time of
construction.
The Thiesse residence will soon be served with sewer. A
building permit can not be issued for any bedroom expansions
until the house is connected to sewer.

In 1988, Sherri and I had been married for ten years and had no children. We purchased
a house in Orono that would satisfactorily accommodate our lives . Since that time our
family has grown. Our second child is due in January . The house we live in has a little
more than 800 square feet of living area on the main level. This area includes two
bedrooms and the only bathroom in the house.
Our family is very happy where we live, but our house is too small for us.
Our lot is below present city standards for size , therefore I believe that the only
reasonable direction for expansion is up. By placing a second story over the existing
house and relocating the entrances, substantial reduction in hardcover can be
accomplished. Two areas of the variance request propose intensification of existing
hardcover. In both cases, I cite "life in Minnesota" as the hardship.
The first intensification of hardcover is a small entry over the front step that acts as a
combination air-lock to the outside/connecting link from the house to the garage . This
small entry would keep the north wind of wmter out of the main part of the house as
doors are opened.
The second intensification of hardcover is a porch covering half of the existing deck.
This porch would allow us to enjoy the summer evenings without being eaten by
mosquitoes .
The remainder of the proposed expansion is adding another level under the existing
roofline.
I have discussed this request for variance with my two most immediate neighbors ,
Ms. Peggy Peterson and Ms. Cindy Rowlette. Neither of these neighbors have objections
to my proposal.

#1780 The City of Orono seeks approval of a
residential subdivision consisting of two residential
lots and a wilderness park area of the property located
at 1000 Old Crystal Bay Road.
#1785 David Carlson proposes a residential subdivision
of a lot line rearrangement involving properties
located at 600 Big Island (formerly Record Lot 60), 610
Big Island (formerly Record Lot 34) and 620 Big Island
(formerly Record Lot 28). The subdivision also
proposes the creation of an easement for the purpose of
sharing in the use of a septic system involving
properties at 610 and 620 Big Island.
This comprehensive subdivision application also
includes Applications 1781, 1782, 1783 and 1784
consisting of variances and conditional use permits
involving 610 and 620 Big Island. The applicant, David
Carlson, proposes the removal of existing cabins and
replacing with new structures requiring variances to
the average lakeshore setback line and for land
alterations within the flood fringe district in
addition to a conditional use permit for these land
alterations.
The Planning Commission will also hold public hearings to review the

Sl.3.0,4 RIGHTS OF SUBJECTS OF DATA
Subdivision l Type of data.. The rights of individuals on whom the data is
stored or to be stored shall be as set forth in this section.
Subd. 2. Information required to be given individual. An.individual asked to
· supply private or confidential data concerning himself shall be informed of: (a) the
purpose and intended use of the requested data within the collecting state agency,
political subdivision, or statewide system; (b) whether he may refuse or is legally
required to supply the requested data; (c) any known consequence arising from his
supplying or refusing to supply private or confidential data; and (d) the identity of
other persons or entities authorized by state or federal law to receive the data. This.
requirement shall not apply when an individual is asked to supply investigative data,
pursuant to section 13.82, subdivision 5, to a law enforcement officer.

Subd. 3 •. ··· Access to data. by·· individual. Upon request to a responsible
authority, an individual shall be informed whether he is the subject of stored data on
individuals; and whether it is classified as public, private or confidential. Upon his
. further request, an individual who is the subject of stored private or public data on
individuals shall be shown the data without any charge to him and, if he_ desires, shell
Se informed of the content and meaning of that data. After an individual has been
shown the private data and iniormed of its meaning, the data need not be disclosed to
him for six months thereafter unless a dispute or action pursuant to this section is
pending or additional data on the individual has been collected or created. The
responsible authority shall provide copies of the private or public data upon request by
the individual subject of the data. The responsible authority may require the
requesting person to pay the actual costs of making, certifying, and compiling the
copies. ·
The responsible authority shall comply immediately, if possible, with any request
made pursuant to this subdivision, or within five days of the date of the request,
excluding Saturdays, Sundays and legal holidays, if· immediate compliance is not
possible. If he cannot comply with the request within that time, he shell so inform the
individual, and may have an additional five days within which to comply with the
request, excluding Saturdays, Sundays and legal holidays. -----·
Subd. 4. Procedure when data is not aceurate or complete. An individual may
contest the accuracy or completeness ·of public or private data concerning himself. To
exercise this right, an individual shall notify in writing the responsible authority
describing the nature of the disagreement. The responsible authority shall within 30
days either: (a) correct the data found to be inaccurate or incomplete and attempt to
notify past recipients of inaccurate or incomplete data, including recipients named by
the individual; or (b) notify the individual that he believes the data to be correct.
Data in dispute shall be disclosed only if the individual's statement of disagreement is
included with the disclosed data.
. The determination of the responsible authority may be appealed pursuant to the
provisions ~f the administrative procedure act relating to contested cases.
