Park Commission. The only comment that the Engineer had regarding this

entered the property from Stubb's Bay Roa<l because of the steep slope.

Mr. Charles Spear h~s submitted a revised ore! irninary plat indicating 8
lots that would be combined to provide 4 bui I ding sites. Since we do not have
a comprehensive plan 1~hich v1ould indicate I acre lots, a pre! iminar-y plat 1~ith

be granted from the required 15' side yar<l
setback and a 50' setback from the roa<l right-
of-way. Althoug:\ the ar ca is zoned for l½ acre
lots, the lot is only 3/4 acre, and due to its
irregular shape, and the need to maintain a
50' setback from the lake, it becomes difficult
to design a home without a variance,
The Rovick' s architect, /,Ir. Alexander, informed
the Planning Commission ti1at witi1 a minor
modification, the need for a side yard set-
back variance could be eliminated, leaving
only a 15' variance from the road setback
requirement.
The Zoning Administrator informed the Planning
Commission members that no final plat had
ever 0een filed for this property, according
to Village records, although the County <lid
r<.;cord the division. The Zoning Administrator
advised the Planning Commission that they could
take action on the requested variance, but they
should be aware of this discrepancy.

As you know, Riedel Company is also the owner of Lots 1 and 16, Block 3,
Bay View Park and Lot 16, Block 1, Bay View Park. We propose to convey
Lot 16, Block 1 to the ultimate owner of Lot 1 in the Subdivision of Lot
49, and we propose to coLvey Lot 16, Block 3 to the ultimate owner of Lot
2 in the Subdivision plat, and we prop0se to convey the West Half of Lot 1, Block

Dear Dexter:
We have reviewed the preliminary plat of the subject property
prepared by Gordon Coffin dated July 17, 1973. The information
which we have received is insufficient for us to make a proper
judgment on the proposed plat of the property. We observe from
the property that three of the lots are shown as 2 acres, and
one is 1.45 acres. We also have difficulty in evaiuating the
plat on the basis of the grades. The proposed streets will have
some very severe cuts or some very steep grades which would
possibly be unac~eptable. In order to satisfactorily review
and approve this plat, we would need to know the proposed street
grades, the proposed grading of the lots and how the runoff water
would be handled. With answers to these questions, we could
provide an adequate review of the proposed plat.
If you have any further questions, please do not hesitate to

license for Paul's Landing. In the event
that Paul does not provide the staff with
sufficient information upon which a decision
can be made by the May 13, 1974 meeting, the
Council will take action that it feels is
necessary without having received sufficient

a proposal ready for the council at the May 13,
1974 meeting with recommendations for the

the future policy of docks in that area can
be established. Hardship was recognized to
be the shape of the lot, for part of it lies

Subject: Proposed Replat of Lot 49,

Dear Dexter:
We have reviewed the proposed grading, drainage and street
profile on the subject project and would like to offer the
following comments.
The proposed street leaves Stubbs Bay Road at a 2% grade
and then increases to an 8 % grade. This j_s a fa i.rly steep
grade, and normally a reasonable maximum is 7% for a city
thoroughfare. However, since this will be serving only a
limited nwnber of homes, it would be acceptable to permit
this grade at 8%. It should be recognized, however, that
it will be a steep hill.
The grading at the edge of Stubbs Bay Road calls for a
cut of 16' through the hill. While not shown on the plans,
the banks on both sides of the approach should be well cut
back so as to have a sight distance both ways on Stubbs Bay
Road to permit a clear view of traffic before entering the
street. It should be a requirement in the approval of this
plat that this hill be cut back at the entrance.
Other than that the proposed grading and drainage plan
appears to be satisfactory. If you have any further questions,
please do not hesitate to contact us.

Thank you for submitting this plat for cur review. We have reviewed the proposed
plat and have the following recommendations:
1. Dedicate right of way for a total distance of 33 feet along and on
both sides of the existing traveled centerline of CSAH 84, after
which request that the County of Hennepin vacate the unused portion
of the originally platted roadway.
2. Access to the plat should be limited to the proposed street as shown
on the plat, this street having its access from Stubbs Bay Road.
Access to the individual lots should be from the proposed street,
rather than CSAH 84. Any access to the lots lying south of CSAH 84
will require an entrance permit which must be obtained from our

Charles Spear, represenLing Kermit Knutson, has asked to be placed
on the Council agenda, August 13, 1974, for final plat approval. I
have asked from him and he stated he would forward:
l. $8~000 performance bond specified by the engineer that the street
will be built to Village standards
2. A park dedication of $1,125 computed at 5% of the raw land value
appraised at $22,500 by the assessor. I cannot find any ordinance
on this but note the last three divisions all required that per-
centage.
3. I requested he name the street which was not named on the preliminary
plat.

Dear Mr. Scheller:
J. P. Riedel & Company were the owners of Lot 16, Block 1, Bay View Park
and Lots land 16, Block 3, Bay View Park.
Riedel Company conveyed to Hennepin County almost all of the land con-
tained within the boundaries of the above three lots. How2ver, a amall
triangular sliver of lnnd was retained by Riedel Company, and I am en-
closing a drawing received from :V.r. Coffin which shows the triangular
sliver of land retained by Hiedel Company.
~ My question pertains to Lot 1, Block 3, Bay View Park. We propose to
convey the East half of that triangular sliver of land contained in Lot 1,
Block 3 to the purchaser of 3640 BaYside Road. That, of cour&e, is
technically a division of a ~arce• of land lying within the boundary of
the City of Orono and necessitates approval of the city. At a future
date we would also like to make the same kind of division of Lot 16,
Block 3, Bay View Park, but at this time we are concerned only with Lot 1,
Block 3, Bay View Park.
When the preliminary plat was app=oved as shown by the April 22, 1974
minutes of the council, it was further st9.teci in the minutes as follows:
"It is further stipulated that four docks will be authorized
at this time until the future policy of docks in that area
CP.:1. be established."
We wish to request the City of Orono to authorize the division of the tri-
angular strip of land so that the purchaser will have ownership of land
from which he could erect a dock when the permit is issued for such er.ection.
The legal description I propose to use for the East half of said triangular
strip in Lot 1, Block 3, Bay View Park is attached to the drawing.
As the sliver of land is only about 4 feet wide at its widest end and then
narrows down to a foot or so, and as there is no structure on the land, and
as four docks have already been authorized, Mr. Rolfe Worden, attorney for
the City of Orono, thought we could get fast approval of this land division.
Any attention you can give this matter ftill be greatly appreciated.

I enclose a Quitclaim Deed from the City of Orono to
J. P. Riedel & Company for a certain portion of vacated Lake
View Avenue and two Quitclaim Deeds from J. P. Riedel & Com-
pany to the City of Orono granting to the City scenic ease-
ments over the property described therein.
It is my understanding that you will file the two
scenic easements in the Office of the Registrar of Titles
upon completion of the torrens pro9eedings next Tuesday.
I am also relying upon the additional representations made
by you in your letter to me dated June 26, 1975.
This letter represents my recommendation to Mayor
Robert Searles and Clerk-Administrator Richard Benson that
the enclosed deeds will effectuate the terms and conditions
set forth by the Cc~ncil at the June 24, 197S Council meet-
ing and at several Council meetings prior thereto.
If you deliver the Q~itclaim Deed from Orono to J.P.
Riedel & Company, the Mayor and the Clerk-Administrator will
sign it.
I enclose the Contract for Deed and addendum thereto.

The Planning Coxmnission recommended approval of the Final
Plat as shown on the handcopies and milars submitted.

Richard Gothmann, represented himself in a
petition to place a bait shop in the building
that housed the former Mac's Pizza at 14,10
Shoreline Drive. Muhich stated the Planning
Commission had given a recommendation for
approval with cohditions. He showed a parking
plan which was in conformance and a three-
year planting schedule as follows: First year,
three ash trees to be planted; second year, a
3 1 X 8' roughhewn planter to be planted with
Juniper; third year, planting across the highway.
Massehgale advised placing exact conditions in
the Minutes. ~hat this is a non-conforming use
in its present status with two residences, along
with the subject building on the property and
a busy usage across the street. Also, setbacks
are not in conformance.
Paurus moved, Butler seconded, to approve the
usage with the followin.g conditions:
1. No other usage than a bait shop, including ~ocks.

Stan Straley took exception to the above approval
saying he was turned down for a bait shop and
boat rental on Maxwell Bay last year. Searles
stated that at that time there was a moratorium
on all usage to allow study of the B-2 area for
the comprehensive plan and lake density.
After members studied the final plat of Charles
Spear, 3640 Ba~ide Road, Riedel Company Stubb's
Day Adctition,
Butler moved, Paurus seconded, that the final plat,
Riedel Company Stubb's Bny Addition, 3640 Bayside
Road, for Charles Spear, be approved. notion,

Muhich presented the variance petition of Michaei
Pirich, 2224 Shadywood Road. Brought out was th.at
a variance for the same usage had been granted on
this site on May 28, 1974, which under present
ordinances expired on May 28, 1975. The Planning
Commission now recommends reapproval.
Welsh moved, Butler seconded, that the variance be
granted for lot width and size only, not setbacks
for Hibhael Pirich, 2224 Shadywood Road. Motion,
Ayes (5) -Nays {O).

Dear Dick:
We have received a sketch from Hank regarding a sketch
by Gordon R. Coffin for J.P. Riedel & Company, Block 3, Bay
View Park Hennepin County, MinnesoLa. In a letter from Mr.
Stern, Attorney for Riedel Company he proposP.~ ~hat in o~Lcr
to construct four docks on ~he portion of Lot~ and 16, Blo~k
3, Bay View Park they would like to divide these little slivers
of lots into half. To give a little background information, as
a result of straighting out some disagreements or conflicts of
County Road 84 right-of-way the owner ended up with sma.1.1 slivers
of lots as shown on the attached sketch. You'll note that the
portion of Lot 1 is 4 feet at the West end and practically
nothing at the East end on Lot 16 it is 8 ~oot wide at the West
and about 5 feet at the East end. The attacheq sketch also shows
the existing shore line as of October 29, 1974. It shows that
on]v ct very small part of Lots 1 is shore line and appears to be
ar~roximately 3 to 5 feet. The balance of the shore line is in
Lot 2 which is tax forfeited land owned by the State of Minnesota.
The Village has asked the state to hold on the land retaining it
ana not placing it on standard tax forfeited sale.

It would appear that there Js no way to get from Lot 1
to the lake shore without crossing over Lot 2. There probably
is adequate area on Lot 16 if this were developed East and West
that docks could be put on this property.
We understand the council has already approved the constr-
uction of four docks. However, we believe that something should
be worked out before any subdivisions of Lot 1 is permitted. One
way that this might be resolv0d would be for the council to re-
move the hold from the sale of this lot by the State and then let
the developer pick up Lots 2 and 15 then they would have the ade-
quate shoreline needed. This land seems to be rather useless for
any other purposes and it seems to make sense that such a arrange-
ment could be worked out.
