Re: Septic System
Dear Ms. Nephew:
This letter is to update you on the action taken regarding
your failing septic system. A violation citation was issued to
Linda Freeman via the mail on 10/30/84 per the attached letter.
Please note in the attached letter that Orono Municipal
Code, Section 9.03 imposes an obligation on the tenant as well as
the owner to prevent discharge of overflow of the system, i.e. as
a minimum you are obliged to notii-! the owner whenever overflow
is expected to ,)ccur, and dependin, on your agreement with the
owner, one or Moth parties would be responsible if an overflow
occurs. Note that I have not issacd citations to you because you
brought the situation to the City's attention as a complaint.
Pending the result of the court action, the City intends to
commence hazardous building proceedings pursuant to Minnesota
Statutes Section 463.15 et seq. The end result would be to
declare the building uninhabitable and you would have to vacate.
The Minnesota Health Department referred your complaint back
to the City. We will proceed as quickly as possible to resolve
the situation. Please call if you have further questions.
