A RESOLUTION AMENDING THE PROGRAM FOR DEFERMENT OF SPECIAL ASSESSMENTS FOR PERSONS 65 YEARS OF AGE OR OLDER W�iEREAS,the City Council of the City of Orono is the official governing body of the City of Orono; and WHEREAS,Minnesota State Statute Section 435.193 through Section 425.195 authorizes the City of Orono,upon proper application,to defer the payment of special assessments against any homestead property owned by a person 65 yeazs of age or older on January 1 of the payment yeaz and for whom it would be a hardship to make the payments; and WHEREAS, Section 425.194 authorizes the municipality to establish an interest rate to be added to the deferred assessment which shall be payable in addition to the defened assessment;and � that Orono had adopted such a program under Ordinance 2.62 (1984 recodified), Resolution 1093 • (dated November 13, 1979),Resolution 1779(dated June 10, 1985),Resolution 2864(dated August 27, 1990),Resolution No.3894(dated Apri128, 1997),Resolution No,4288(dated May 10, 1999), Resolution No. 4667 (dated May 8, 2000) and Resolution No. 4716�(dated October 22,2001). . WHEREAS, the City Council has determined that the defenal of assessments should be granted to any person otherwise qualified who makes proper application to the City of Orono on forms prescribed by the County Assessor of Hennepin County and by the Orono City Council and for whom the City Council determines that it would be a hazdship to make the payments,based upon the following criteria: NUMBER OF PERSONS MAXIMUM INCOME IN HOUSEHOLD � � � . 1 Person $38,100 _ 2 Person � $43,500 � 3 Person $48,9�0 4 Person � $54,400 . 5 Person $58,750 6 Person $63,100 � 7 Person $67,450 8 Person $71,800 Page 1 of 2 � �' _l . NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ORONO IN A REGULAR MEETING ASSEMBLED, that the assessments against any homestead property owned by a person 65 yeazs of age or older and for whom it would be a hazdship to make the payments, be deferred for a period of time not to exceed five yeazs subject to the aforementioned financial criteria, upon submission of an appropriate application signed by the qualified person, and which may upon expiration of initial or any subsequent renewal deferments may be reapplied for, and subject to the applicant meeting all the necessary criteria upon reapplication be defened for an additional period not to exceed 5 yeazs; and BE IT FURTHER RESOLVED, that the right of deferment is automatically terminated under Section 435.195 if: 1. The owner dies and the spouse is not�otherwise eligible; � � � . 2. T'he ro e or an art thereof is sold transferre P P ri3' Y P , d or subdivided; 3. The properiy should lose its homestead status; or 4. If for any reason the City determines that there would be no hazdship to require . immediate or partial payment.
