The City and State DNR have no record of any previous dredging at this location. 7. The City feels that riparian access is not endangered because the property owner can extend docks to navigable water within the authorized dock use area, and has in fact more than 30 goats currently docked at the existing facilities. 8. 'I"ne City finds no evidence of any previous attempt to control runoff and siltation which may have contributed to the applicant's current desire to dredge. 9. The City questions the need to dredge the entire shoreline if a lesser amount can be dredged to provide access to a launching area. 10. The City questions the applicant's desire to indiscriminantly dredge the clock use area when boat storage can be more environ- mentally provided by some onland storage system. 11. The City questions the permanent need to dredge when the applica- tion comes in a low water vcar. 12. The City questions the very operation of a commercial marina on this site. 'llie area was zoned for this use because of a long existing fishing boat rental operation on the site. I"he support- ing structures were destroyed by fire in January 1977, and the only current land use is the non -conforming slip rental of water space not supported by any public facilities or services. 13. The City feels tl,at this site is unsuited to any expanded, commercial use because of the limited traffic access to the area, the surrounding residential land use, the extremely low level of the land, the lack of any sanitary sewer or projected construction of same, the questionable on -site sewage treatment capability, and the naturally shallow�eutrophic and remote nature of Stubbs Bay. 14. The City has not yet received any information regarding fish and wildlife habitat affects anticipated by this proposal. 15. The City is adamantly opposed to any improper dredging method and to any on -site spoils disposal within the Lake Minnetonka watershed. 16. The City feels that any dredging allowed mist be contingent upon proper riprapping and runoff filtration system installation to forestall additional dredging in the future. Mr. Rutford Page 3 16. Above all, the City feels that there are many alternatives available for exploration that will have less permanent or adverse environmental impact on the Lake, the shore and the neighborhood, and that these alternatives should be documented and weighed against the personal benefits to be gained by allowing this dredging to proceed as proposed. Your application will be on the Planning Commission agenda for work session on Monday, August 1S, 1977. Major areas of concern were the location and method of spoils disposal and provision for reducing futu:-e silta- tion causes. There is reluctance to approve any spoils disposal within 1,000 feet of the shoreline, or any dredging near the shore without riprapping or other siltation control measures. Grading at "Stone Ridge Trace"; Minnetonka Doug Goriesky, consulting engineer on behalf of the dev- eloper of Stone Ridge Trace, appeared before the managers and ad- vised the managers that grading had been undertaken by the devel- oper outside the right-of-way for road construction prior to sub- mission of a permit application to the district. Mr. Goriesky stated that he had contacted the district's engineer as soon as he became aware of this situation, and was proceeding to insti- tute interim measures at the request of the district's engineer. Mr. Goriesky further indicated that the developer would submit a permit application pzomptly. Hennepin County Well - Lake Minnetonka Association The engineer reviewed the history and present status of the groundwater wells previously or -rated by Hennepin County and later transferred to the district. Stan Kinghorn of the Lake Minnetonka Association indicated r iew that additional informa- tion regarding the possible utili. on of the existing wells should be secured by an appropriate public body. President Cochran expressed the general interest of the Board of Managers in explor- ing the matter to determine what would be involved in evaluating the possibility of utilizing the existing wells. President Cochran expressed the appreciation of the managers for the report made by Mr. Kinghorn. Dredging of La):e Minnetonka has been of great concern to the City of Orono. We've been unable to find any data supporting a dredging project as a benefit to the general public. We feel dredging is not necessary along shorelines of properties where lake access is not obstructed and lean toward denial of all such proposals unless the riparian property Qwner has lost all means of lake access. The term "maintenance dredging" as used by the D\'R has always been a concern in Orono. We are currently consideving the Stubbs Bay *farina dredging proposal. Ince again we are faced with a problem. lie have found no records indicating any previous dredging, so I would assume the term 'Yointenance dredging" would not apply here. We suggested to Mr. McCleary he consider some alternatives such as onland storage. He was not too happy with this suggestion indicating the cost would be prohibi- co tive. The Orono staff reviews and prepares reports on all proposals before consideration by the Planning Commission and Council. Our staff is somewhat limited, however. 1* do lac}, the expertise in fish and wildlife as well as many other natural aspects. Before we do prepare a report, I would appreciate any dita that the various D,\'R experts might be able to provide to include in this report. We have also r:-ceived copies of applications made to the Minnesota TVR on July 18, 1977, the Minnehaha Creek Watershed District on August 3, 1977, and the Corps of Fatgineers on August 11, 1977. 2. Discussion with personnel from the DNR indicates that the permit request made to them was after a DNR conservation officer tagged an operator for dredging the shoreline with a backhoe. 3. The City of Orono Planning Commission has reviewed this application at their meetings on September 6 and September 19 and have not passed on the request due to insufficient information regarding need, detrimen- tal aspects, and possible alternatives. 4. The City of Orono has extensively reviewed the environmental conditions of Lake Minnetonka and is intimately aware of the delicate balances affecting water quality and shoreline protection. The City has found that many previous dredgings in other areasof the Lake have caused serious and permanent damage to the environment. S. The City has previously, if reluctantly, approved maintenance dredging of certain areas which had been dredged in the past or which were required to maintain any navigable access to historically riparian property owners.
