VARIANCE - PROPOSED ADDITION
The subject house is on a 0.37 acre lot in a 2-acre unsewered Boning
district. This area is currently under a moratorium for all building
or additions on substandard lots. The Huber residence currently horses
five people in two bedroom. Based on a standard 75 gal./person/day
water use raga, and assur'_ng the prociuminately clay soil (Kilkenny Loam)
would require approximately 165 square Beet of drainfield per person,
our e-sde would require a drainfield of 823 square feet for the existing
house. and with thi addition of two bedrooms a total of about 1,300 square
loot. The house has 500 square feet of drainfield existing now which
appears to be handling the Huber's needs adequately.
Orono's current code requires that 10,000 square feet of suitable area
for drainfield be preserved on a new building lot. The intent of the
code is to preserve on both new and existing lots enough area to handle
cl1 future sewage treatment needs in the %insewered area. The existing
lot has about 3,500 square feet available, and with the addition would
cut this to about 3,000 square feet. The addition of two bedrooms
would make the existing actual ;rainfield (500 sq. ft.) more substandard
than it is already. Were the existing drainfield to be upgraded to
current standards for a four bedroom home, essentially only about
one-fourth of the area required for one alternate or future drainfield
would be left.
In the past year, only two house additions in the unsewered area resulted
in potential additional water use being added. In both cases, th3 septic
systems were reviewed and in one case upgraded. HeitheL case ri►quired
a variance and both had substantial area in -hich to expand the existing
systemx. in my opinion from a technical standpoint, the Huber lot
does not have the available area required for both a present and future
drainfield correctly sized for a four bedroom home. However, a mi°igating
circumstance might be that the Hubers apparently do not intend to greatly
expand their family, that the existing substandard size drainfield is
currently handling the existing sewage load, and that the Hubers expect
to remaih in the house indefinitely. All these factors are of course
subject to change.
The Planning Commission must decide whether or not to allow the addition
based on the above facts and statements of facts below:
1. The subject property is within the Stubbs Bay Moratorium Area. The
purpose of the moratorium is to temporarily stop exactly the type of
application the Huber* area presenting, i.e. addition which will
increase the potential sewage treatment problem in the area.

2. As stated in Ordinance No. 210, The On -Sits Sewage Treateent Coder
Section 22.01, Subd. 2, the purpose of the code isa "i. To Prevent
the premature extension of cos::ly municipi.1 sewer and vtl £ ser U08
consistent with the adopted Comprehensiv" Land Use Plan of the City."
it is just such proposals as that of the Hubers that have a high
potential for causing premature extension oC sewvre.
3. The intent of the code is to preserve adequate lane. area suitable
for use as future drainfie)u in the unsewerad trees. The code seta
standards for the amount o` area to be pratc-ved. Also Section 22.20
Subd. S, states in part thats "No building permit, plumbing or
mechanical permit shall be issued by the City for an- expansion or
alteration of a building or ure connected to an existing on -site
system, unil such system has been inspected and certified by the
City as being in compliance with this code. Whenever the addition
of bedrooms, plumbing fixtures or mechanical equipment, or a chan94
in the character or intensity of the established use is proposed,
the City may :squire the review and/or replacement, repair, alteration
or expansion of the existing system or any portion thereof."
i contend that the lot in questi..i does not and cannot most tha intent
of the code in preserving adequate area for future drainfield. i must
recommend denial of the application.

SUBJECT: f517 Robert M. Huber, 3390 Sayside Road - VARIA:4cZ
The Huber* have indicated a willingness to acquire an additional
50' X 125' lot from the owner of Lots 6-11. The addition of this
lot (Lot 6) will give them ample room for future drainfield
(whether it be standard trenches or a sound system). Assuming a
variance to our well and septic codes to allow a 50' rather than
75' separation distance between septic systems and wells (state
required minimum), this lot acquisition will not appreciably affect
the future drainfield possibilities for the owner of Lots 6-11,
who will still have more than the required room for future drainfield
additions.
Note that: 1) There have been no cases of wrll water contamination
from septic systems in Orono. Allowing the state minimum of 50'
separation should not cause any potential problems on either of these
lots, 2) Our policy on enforcement of the septic code with regards
to potential water use additions on substandard lots has been and
should continue to be that the existing septic system must be in
good working condition and that enough area must be preserved for
at least one future conforming drainfield. Specifically, I
recommend that if the Huber addition is allowed, no action be taken
to make the existing septic system conforming until such time that
it fails, at which time it must be made fully conforming. While
an addition of drainfield would maze the system conforming now,
there is a possibility that •nf additions could disturb the existing
working system, and that future additions may require construction
of a mound system in the back yard if soil conditions dictate.

The applicant proposes the construction of a
34' X 20' adeition, coneeiating of two bedrooms
and a bath. The Hubers note that an existing
9' X 12' bedroom will be converted to a d, ,,.-
sewir- room ai►d that thu house will have ►ree
define bedrooms. The Zoning Administrator
reviewed the variances required in this
application: 1) variance to moratorium,
2) variance to septic code - SO' separation
between well and drainfield (75' is required
in Septic Ordinance) i 10' setback from
property line for drainfield (20' is required
in Septic Ordinance), and 3) variance for
side ysird setback of 19.21.
Oaffron reviewed for the Planning Commission
the conflicts presented with this type of
application involving building expansion on
substandard lots and complying with standards
of septic code. The proposed expansion on the
Huber property not only increased the
specification for main dra-nfield area but placed
the same demands on seeking an alternate drain -
field area. There was not enough dry land area
left to satisfy the septic code. The Hubers have
been able to acquire an additional lot. Gaffron
recommends approval based on acquisition of the
additional land for an alternate site.
Frahm moved to recommend approval of the variance
based on the septic .inspector's recommendation
and that Lot 6 be combined with Lott 12 and 13
upon Council approval, proof of combination
obtained before a building permit will be issued.
Motion seconded by Adams. Vote: Ayes (4),
Nays (0). Motion passed unanimously.
The applicant proposes combining lots 9, 10, 41,
12 and 13, Block 2, Minnetonka Summit Park to
create a residential building site. The
combined lots total 681 of required acre or a
324 lot area variance. each lot was assessed
.20 of a unit, totaling a full unit assessment
upon combination. After an inspection of the
site, Planning Commission determined the request
to be consistent with pattern of neighborhood
development. Planning Commission noted site
plan submitted with application did not require
setback variances. Arplirnnt was advibed that
if Council grants the lot area variance, no
setback variances would be granted.

The Huber variance application has been subject to the same reviewing
process as the two previous variance applications to the moratorium -
#501 (Gerald Gustafson) setback variance for basement addition and
0503 (Henry Schmitz) setback variance for detached garage. The
Hubers propose an addition with two bedrooms and a bathroom requiring
a side yard setback. This reviewing process involves Michael saffron,
the septic system inspector, inspecting each site plan to assure that
adequate area remains for septic expansion, either additional area to
expand existing system and/or adequate area for an alternate system.
The intent of the septic code is to preserve on both new and existing
lots enough area to handle all future sewage treatment needs in the
unsewered area. Michael Gaffron has detailed this application of the
septic code in his memo dated September 19, 1979 (Exhibit 0).
The Hubert did not have enough area tr satisfy both the addition and
the septic code's demands. Our advice was to acquire additional land
from the neighboring property owner. Gaffron'■ memo of September 24, 1979
(Exhibit 71 reviews the effects of this acquisition on both the Huber's
application and the neiqhor's property.
Approval of the Huber's variance application was based on the following
conditions:
1. Applicant submit proof of legal lot combination before
building permit can be issued.
2. The acquisition of additional land for an alternate drainfield
area r..eets the intent of the septic code in providing self-
sufficient septic treatment and therefore the intent of the
moratorium is not violated. These conclusions are based on the
septic inspe--tor's findings and recommendations.

Comprothensive Plan. We would prefer t.-) ca+tplete
these first, including the changes in fencing
provisions with the general zoning code revision

Connequently, we think it is logical and justified
