The Planning commission will hold Public Hearings in the Council Chambers
at 1275 South Brown Road on Tuesday. February 21, 1989 on the matter of
reviewing the following land use applications:
1. #1367 Steve Harris, of 3850 Watertown Road, applied for a condiLional
use permit to install a pond on his residential property.
2. 81369 Charles Rickhafer, of 1040 Townline Road, seeks a front street
setback ance for a proposed garage addition to his existing residence.
3 11371 ert and Theresa Minkema, of 3200 Bayside Road, seek front
st side street setback variances for proposed additions to the
existing residence.
4. i1373 Dave Eiss, of 1635 Concordia Street, seeks a conditional use
permit and variance for land alterations within 75' of the lakeshore
protected area for the purpose of controlling drainage at the new building
site.
S. i1375 Dave Price, of 2914 Casco Point Road, seeks a hardcover variance
for a proposed addition to the existing residence.
6. #1376 Dale and Chris Palm, of 1710 Shadywood Road, seek hardcover
variances to allow a detached garage, originally required to be removed by
the City in an earlier review, to remain on the property in exchange for
the removal of existing hardcover improvements within the 75-250' setback
area.

2. Applicant is proposing to construct a two story addition to
the existing house. The additions extend northerly along the
east line of the house, so the setback from the east lot line
will remain at 33.81. The proposed addition at the southwest
corner of the house apparently is a covered porch area. The
applicant has not submitted elevation views of the proposed
residence, since those plans apparently have not been drawn up
vet. However, the floor plans would indicate the house will. be
two full stories at a point 18.4' from the south lot line.
3. The proposed garage addition is located entirely within the
allowable accessary structure building envolope, and does not
require a variance.
4. Area of the property is approximately 1.1 acre. The property
is located approximately 1,100' from Stubbs Bry, hence while it
is within a lakeshore zone, it is outside the 1,000 foot area
under hardcover limitations. Proposed hardcover is only about

Discussion -
As of this writing, applicant notes he will re sub.nitting
elevation views prior to the Planning Commission ' g along
with his building permit application.
Procedural Options
1. Recommend approval based on the following findings:
A. The existing residence is located entirely within the
required front and side stre,,t setbacks, ai,d therefore
any additions to the existing residence require a
variance.
B. The plight of the landowner is due to circumstances
unique to his property not created by the landowner.
C. Granting of the variance will not alter the essential
character of the locality.
D. The special conditions applying to this structure a:e
peculiar to this property.
E. The existing residence is unusually close to the
front and side street lot lines, which is unusual for
properties in the LR-IA zoning district generally.
F. Granting of the variance is necessary for the
preservation and enjoyment of a substantial. right of the
applicant.
G. The granting of the proposed variance wi l 1 not in any
way impair health, safety, c3mfort, morals, or in any
other respect be contrary to the intent of the zoning
code.
H. The granting of this variance will merely serve as
convenience to the applicant, but is necessary to
alleviate demonstrable harlship or difficulty.

The Affidavit of Publication and Certificate of Mailing were
duly noteli
The applicant was present for this matter.
Zoning Administrator Mabusth informed the Planning
Commission that Mr. Kickhafer was requesting a front street
setback variance 4 n order to construct an attached garage. Due
to accessory improvements previously made to the rear of the
property, placement of the garage to the rear of the house
becomes impractical.
There were no comments from the public regarding this matter
and the public hearing was closed.
It was moved by Chairman Kelley, seconded by Planning
Commissioner Hanson, to recommend approval of this application,
granting the 30' front yard setback variance for the purpose of
constructing a single story garage 24'x 24'. Mr. Kickhafer's
hardship is that he has no garage and the house was built prior
to the 5-acre zoning amendment. Bellows added that the
topography of the land was also a hardship. Motion, Ayes-6,
Nays-0, Mction passed.

Mr. Minkema was present for this matter.
Assistant Planning and Zoning Administrator Gaffron
explained that the Minkemas were in need of front and side street
setback variances in order to construct an addition onto their
existing residence.
There were no comments from the public regarding this matter

It was moved by Planning Commissioner Brown, seconded by
Planning Commissioner Cohen, to recommend approval of application
#1371, both front and side yard setback variances. The hardship
is the location of the existing residence and that there is no
additional encroachment. Motion, Ayes=6, Nays=0, Motion passed.

CONDITIONAL USE PERMIT
PUBLIC HHARING 7:51 P.M. - 7:57 P.M.
The Affidavit of Publication and Certificate of Mailing were
duly noted.
The applicant was present for this matter.
Zoning Administrator Mabusth informed the Planning
Commission that Mr. Eiss was seeking a conditional use permit and
variance for land alterations in the 0-75' setback area. Mr.
Eiss's new residence is located within a pre-existing retention
area which serves the 1.44 acre watershed. Mr. Bozonie, a
neiqhbor to the south of Mr. Eiss, communicated to the City his
understanding of the drainage pattern for the area. Public Works
Director Gerhardson has recommended the use of the drainage swale
or underground tile because a private drainage system to the
south would have a significant impact upon the Trainor property.
Gerhardson has confirmed that the existing drainage ditch within
the Trainor property is not a public drainage way.
Chairman Kelley questioned the number of trees that would
need to be removed if a 40' wide swale were installed. Mabusth
estimated that many trees would need to be removed. She was
unable to specify the exact number. She further added that the
City was not in favor of this option, but would prefer the
underground drainage tile based on the degree of impact within
the lakeshore protected area.
Chairman Kelley expressed his preference for option 3 and
suggested tabling this item until further information could be
reviewed. Because of the urgency in resolving the runoff problem
before the Spring thaw, it was suggested that this matter he
brought directly from the March 20 Planning Commission Meeting to
the March 27 Council Meetinq.
There were no comments from the public regarding this matter
and the public hearing was closed.
It was moved by Chairman Kelley, seconded by Planning
Commissioner Moos, to table this item until more hydraulic
information could be gathered by the applicant and Mr. Zuckman.
Mabusth indicated to Mr. Eiss that she would provide him with the
.•riteria needed by the City before the March 20th Planning
Commission Meeting. Motion, Ayes-6, Nays-0, Motion passed.

Discussion -
Please review the memo ana exhibits of February 13, 1989. The
applicant is proposing to construct additions to his existing house, which
is located near the front lot line (Bayside Road) and side street lot line
;Leaf Street) than the required setbacks. Applicant is proposing to
construct an addition to the north end of the house, continuing the east
line of the existing house, so there will be no further encroachment past
the existing 33.8' side street setback. In the front, the additionS will

WHEREAS, Robert Mir.kera (hereirafter "the applicant") is the
owner of the property located at 3200 Bayside Road within the City of
Orono (hereinafter "City") and legally described as follows:
Lot 14, Auditors Subdivision #203, Hennepin County, Minnesota
(hereinafter "the property"); and
WHEREAS, the applicant has applied to the City of Orono for a
variance to Municipal Zoning Code Section 10.23, Subdivision 6 (B) to
permit the zonstruction of additions to his e.xia�ing residence, which
additions will be located less than the c�-quired 50' setback from the front
street lot line and less than the required 50' setback from the side street

NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,

Residential Zoning District.

4. The City Council has considered this application including the
findings and recommendations of the Planning Commission, reports by
City staff, comments by the applicant and the effect of the proposed
variances on the health, safety anI welfare of the community.
5. The City Council finds that the conditions existing on this
property are peculiar to it and do not apply generally tc: c,the-
property in this zoning district; that granting the variances would
not adversely affect traffic conditions, light, air nor pose a fire
hazard or other danger to neighboring property; would not merely serve
as a convenience to the applicant, bait is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a
substantial property right of the applicant; and would be in keepirg
with the spirit and intent of the Zoning Code and Comptehensive Plan
of the City.
ConCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby
grants a variance to Municipal Zoning Code Section 10.23, Subdivision 6 W
to permit the construction ••f additions to the existing residence which
will be located 33.8' from the side street lot line where a 50' side street
setback is normally required, and 18.4' from the front Jut line where a 50'
from setback is normally required, subject to the following conditions:
1. Any changes to the site plan (attached herein as Exhibit A) which
will place the residential additions closer to the affected lot lines
than the proposed setbacks will require additional review by the City.

2. Authorities granted by this variance run with the property not
with the applicant, but are permissive only and must be exercised by
application for a building permit within one year of the date of
Council approval, or this variance will expire on that date (March

conditions of this variance shall constitute a violation of the zoning
code, shall automatically terminate any authority granted herein, and
shall be punishable as a misdemeanor.
4. The undersigned applicant has read, understood and hereby agrees
to the terms of this resolution and on behalf of himself, his heirs,
successors and assigns, hereby agrees to the recording of this
