Discussion -
I. General
Applicant propose, to Snlit this 5.7 acre parcel into
two building sites o! 2 :plus icre^ each. Lot 1 (west) is
, -iticipated to access from TIayni-i- Road. The proposed house Site
is to the rear of tho lut wher- it widens out. The lot needs a
width varianco but 1s front on a p ubl ir• r ,adway,
Lot 2 will access from %eaf Stroat. Again, the assumed
house site is to the rear, over looking thr, creek. This lot also
needs a width variance.
II. Drainage
Drainage is a conce-n on this property only in that
provision must be made to Prot^ct significant drainageways that
traverse the property. 'Stubb^ pay Creek' follows along the
northwest lot line of the property. A detailed flood study of
the drainage area was done in the 1970's and f loodplain
elevations have been defined. The City will require granting of
a Conservation and Flowage Easement coinciding with the
floodplain elevations along the creek. Staffs preliminary
review indicates that lot areas cast of the drainage easement
will still exceed the required 2.0 acres in area by a wide
margin.
Both access corridors ire traversed by a minor
creek/gully leading from a pond east of Leaf Street. Culverts
and drivewa.-I grading must be approved by the City Engineer to
ensure no restrictions in flow through this drainageway.
III. Setbacks
Based on the Zoning code definition of rear lot line and
rear yard, Exhibit J indicates the setbacks that will be required
for these lots.
IV. Septic Concerns
Applicant's Engineer has submitted soil testinc,
information for primary and alternate sites. The clay coils on
the site are mottled at 3 -3' depth, indicating mound systems
will be necessary.
Wr� have some concerns as follows:
a.) Primary site for Lot 2 appears to be within a minor
drainage Swale from the propeL•y +n the northeast.
The alternate site on Lot 2 is a much better site.
We would prefer to see the primary site moved to a
location away from the swale and further back from
the southerly lot line, since a mou: d in this area
will have a potential impact on the soil -water
regime of the neighboring property^s due to
topography.
The primary site for Lot 1 is not in a Swale but
should ilso he movre,i nortnwesteriy to reduce its
impact on neighboring properties.
c.) The alternate sit^ for Lot 1 needs to be better
riefined so that the orientation and size of the
potent is 1 syst,�r+ to he instal led is known and so
that the driveway can be located to avoid this site.
11. Septic Concerni in neighboring Properties
Because this property is in the Stubbs Bay Sewer Study
Area, it is appropriate to consider what effect, if any, this
su'.A i v is ion will have as to overall septic concerns in the area.
There is no question that the two new lots can meet the standards
for on -site sewage treatment. Staff does note, however, that the
properties at 3280 and 3310 Bayside are each approximately only
0.9 acres in area, and have relatively little area that is
potentially suitable for alternate septic systems (see Exhibit
L). The southerly portion of Lot i will, as of this subdivision,
no longer be viable as a potential future acquisition by either
neighboring property for use as drainfield. Staff would suggest
that this division may well seal the fate on the City•s future
determination of need to extend sewers to some properties in the
study area L c of Crestview.
Staff Reacsmendation
Staff recommends approval of the 2 lot plat for Craig
Anderson subject to the following conditions:
1. Each lot must be at least 2.0 acres in dry buildable
area east of the casterly floodplain boundary along the
Stubbs Bay Creek.
2. Lot width variances for both lots to be granted.
3. Setbacks per F,xhibit .i of this memo.
4. Septic sites, house locations, driveway locations to
be ref inei in accordance wits Item IV above (work with
staf f on th in and resol +e prior to Council review for
preliminary pl:t approval).
S. Preliminary plat -urvey to be completed and
submitted prior to Council review for preliminary plat
approval.
5. Flowage anJ Conservation Easement to be granted in
accordance with the flodplain boundaries along Stubbs
gay Creek.
7. Grant standard drainage and utility easements along
all lot lines. Grant widened drainage and utility
easement for minor creek along Bayside Road.
9. Plat to .ledicate 33' for right-of-way for Leaf
Street and 33' for right-of-way for Bayside Road if
surveyor determines those right-of-ways have never been
so dedicated.

replace the existing cement stairs paved stepped walk,
patio and storage structure located within 75 feet of
the lakeshore. The total hardcover to be removed is
509.5 s.f. providing a final reduction of 55.1 s.f. or
.50. She also noted that wetland areas are credited
against the hardcover, almost half of the property
consists of wetlands. The existing steps and patio are
34' from the lakeshore, and the proposed deck is 27'
from the lakeshore.
James Beck explained that the deck is designed to
provide a safe and easily negotiated access for elderly
individuals, which replaces the old patio.
There were no comments from the public regarding this
matter and the public hearing was closed.
It was moved by Cohen, seconded by Chairman Kelley, to

Present for this matter were Todd waters and Dori
Molitor and their Planning Consultant Greg Kopischke.
Todd Waters addressed the mistakes and misconceptions
made that led to the need for after -the -fact conditional
use permit/variance. He stated that he never intended
to mislead the City regarding his project.
Chairman Kelley stated that at this point Planning !
Commission should not point blame, but concentrate on
the alternatives to solving these problems.
Zoning Administrator Mabuavh explained that on May 11.
1987 Council approved variances to the average lakeshore
setback for construction c-f a new residence. Nei+her
staff, Planning Commission or Council realised that the
one third of the lakeside :f the structure was to be a
walkout requiring addition;..i excavation and encroachment
into the lakeshore protec�_ c: areas. The major issue is
that the excavation inva: vas major land alterations
involving changes in exist::-; drainage and alteration of
the lakeshore bank thrr .--learly were not required
because of the walkout. :he underground the that
carried drainage from t :ear to the lakeshore was

WHEREAS, the City of Orono is a municipal corporation organized
and existing under the laws of the State of Minn. sota; and
WHEREAS, the City Council of the City of Orono has adopted
subdivision regulations for the orderly, economic and safe development of
land within the City; and
WHEREAS, the City Council has considered the application for
a subdivisior. by Craig Anderson, the subdivider; and
WHEREAS, the City Council approved Resolution #2269 granting
preliminary approval for a two -lot plat of property located at 3-75 Leaf

2. Each lot has been shown to contain a feasib.f building site
exclusive of primary and alternative drainfield sites with
proper setbacks.

4. A major creek runs through the northwest portion of the
property. The creek and its defined f lood plain would be
covered under a Conservation and Flowage Fasement shown as
"proposed drainage easement" on the survey. No construction
would be allowed within 26' of the easement boundaries.
5. Both Lots 1 and 2 require a variance f-)r lot width at the
rear of the 50' front yard set')ack. I,ot 1 is 121' wide, Lot
2 is 70' wide, both requiring 200' in width. Each lot
contains 2001+ of width at the proposed house location.
Discussion -
This plat received Council approval on May 9, 88 per the
final plat approval resolution -'Cher. The preliminary plat
approval resolution is also attar for your review.
Staff hAs carefully compareu the current site plan proposal
against that which was originally approved, and finds no changes
whatsoever. Except for the noted variances, which are due to the
existing property configuration, all other requirements for
subdivision appear to be satisfied.
The Planning Commission originally reviewer? this subdivision
in July and August 1987 dnd - ommended on a vote of 4-2 to
approve. Minute, of those meetings are attached for your review.

Chairman Kelley a eked Mr. Otten what days and hours of thu
day his business would be in operation. Mr. Otten replied that
the business is open 7 days per week from Easter to Christmas
from daylight tc dark. Kelley also asked about security
lighting Mr. Otten said that he had not determined to what
degree he would need such lighting. Mabusth suggested that Mr.
Otten in;lude that information should be shown on the final
lighting plan. Planning Commissioner Johnson asked the applicant
when he intended to begin construction? Mr. Otten said that he
would begin in the fall. Johnson suggested that the access off
of Highway 12 be subject to approval by MNDOT. Kelly agreed to
amend his motion to reflect that; Cohen se,,unded. Motion,

Assistant Planning and Zoning Administrator Gaffron
explained that this matter had previously been before the
Planning Commission. There have been no changes to that original
proposal. Each of the 2 lots will have 2 acres and the
drainfield sites have been dedicated. Each lot -ill be served by
a separate driveway. Lot 2 will have a driveway off of Leaf
Street, Lot 2 will have an access off of Bayside.
Mr. Henry Furchner, 360 Leaf Street, expressed his concern
regardit.3 the driveway being installed off of Leaf Street due to
the normally wet, marshy conditions that exist in that area.
Ms. Sut ulsun. 3280 Bayside Road, questioned where the house
and driveway for the lot on Bayside Road would be located.
Gaffron said that the driveway had to go to the west of the
defined drainfield site. He said that the applicant was
proposing to locate the driveway next to the Olson's driveway.
Ms. Olson indicated that she would prefer to have the driveway
more centrally located. Gaffron showed Ms. Olson where the house
was proposed to be located.
Ms. Jane Behrman, 340 Le%f Street, asked where the existing
house on Leaf Street was loca, _ Gaffron indicated that there
were several houses on Leaf Stre:,_. Ms. Behrman asked whether
the proposed lots would be sewered? Gaffron said that the
propos,71 was for septic systems for both lots.
Mr. Olson questioned .that type of houses the applicant
intended to build? He said that he preferred not to have
enormous homes built. Mr. Munsing replied that custo,, homes
ranging in price between $300,000 to $400,000 would be built.
Gaffron noted that there would be need for a culvert and a
drainage easement would be taken.
There were no "urther comments from the public regarding
this matter and the public hearing was closed.
Planning Commissioner Bellows indicated chat she had not
been in favor of this subdivision when previously presented and
tha+ -,pinion had not changed.
lanning Commissioner Hanson said that this was not his
"favorite" subdivision, but he did not see any reason why it
should be denied. Bellows noted that the City prefers not to
create flag lots at all and this application would create two.
Bellows questioned the buildabiIity of the land and whether it
would support two houses.
It was moved by Planning Comm sioner Johnson, seconded by
Planning Commissioner Hanson, ecommend approval of this
application for a preliminary bdivision. Motion, Ayes=2,
Cohen, Kelley, Bellows, Nay, Motic., failed.

Briefly, this subdivision receiver' previouj Coancil approval in

The proposal is to split this 5.8 acre parcel into two lots, each
exceeding 2 acres in area. Technically, lot width variances are
needed for each lot, the hardship being the h,-_stor,c
configuration of the property, with 7G feet ,f fron' on Leaf
Street and 121 feet of frontage on Bayside Road.
Neighboring pro{.!rty owners have generally expressed opposition
to this subdivision, notinc ^oncerns about driveway and culve4t
locations as well as drainage concerns. The City Engineer has
reviewed the p -oposal and has de., inera the location of the
necessary draina,,,L easements to accrn,modate the two significant
drainageways on the property. Neighbors have also requested that

Planning Commission Recommendation - The Planning Commission
voted two in avoz, three against on a motion to recommend
approval. The Planning Commission members opposed to the
subdivision stated the opinion that the subdivision creates two
marginal lots but would make one good buildable lot as it now
exists. Planning Commission also referred to the need for lot
width variances as a justification for denial. Note that when
the subdivision was originally reviewed in 1987, Planninq
Commission at that time voted 4 to 2 for approval, with Council
voting 4/0 for approval.
Staff Recommendation - Since the need for lot width variances is
inherent with the historic shape of this property, that would
seem to be a reasonable hardship in staff's opinion for granting
of those variances. Although these lots may be somewhat limited
due to lot configurations and slopes, each lot contains more than
two dry buildable contiguous acres and has met all other
standards so that a residence can be constructed without further
variances. Staff would therefore recommend preliminary plat
approval per the attached resolution, which is nearly identical
to the preliminary plat approval resolution adopted in 1987.
notes Apparently Some of the survey stakes placed in 1987 have
been removed or disappeared according to the neighboring property
owner. Applicant is advised to have them replaced as soon as
possible.

Discussion -
The applicant has revised the driveway location for Lot 1,
centering that driveway on the Property. This tanuld appear to
eliminate the need to remove trees near neighboring lot lines.
City Engineer Glenn Cook briefly reviewed with staff the
concerns of the neighbors regarding culvert freeze-up and staging
of driveways only 60' apart. Glenn noted that culverts
underneath the driveways on either side of Lot 1 are 18" and 21"
respectively, and Glenn recommends a 24" culvert be provided for
the new driveway, which would minimize any effect this new
driveway would have on existing driveway culverts.
Due to the location of the alternate drainfield site for Lot
1, the neighbor to the west may still have a concern regarding
the driveway location and headlights aiming towards his house
when vehicles leave Lot 1. The applicant noted to staff that tie
would be discussing the screening possibilities with that
neighbor. Of course, there is nothing in the zoning code that
specifically requires such screening.
As of this writing, one of the neighbors had noted that the
lot corners had not yet been restaked. Since the property owners
both east and west of Lot 1 are new to the neighborhood since the
previous preliminary subdivision approval in 1987, it is
appropriate that the lot corners he rep skid by the applicant as
soon as possible.
Staff Recommendation -
A proposed resolution for preliminary flat approval appears
as Exhibit D. Staff would recommend approval. If Council wishes
to require specific screening along the driveway for Lot 1 or
wishes to condition approval on the centrally located driveway
for Lot 1, those conditions could be added to the resolution if
you so desire. t'

3. Lot 1 contains 3.25 total acres of land, of which 2.28
acres of dry buildable land are contiguous with the proposed
building site; Lot 2 contains 2.57 total acres of land of
which 2.5 acres of dry buildable land are contiguous with
the proposed building site.
4. Both Lots 1 and 2 require a variance for lot width at
the rear of the 50' front yard setback. Lot 1 contains
121.0 feet in defined width where 200.0 feet in width is
required, a variance of 79.0 feet. Lot 2 contains 70.0 feet
in defined width where 200.0 feet in width is required, a
variance of 130.0 feet. Each lot contains 200 or more feet
of width at the proposed house location.
5. Lot 1 will access to Bayside Road (county Road 84) and
is subject to a Hennepin County ac^ess permit. Lot 2 wi :1
access to Leaf Street and is subject to City approval of the
access location.
6. The City will require a 20' wide drainage easement over
each of Lots 1 and 2 for the minor creek traversing the lots
near their respective road access points. Each driveway
crossing of these drainageways will require installation of
a culvert to be approved by the City Engineer.
7. The City wil require a Ccnservation and Flowage Easement
over the designated floodplain of "unnamed Tributary to
Stubbs Bay" on Lots 1 and 2.
8. Both Lots 1 and 2 have been demonstrated to contain
suitable sites for primary and alternate drair.fields to
serve the proposed single family residences.
9. Single family residences can be constructed on both Lots
1 and 2 without the need for further variances.

NOW, THEREFORZ BE IT RESOLVED, that based upon one or
more of the findings noted above, the City Council of the City of
Orono hereby approves the preliminary plat for The Landschute
Group, Inc. at 375 Leaf Street and 3300 Bayside Road per thA
survey dated July 17, 1987, revised September 21, 1987, revised
July 24, 1989 by Theodore D. Kemna, Schoell and Madson, Inc. (see
Exhibit A attached) subject to the following conditions:
1. A variance will be granted to the 200' lot width standard
f or Lots 1 and 2.
2. Lot 1 shall access to Aayside Road subject to a Hennepin
County access permit. Lot 2 shall access to Leaf Street
subject to City approval of the access location.
3. A Conservation and :lowage easement document shall be
executed for the designated floodplain of "unnamed Tributary
to Stubbs Bay" over Lots 1 and 2, and thie easement shall be
shown on the plat drawings as a drainage easement.
4. No building permits will be issued and no permitted
driveway construction or other excavation may be commenced
until such time that the primary and alternate drainfield

Conditions and Stipulations
1. The term mortgage, when used herein, +hall incrude deed of trust, trust deed, or other
security instrument.
2. If the proposed Insured has or acquires actual knowledge of any defect, lien, encum.
brance, adverse claim or other matter affecting the estate or interest or mortgage thereon
covered by this Commitment other than those shown in Schedule B hereof, and shall
fail to disclose such knowledge to the Company in writing, the Company shall he
relieved from liability for any loss or damage resulting from ariy act of reliance hereon
to the extent the Company is prejudiced by failure to so disclose such knowledge. If
the proposed Insured shall disclose such knowledge to the Company, or if the Company

Discussion
The applicants have completed the requirements for final
plat approval. Additionally, a conceptual vegetation screening
plan has been subm�.tted in respect for concerns of the neighbor
to the west about headlights from cars heading down the hill
shining into the house. Applicant notes that the proposal is to
supplement existing screening by transplanting a few cedar trees
from the proposed driveway area. App'l icant notes that the
screening can be further augmented once the driveway is in and
final grades and elevations are established.
The applicant notes that the intent would be to not disrupt
the existing stand of Norway �-ines noted on the sketch. This had
been a concern of the neighbor to the southeast.

BAYSIDE WOODS

WHEREAS, the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota;
and
WHEREAS, the City Council of the City of Orono has
adopted subdivision regulations for the orderly, economic and
safe development of land within the City; and
WHEREAS, the City Council has considered the
application for a subdivision by the Landschute Group:, Inc., the
subdivider; and
WHEREAS, on September 25, 1989 the City Council
approved Resolution #2705 granting preliminary approval for a
plat at 375 Leaf Street/3300 Bayside Road; and
WHEREAS, the proposed plat contains two lots each
exceeding the 2.0 acre minimum lot area requirement of the LR-IA
zoning district. Lots 1 and 2 require a variance to the 200' lot
width requirement as measured at the rear of the 50' front yard
abutting Bayside Road or Leaf Street; and
WHEREAS, the subdivision has been found to meet all
other standards of the LR-lA zoning district, finding that each
lot is of a size and configuration that will allow its use as a
single family residence to be fully developed without the need
for further variances; and
WHEREAS, both proposed lots have been demonstrated to
contain suitable sites for primary and alternate drainfields to
serve the proposed single family residences; and
WHEREAS, proposed Lot 1 is intended to he served by a
private driveway accessing to Bayside Road, subject to a Hennepin
County Access Permit. Lot 2 is intended to be served by a
private driveway accessing to Leaf Street, subject to City
approval of the access location; and
WHEREAS, the subdivider has completed all requirements
of the platting regulations of the City, inc-luding:

2. Lot 1 shall access to Bayside Road subject to Hennepin
County access permit. Lot 2 shah access to Leaf Street
subject to City approval of the access location.
3. No building permits will be issued and no permitted
driveway construction or other excavation may be commenced
until such time that the primary and alternate drainfie'd
sites have been fenced off to eliminate disturbance of same
(see Exhibit A attached).
4. Applicant shal I adhere to the screening/planting plan
for the area of the driveway for Lot 1, attached hereto its
Exhibit B.
5. The aforesaid plat shall be filed by the City of Orono
with the Hennepin County Recorder's Office on or before Mtry
13, 1:90 together with a certified original copy of this
Resolution and executed copies of the Conservation & Flowage
Easement noted above.

I have reviewed the plat of Bayside Woods submitted
to you by letter of November 29, 1989 from Michael P. Gaffron
of the City of Orono.
1. My review has been limited to Chapter 505 of
Minnesota Statutes. I assume that the City has seen that
the plat complies with the Orono subdivisijn and platting
ordinances.
2. The materials received from t'-ie City include
a Resolution No. 2728 adopted November 13, 1989. I am unable
to comment on whether the legal and factual findings in the
Resolution are correct and consistent with the City'z ordinances.
3. Also included in the package is a Flowage and
Conservation Easement for recording. As noted in Mr. Gaffron's
cover letter, the notary acknowledgement forms on that document
are incomplete. The document should be re -executed with
proper acknowledgements. Also, the document should be revised
in the first paragraph on page 1 to indicate that it is made
by "Maurice R. Taylor II and Cheryl L. Taylor, husband and
wife, fee owners, and the Landschute Group Inc., a Minnesota
corporation, contract purchaser." The document should be
filed immediately after the plat.
4. Minn. Stat. §505.03 requires the submission
of an abstract and certificate of title. In lieu of an abstract,
a title commitment has been provided. I recognize that this
is a common practice in many municipalities, but it does
not follow the exact letter of the statute. According to
the Registrar of Titles, the Owner's Duplicate Certificate
of Title is at the courthouse.
5. I assume that all proper procedures were followed
for approval of the preliminary plat. For example, Minn.
Stat. §505.03(2) requires submission to the Commissioner

of Transportation ;f the property abuts a trunk highway or
a proposed highway which has been designated by a center
line order. From my review of the plat, it does not appear
as if there is such a highway or proposed highway abutting
the plat. If there were such a highway or proposed highway,
then Section 505.03(2) would require the subm,ssion of a
certificate that all propez approvals of the Department of
Transportation had been obtained.
6. Under Section 505.08(2(a) in counties that
have microfilm capabilities, the only copy of the plat that
need be filed is the mylar. This applies in Hennepin County.
7. The mylar must be labeled "Official Plat" as
required by Section 505.08(2a).
8. It will be necessary for the proper filing
fees to be paid. Under Minn. Stat. §505.0E(2), the filing
fee is $30. The real estate taxes due and payable in 1989
and prior years have been paid in full.
9. As yet, the plat is incomplete as the signatureG
of the various county officials have not been obtained.
10. Subject to the foregoing, I conclude that
the plat is satisfactory.

FLOWAGE AND CONSERVATION EASEMENT
AND WAIVER OF DAMAGES
THIS INDENTURE, made and entered into this — day cf
pr 19R by and between Maurice R. Taylor iI and
CherylL. Taylor, hus and and wife, fee owners, and The Landschute
Group, Inc., a Minnesota corporation, contract purchaser, and their
heirs, assigns, and successors (hereinafter collectively referred
to as the Grantori) and the City of Orono, its successors and
assigns, a ...inicipal corporation under the laws of the Sate of
Minnesota (her-inafter referred to as the Grantee).
WITNESSETH, Grantors, for and in consideration of the
sum of One Dollar ($1.00) and other valuable consideration, hereby
covenant, grant, gift, quit claim and convey to Grantee the right
to restrict and Grantors agree to limit and preclude the use,
improvement and development, under the conditions and covenants
herein contained, the following described Land in the County of
Hennepin and State of Minnesota:
Areas shown as "Drainage Easements" on the plat of Bayside
Woods, Hennepin County, Minnesota.
as follows:
1. Grantors hereby covenant and agree:
A. No structures shall be constructed, erected, or placed
upon, above, or beneath the Land including without
limitation, fences, fireplaces, steps, docks, piers,
hardcover or roads of any nature whatsoever, or any other
structure or improvement inconsistent wi`.h the natural
state of the Land.
B. No trees, shrubs or other vegetation shall be
destroyed, cut or removed from the Land except as
authorized by written consent of Grantee.
C. No earth, loam, peat, gravel, soil or any other natural
material or substance shall be moved or removed from the
Land and there shall be no dredging or excavation of any
nature whatsoever or any change of the topography of the
Land without the written consent of Grantee.
D. No soil, sand, gravel or other substance or material
as landfill shall be placed, dumped or stored upon the
Land and no waste, trash or garbage shall be pla--ed, dumped
or stored upon the Land.
E. No use shall be made of the Land except uses, if any,
which will not change or alter the natural condition of
the Land, : d no use which would tend to change the
drainage, flood control, water conservation, erosion
control, soil conservation, fish and wildlife habitat
characteristics shall be made of the Land or the water
situated thereon.
F. Grantee may enter upon the Land for the purposes of
inspection and enforcement of the covenants contained
herein and to cause to be removed from the Land without
any liability any structures, uses, materials, substances,
or unnatural matter inconsistent with the covenants
contained herein and the natural state of the Land.
2. Grantors hereby grant, gift, quit claim and convey
to Gran,�ee, a perpetual flowage easement and right and
privilege to trespass with water over and upon any or
all of the Land.
3. Grantors herein do hereby remiss, release, acquit
and forever discharge, the Grantee and any and all of
its officers and employees of and from any and all claims,
demands or causes of action of any kind or nature
whatsoever which may arise or accrue by virtue of any
flowage or trespass with water within terms of these
agreements.
In addition to any other remedy the Grantee may have,
the covenants and restrictions contained herein may be en_`orced
by injunction.
Grantors do not intend teat the public should have any
interest in the above land by virtue of this indenture cr otherwise,
except as hereinabove set forth.
The Grantors herein certify that the Land herein described
is free and clear of all encumbrances except: Contract for Deed
dated October 12, 1989 between Grantors.
All provisions hereof shall run with the Land and shall
extend to and bind the heirs, successors, representatives, grantees
or assigns of the respective arties hereto.

This is to let you know that the plat of Bayside Woods
along with the revised Flowage and Conservation Easement and Waiver
of Damages were filed in the office of the Hennepin County Registrar
of Titles on December 26, 1989. Enclosed for your information
is a photocopy of the receipt for the filing fees totalling $60.50.
These charges will be billed to the C`ty of Orono along with our
statement for fees. I assume that you will be seeking reimbursement
for the filing fees of $60.50 from the property owner. I have
also enclosed for your records an extra fully signed original
copy of the revised Flowage and Conservation Easement and Waiver
of Damages. I am also returning to you the copies of City of
Orono Resolution No. 2728 and First American Title Insurance Company
Commitment No. T18152 which you provided in your previous letter
