Notice of Meeting
The clerk shall give at least 10 days posted notice of the time and place of the meeting of the
board of appeai and equalization; but the failure to give such notice or hold such meeting shall
not ^'itiate any assessment except as to the excess over the market value of the property
(M.S. 274.03)
The Commissioner of Revenue shall specif’ the fonn of the notice. The assessor shall attach to
the assessment roll a statement that die notices have been mailed. Any assessor who is not
provided sufficient funds from die assessor’s governing body to proside such notices mav make
^iplicatioD to the Commissioner of Revenue to finance such notices. The Commis.sioncr of
Revenue shall conduct an investigation and if sau.sfied that the assessor does not have the
necessary funds, issue a certification to the Commissioner of F. nance of the amount neces.saiA’ to
provide such notices. The Commissioner of Finance shall issue a warrant for this amount and
deduct the amount from any state payment to the countj' or municipaiitv’. j'lie necessary funds to
make such payments are hereby ^Tpropriated. Failure to receive die notice shall in no way affect
die validity of the assessment, the resulting tax, the procedures of any board of appeal and
equalization or the enforcement of delinquent taxes by .statutory means. (M.S. 273.121)
Local Board of Appeal and Equalization Duties!
The town board of each town, die council or other governing body of each city, is the local
board of ^ipeal and equalization except;
1 . in cities whose charters provide for a board of equalization, or
2. in any city or town that has transferred its local board of appeal and equalization
power and duties to the county board.
The county assessor shall fix a day and time when the local board of appeal and equalization
shall meet in die assessment districts of the county. Notw ithstandmg anv law- or cit\’ charter to
the contrary, a city board of equalizanon shall be referred to as a board of appeal and
equalization. On or before February 15 of each year, the as.se.ssor shall give writtai notice of
the time to the city or town clerk. Notwithstanding the provisions of any charter to the
contrary, the meetings must be held between -April 1 and May 31 each year. The clerk shall
give published and posted notice of the meetmg at least 10 days before die date of the meetinc.

The board shall detennine whether llic taxable propertj' in the touTi or citv- has been properly
placed on the list and propaly valued b>' the assessor. If real or persona] propcrn’ has been
omitted, die board shall place it on the list widi its market value, and correct the assessment so
that each tract or lot of real properU’, and each article, parcel, or class of personal propert>-, is
entered on the assessment list at its market value. No assessment of the pri»pert>- of an\- person
may be raised unless the person has been duly notified of the intent of the board to do so. On
triplication of any person feeling aggrieved, the board shall re\iew the as.sessment or
classification, or both, and correct it as appears just The board may not make an individual
market value adjustmoit or classification change that would benefit the property in ca.ses
where die owner or other person ha^’ing control over the propert)' will not permit the assessor
to inspect the property and die interior of any buildings or structures.
A local board may reduce assessments upon petition of the taxpayer but the total reductions
must not reduce the aggregate assessment made by die count}’ asses-sor by more than one
percent. If the total reductions would lower the aggregate assessments made by the count}’
assessor by more than one percent, none of the adjustments may be made. The as.sessor shall
correct any clerical errors or double assessments discovered by the board witliout regard to the
one percent limitation.
A local board of ^ipeal and equalization does not have die audiorit}' to grant an exemption or
to order property removed fiom the tax rolls.
A majority of die members may act at the meeting, and adjourn from da}- to day until tiiey
finish hearing the cases presented. The assessor shall attend, i^ith the assessment books and
papers, and take part in the proceedings, but must not vote. The count}- a.ssessor shall attend
the meetings. The board shall list separately, on a form appended to the assessment book all
omitted propert}’ added to the list by the board and all items of propert}- increa.sed or
decreased, w-idi die maiket value of each item of propert}', added or changed by the board,
placed opposite the hem. The count}- assessor shall enter all changes made b> the board in the
assessment book.
Except for taxpayers in the town or city whose town or city elected to transfer its powers and
duties to die county, if a person feds to appear m person, by counsel or by wrinen
communication before die board after b^g duly notified of the board's intent to rai.se the
assessment of die property, or if a person fe' 'mg aggrieved by an assessment or classification
iails to apply for a rei-iew of the assessment or dassificaiion. the person may not appear before
die county board of appeal and equalization for a rex-iew- of die assessment or classification.
This paragr^ih does not apply if an assessment was made after the local board meeting, as
prov-ided in M.S. 273.01, or if the person can establish not ha\’ing received the iKtticc of
maricet value at least five da}’s before die local board meeting.

The local board must complete its woric and adjourn within 20 days from the lime of
convening stated in the notice of the clerk, unless a longer period is approved by the
Commissioner of Revenue. No action taken after that date is valid. .\11 complaints about an
assessment or classification, made after the meeting of the board must be heard and
di'rtermined by the county board of appeal and equalization. A nonresident may. at any time,
oefore die meeting of the board file wntien objection.^ U) an as.sessmcnt or classification with
the county assessor. The objections must be presented to the board at its meeting by the county
assessor for its consideration. (M.S. 274 01, subdivision 1)
Local Board Duties Transferred to Countv
The town board of any town or the governing body of any home rule charter or statutorv' city
may transfer its powers and duties to the county board, and no longer perform the function of a
local board. Before the town board or the governing body of a aty transfers the powers and
duties to die county board, the town board or city’s governing body shall give public notice of
the meeting at which the propo.sal for transfer is to be considered. The public notice sliall follow
(he^TTOcedure contained m M.S. liD.04. A transfer of duties as penrijcted under this subdivision
must be communicated to the county as.sessor, in writing, before December 1 of any year to be
effective for the following year’s assessment This transfer of duties to the county may either be
peimanent or for a specified number of years, provided that the transfer cannot be for less than
diree years. Its length must be stated in wntmg. A town or city may renew its option to transfer.
The option to transfer duties under this subdivision is only available to a town or city whose
assessment is done by the county. (M.S. 274.01, subdivision 3)
Alternative Review Option
The count)’ shall notify taxpayers in the town or city when the iowti or city board elects to
transfer its local or city board of appeal and equalization powers and duties to the county. Prior
to the time of the county board of appeal and equalization, the county shall make available to
those taxpayers a procedure for a review of its assessments, including, but not limited to. open
book meetings. This alternative review process shall take place in ,\pril or May. (M.S. 274.13,
subdivision Ic)
Special Board of A|^peal and Equalization
The council or other governing body of any city, including cities whose charters provide for a
board of appeal and equa lization, may appoint a special board of appeal and equalization to
which it may delegate all of the powers and duties of the board of appeal and equalizaiicm. The
special board of ^ipeal and equalization shall serve at the direction and discretion of the
appointing body, subject to the restrictions inposed bv law on the appointing body. The
^ipointing bod)' shall determine die number of members to be appointed thereto, the
compensation and expenses to be paid, and the term of office of each mem’oer. .At least one
member of die special board of appeal and equalization shall be an appraiser, realtor or other
person familiar widi propert)' valuations in the assessment district (M.S. 274.01. subdivision 2)

Summary
•M.S. 274.01 provides that dre town board of each township and the governing bod>' of cities
shall be tire local board of ^rpeal and equalization. The board is to review the asses.sment and
classification of property in their township or city.
The county assessor sets the dates for boards of appeal and equalization to meet in his county.
He must notify the cleric of the various dates on or before February 15 of each year. The
meetings art held between April 1 and May 31 .
Duties of Local Boards of Appeal and Equalization
1 . See that all taxable property’ in the township is properly as.sessed. valued and
classified. The board may consider both real and personal property'.
2. If any property has been omined. the board must correct the assessment by adding it to
the list of assessments along with its market value.
3. The assessments of each descripbon of real property’ consisting of land and buildings
are reviewed by the b

Persona] property is limited to mobile homes, storage sheds, decks or similar
improvements located in a manufactured home p>ark, structures on lea5;ed public lands
and railroad operating rights-of-wa}’ and leased buildings located on land ouncd by
the occvpmx and used for purposes of a homestead.
5. The authorit)’ of die local board extends over the indi\idua] assessments of real and
personal properly. The board can*t increase or decrease by jxrccntage all of the
assessments in the district of a given class of prjpcrty. Changes in the aggregate
assessments by classes are made by the counU* board of appeal and equalizanon.

6. Although the local board of appeal and equalization has the authorit>- to increase or
reduce individual assessments, the total of such adjustments must not reduce the
aggregate assessment made by the county assessor by more than one percent of said
aggregate assessment If the total of such adjustments does lower the aggregate
assessment made by the county assessor b>‘ more than one percent none of the
adjustments will be allowed. This limitation doesn't apply, however, to the correction
of clerical errors or to the removal of duplicate assessments.
7. The local board of ^Tpeal and equalization does not have the authority to grant an
exemption or to order propeity' removed from the tax rolls.
8. The local board of appeal and equalization doesn't have the authority in any vear to
reopen former assessments on w'hich taxes are due and payable. The board considers
only die assessments that are in process in the current year. Occasionally a taxpayer
may appear with a tax statement and protest the taxes or assessment of the pre^^ous
year. The board should explain tactfully that it does not have the authonn to coasider

process of application for abatement or by legal action.
9. In reviewing flie individual assessments, die board may lind instances of
undervaluation. Before the board raises the market value of property, it must notify the
owner. The law doesn't prescribe any particular form of notice except that the person
whose property' is to be increased in assessment must be notified of the intent of the
board to make the increase. The local board of appeal and equalization meetings
assure a property' owner an opportunity to contest the valuation Or classification that
has been placed on his property or to contest or to protest any other maner relating to
the taxability of his property. The board is required to reN’iew the matter and make any
corrections that it deems just
10. \^Tien a local board of appeal and equalization convenes, it is necessary that a majority
of the members be in attendance in order for any valid action may be taken. The local
assessor is required by law to be present w'lth his assessment books and papers. He
also is required to take part in the proceedings but has no vote. In addition to the local
assessor, the county' assessor or one of his assistants is required to attend. The board
should ask the local assessor and county assessor to present any tables that have been
prepared, making con^iarisons of the cuirent assessments in the distnct The county-
assessor is required to have maps and tables relating particularly to land values for tlie
guidance of the local board of ^ipeal and equalization. Compan.sons should be
presented of assessments of ty'pes of property- with pre\'ious years and with other
assessment districts in the same counts'.
11. It is die piimaiy duty of each local board of ^jpcal and equalization to examine the
assessment record to sec that all taxable property* in die assessment district has been
properly placed upon die list and valued by the assessor. In case an\* property’, either
real or personal, has been omitted, the board has the duty’ of making the assessment

12. The complaints and objections of taxpayers who feel aggrieved with an\- asse.ssments
for the current year should be considered very carefully by the board. Such
assessments must be reviewed in detail and the board has authority' to make
corrections it deems to be just The board may adjourn from day to day until all cases
have been heard.
13. A nonresideni may file uritten objections to his assessment with tlie count) asse.ssor
prior to the meeting of the board of appeal and ec]ualization. Such objections must be
presented to the board for consideration while it is in session.
14. Before adjourning, the board of appeal and equalization should prepare an official list
of the changes. Die law* requires that the changes be listed on a .separate form which is
^ipended to the assessment book. The assessments of omined propert> must be listed
in detail with their market values. .All assessments that have been increa.sed or
decreased should be showTi as prescribed in the form along with their market values.
After the changes have been cx*»npieted, the record should be signed and dated by the

Infonnafioo for Local Boards of Appeal and Equalization
The local board of appeal and equalization must complete its work and adjourn within 20 days
from the time of convening specified in the notice of the clerk, unless a longer period Ls
^^ved by the Commissioner of Revenue. No action taken after that date shall be valid.
A request for additional time in order to complete the w ork of the board of appe and
equalization must be addressed to the Commissioner of Revenue in writing. The
commissioner's approval is necessary to legalize any procedure subsequent to the e.\piration of
die 20-day period. TVe Commissioner of Revenue will not how’ever. extend the time for local
boards of appeal and equalization to meet past the time county boards of appeal and
equalization convene in June.
If a person fails to appear in person, by counsel, or by written communication before the local
board of appeal and equalization after being duly notified by the board's intent to raise the
assessment of the property, or if a person feeling aggrieved by an assessment or classification
fails to apply for a review of the assessment or classification, he she mav not appear before the
county board of appeal and equalization for a review of the assessment or classification,
except wdien an assessment was made subsequent to the meeting of the board or if it can be
^blished that notice of the market value was not receiv-ed at lea.st five davs before the local
’of ^ipeal and equalization meeting. (M.S. 274.01, subdivision 1)
All real property subject to taxation shall be listed and at least one-fifth of the parcels listed
diall be ^ipraised each year with reference to dieir value on January 2 preceding the
assessment so that each parcel shall be reappraised at maximum mtervals of fiv e vears. .All
real property becoming taxable in any year shall be hsted with reference to its v alue on
January 2 of that year. (M.S. 273.01)

Local ass^sor: The duty of the duly appointed local assessor sh^ be to and appraise
the value of all property as pro\ided by law, but all the booV woric shall be done by the count}'
assessor, or his assistants, and fte value of all propeit}' subject to assessment and taxation shall
be determined by the county assessor. (M.S. 273.061)
County assessor: The county assessor makes all assessments based upon the appraised values
reported to him by the local assessors or his assistanLs and his own knowledge of the \ alue of
the property assessed. He must personally >iew' and determine the value of anv property' which
because of its type or character may be difficult for the local assessor to appraise. The count\*
assessor is to make all changes ordered by the local boards of appeal and equalization relative
to the net tax capacity of the property’ of any individual firm or corporation after notice has
been given and hearings have hten held. (M.S. 273.061 )
Appeals and Ei}ualization Course and Meeting Requirements
New legislation was enacted in 2003 requiring the Commissioner of Revenue to develop an
appeals and equalization coiUst' for local boards of appeal and equalization, ll'.c legislation
was enacted in response to complaints that taxpayers had when aUending local boards of
appeal and equalization meetings. For example:
• some local boards have held meetings without having a quorum:
■ some taxpayers have found the experience to be confrontational; and
■ some local boards have claimed that thev’ “don’t know anj'thing about property
values.”
The course will detail the responsibilities, procedures and requirements of the local Kards in
an effort to reduce coiuplaints and improve this step <»f the appeal process for taxpayers.
The handbook: By January 1,2005, the Commissioner of Revenue is to develop a handbook
for the course that will include the following:
• the role ofdie local board in the assessment process;
■ legal and policy reasons for feir and ipartial hearings;
• local board meeting procedures that foster fair and impartial assessment re\iews and
best practices;
• quorum requirements for local boards; and
explanations of alternate re%neu methods.
The course: By January 1,2006, at least one member at each meeting of a local board of
^apeal and equalization must have attended the ^ipeals and equalization course de\ eloped or
approved by the Commissioner of Revenue wifliin the last four years. The course mav be
offered in conjunction with a meeting of die Minnesota League of Cities or the Minnesota
Association of TowTish^s. The handbook developed by the Commissioner of Re\ enae must
be reviewed during die course.

Compliance: Cities and towns must provide proof to the county assessor by December 1,
2006, and each year diereafter, of having:
at least one membo' at each local board of ^jpeal and equalization meeting who has
attended the appeals and equalization course in the last four years; and
a quorum at each local boa^ of appeal and equalizabon meeting in the prior year.
Any city or town that fails to provide such proof is deemed to have transferred im board of
appeal and equalizanon powers to the count>' for die following year's assessment

The purpose of this local board meeting is to review the Estimated Market Value Classification for the 2003
Assessment, ndiich will be reflected in taxes payable for 2004.
Any questions regarding the taxes payable in 2003 cannot be addressed at this meeting because they are based on the
assessment made in 2002. This Board has no authority to act on the 2003 taxes as per MN statute. Sec. 274.01 .
While we realize the MN Property Tax system is rather complicated and, at times, difficult to understand, it is hoped that
the following information will help you when trying to communicate your questions and concerns with regard to your
property’s market value.
State law requires that the value and classification of real estate be established as of January 2nd each year. Market values
are based on sales of properties within your market area. The Minnesota Department of Revenue requires the overall level
of assessment to be between 90% and 105% of market value. If the overall level of assessment is not at least 90%, the state
may impose an aggregate increase on all properties within a city or classification. If sales indicate the market values have
changed^ the assessor must follow the trend indicated, whether it is to increase or decrease property values.
Mass appraisal is the method used by assessors to estimate the market value of properties. Each property is physically
viewed every four years. In addition, all new construction, alterations, or improvements will be appraised annually.
COMMONLY ASKED QUESTIONS AT BOARD OF APPEAL MEETINGS
1. IS IT ILLEGAL FOR THE ASSESSOR TO INCREASE MY VALVE SO MUCH IN ONE YEAR?
( No. The assessor must v.ilue property at market value each year. Property values chance conlinuously with
changing economic conditions. There is no limit as to the amount of increase or decrease in property \-alues in a
given year.
2, WHEN WILL THE VALUE INCREASES STOP?
This is impossible to predict Our values are dictated by the market. If sale prices are increasing, our
estimated market values will increase. If sale prices are falling, then our estimated market >’alues must follow
that trend.
3. WHAT DOES THE ASSESSOR LOOK AT TO DETERMINE A PROPERTY'S MARKET VALVE?
Each property is viewed to gather information on all characteristics that affect its market value such as location,
size, age, quality of construction, amenities (i.e. w’alkout basements, fireplaces, and extra baths), and site
characteristics.
4. ASA HOMESTEADING RESIDENT, WILL IRE TAXED OFF MY PROPERTY, ESPECIALLY IF I AM
ON A LIMITED INCOME?

Homesteading residents are eligible for property tax breaks in Minnesota through the use of the Homestead
Classification. This decreases the property taxes on most residences. In addition to the Homestead Classification,
residents of Minnesota are eligible to apply for the Regular Property Tax Refund or the Special Propert> Tax
ReAmd. Both of these must be qiplied for using the M • IPR form issued by the State of Minnesota. The Regular
Refund is based on income, so check the requirements stated on the form. You may qualify for the Special Refund
if your property taxes uicreased by more than 12% from 2002 to 2003 and the increase was SlOO or more. There
are speafk guidelines for each refimd, which sue included with the instructions for the M • IPR form

NOTICE IS HEREBY GIVEN, that the Local Board of Appeal and ^ualization of the
City of Orono in Hennepin County, Minnesota, will meet at the Orono Council Chambers, 2780
Kelley Pathway, in said City of Orono at 7:00 o'clock p.m. on Wednesday, the 20th day of April,
