The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance woulc; not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary tc, preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLOSICNS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants a variance to the Municipal Zoninq Code Section 10.25, Subdivision 6(B) to allow construction of a second story addition over an existing first story located 4.2' from the side lot line where a 10' side setback is normally required; and grants a variance to Section 10.22, Subdivision l to allow encroachment of 7' into the average lakeshore setback zone where no encroachment is normally allowed and allow a ]' encroachment into the 0-75' lakeshore setback zone where no encroachment is normally allowed; and grants a variance to Section 10.22, Subdivision 2 to allow hardcover of 1.3% in the 0- 75' lakeshore setback zone where no hardcover is normally allowed, subject to the followin- conditions: 1. Applicant must remove the 8'x 30' deck except for a 6'x 8' section which is allowed to remain. 2. The removed deck sections may be replaced with a loose rock or woodchip area underlain by permeable geotechnical weed reduction fatric but not plastic sheeting which is hardcover. Mnile I was there, I noticed that you had installed a now wood burning stove without s permit and without installation Inspections. I am concerned because of several serious safety problems noted as followst 1. Manual damper in gas vent connector prohibited (811C 7401(a)). Damper closes flue and allows products of combustion to enter house - asphyxiation hazard. 3. Vent connector installed with downward pitch prohibited !SK 7407, Pitch) - does not allow gas appliance to vent properly and wood burning unit can back vent into gas appliance. 3. Vent connector passinq through wall without thimble prohibited 188C 7404, Clearance). The thimble is to provide proper clearances and firestops. 1. Gas appliance coltnected to wood burning unit flue prohibited (50C 7407). S. Wood burning unit does not have proper testing or certification (811C 103-7) Without twisting or certification, clearances to combustibles, proper installation, operstiott and maintenance cannot be assured. 6. Clearances to combustibles (4" existing) have not e.►en slat. (8K 8406) must. by 360 from unprotected combustible wall. 7. Chimney height is not high enough - must be 2'-00 above rjAge of house (ROC/UNC 37031f)). •. Permit is required for installation of furnace and woodburnine unit (Orono Ordinance 4o. 20.010). We are concerned that your homemade stove has not been properly testad or provided with proper installation or clearance. We will cooperate in any way we can to help you provide an acceptable energy alternative.
