REQUEST: To remodel and add on to the existing home, particularly on
the lake side in place of a former screened porch. Also
shown is a large deck extending farther toward the lake.
VARIANCES REQUIRED: 34.201 - One small corner of the porch addition
encroaches on the 75 ft. lakeshore setback. The
deck encroaches to within 64 ft. of the shore
and well in front of the adjoining homes.
SPECIAL NOTES: The home is a converted summer cottage on a 50' x 190'
(9500 sf) lot and is located 4.23 ft. from the west
lot line. There is no foundation under the existing
porch and questionable foundation under the remainder.
Remodeling in excess of 50% of the market value ($14,600
* 2 = $7,300) would also require variances to 34.552,
lot area and lot width.
PLANNING COMMISSION - April 10, 1978 WORK SESSION
Planning Commission expressed approval of addition but not deck as it extends
too far into lakeshore setback zone. Also expressed approval of repairing
existing porch and steps which encroach lakeshore setback.

The Planning Commission approved the variance contingent upon maintaining the steps
and omitting the deck.

The Village Planner introduced the subdivision.
Mr. Kelly was presert_. The Village Planner
stated the size of Parcel A, which is 6 acres,
should be addressed as to where it will be
redivided and where there will be access. Jim
Olson concurred that it would be in the best
interests of the applicant and the City of Orono
to address the access at this time -regarding
private or public. The Village Planner stated
the Council is in the process of preparing
guidelines for the Planning Commission regarding
this issue.
The Planning Commission indicated that they did not
have any problems with this subdivision plan as
submitted. The Commission informed Mr. Kelly that
any wetlands would be subtracted from the total
dry buildable area and that any roads would also
be subtracted. The Village Planner noted the
wetlands area had not been located and that a survey
would have to be submitted indicating the designated
wetlands area.
WORK SESSION ITEMS
Mr. Wittmer was present. The Zoning Administrator
stated this is a variance to add onto the existing
home on the lake side. He added that this area is
sewered. The Planning Commission indicated that
they were not in favor of the deck encroaching within
75 ft. lakeshore setback, but that they did not have
problems with the small portion of the porch or the
existing steps encroaching.
Mr. Grimes and Mr. Dahl were present. It was noted
this is an existing non -conforming situation that
the addition needs no variances, but that the
existing house encroaches into the front yard setback.
The Village Planner stated that the Ordinance states
that if the addition is over 507. of the value of the
existing structure it is considered a new structure
and requires a variance.
Hannah moved, McDonald seconded, a motion that given
the fact that this property has been before the
Commission and the Council for subdivision and that
they are aware of the existing structure and have
previously Approved the lot lines, the variance should
be approved subject to no new variance being required
to add onto the existing structure.
Motion: Ayes (6), Nays (0), motion passed.

Members of the Planning Commission:
In accordance with your wishes verbally given to me at the
Planning Commission meeting on April 10, 1978. I am, by
this letter, reapplying for a variance in accordance with
the plans that you reviewed at the April 10 meeting.
The property is at 1420 Boulder Park Road. However, in
resubmitting I herewith agree to delete the front deck
from the lakeside of the home and further agree that the
steps that I. reconstruct will be no larger in length,
width or height than those presently existing.
Since the April 10 meeting, I have spoken with Mr. Al Olson
from the building inspector's office who indicated to me
that this was a proper method to resubmit for variance, and
I herewith request that action be taken on this variance at
your next regularly scheduled meeting on April 24, 1979.

MINUTES OF A PLANNING COMMISSION MEETING HELD ON APRIL 24, 1978
Chairman Hassel announced this was the time and
place for a Public Hearing on the petition of
American Rebuilders. The City Planner presented
the Notice of Public Meeting and the Affidavit of
Publication. The applicant Mr. Herfurth was
present as well as the following neighbors: Fred
Keller and Jack Rosengren, a representative for
Elmer Ties. Al Olson read into the record a
recommendation of the County Engineer regarding
access and right-of-way on this property -
Basically, the County would request an additional
10' of right-of-way along County Rd. 6 as has
been standard procedure along this highway and
that no more thin two new access points to County
Rd. 6 be granted. This last request would require
at least one common access point along the three
lots abutting County Rd. 6. The Public Hearing
was closed at 7:58 P.M. Most of the Planning
Commission discussion centered cn the Highway
Department's recommendation - they were not
ready to limit access to two access points until
the staff had reviewed it further. Jim Olson,
city engineer, noted for the record that Lots 2, 3,
and 4 were just under 4 acres each and that due to
the 2-acre zoning requirement they would not be
further subdividable. The Planning Commission
thereafter recommended approval of the preliminary
plat as shown on the drawings dated 2-9-78, subject
to septic system testing prior to final, plat approval,
park dedication fee payment, conservation and flowage
easements over the wetlands, and to the 10' additional
right-of-way dedication along County Rd. 6 as shown
on the preliminary drawings. Motion by Frahm,
seconded by Hanunerel, Ayes (6), Nays (0), motion
carried.
Mr. Wittmer was present. It was noted that a letter
had been received from Mr. Wittmer revising the
application. Frahm moved, Hassel seconded approval
of the variance contingent upon maintaining the
steps and omitting the deck. Motion, Ayes (6),
Nays (0), motion carried.

record the request of Hennepin County Vo-Tech,
2950 Sixth Avenue North, for a conditional use
permit renewal, datf-d April 24, 1978 which states:
