I O� O O . • �� � . � : CITY of ORONO . � - ; � ��� �G~' �� RESOLUTION OF THE CITY COUNCIL `9kESIIOg' NO. � � "� � A RESOLUTION REQUESTING A VARIANCE FROM MINNESOTA RULES FOR STATE AID OPERA.TIONS CHAPTER 8820 WHEREAS,the City Council of the City of Orono is preparing construction plans for � the replacement of the Fox Street Bridge over Long Lake Creek, Existing Bridge No. L8865, which is considered deficient according to Mn/DOT's standards; and WHEREAS,the City Council of the City of Orono, its citizens, and city staff believe that the minimum design standards set forth by Minnesota Statutes as applicable to the proposed replacement of Bridge No. L8865 create an undue hardship; and • WHEREAS, said hardship is further explained in the attached supplementary letter from the City Engineer; and NOW THEREFORE, BE IT RESOLVED that the Orono City Council, located in Hennepin County, Minnesota, hereby respectfully submits a request for a variance to the Commissioner of Transportation for Minnesota Rules for State Aid Operations,Chapter 8820.9920, Geometric Design Standards; Rural and Suburban Undivided;New or Reconstruction Projects, as they apply to the proposed Fox Street bridge replacement project located in the City of Orono,so as to allow the following: 1. 12-foot Traffic Lane Widths and 2-foot Shoulder Widths; in lieu of the � minimum 12-foot traffic lanes and four foot shoulder widths required; 2. A 28-foot bridge roadway width; in lieu of the minimum 36-footwidth required; 3. The Council further agrees to defend at its sole cost and expense any action or proceeding begun for asserting any claim of whatever character arising as a result of the granting of the variance. No. 152-105-01 Our File No. 139-03-136 Dear Dan: • I am writing regarding the variance that the City of Orono will be re uestin for the brid e q g g replacement. Once we have an opportunity to discuss the variance, the City Council wi11 consider a resolution regarding the variance. The project in question involves replacing an existing 26-foot wide bridge in Orono. The bridge serves primarily local residents. Included with this letter are some photos of the project area and a map .showing the project location. • i�ariance Requested MnDOT design standards for rural bridges calls for a minimum of 12-foot lane widths and 4-foot shoulders. The curb to curb width of the bridge is the sum of the lanes width and shoulder widths plus four feet. This would require a minimum curb to curb width on the bridge of 36 feet. We are requesting a variance from Rule 8820.9920 to allow two 12-foot lane widths and 2-foot shoulders. The specific variances requested are: l. Two 12-foot wide traffic lanes and 2-foot wide shoulders on each side in lieu of the � � minimum 12-foot wide traffic lanes and 4-foot wide shoulders required; and . 2. Mr. Dan Erickson May S, 2003 Minnesota Department of Transportation � 9 `�' � Page 2 � Yariance Justification �� :` Fox Street is an east-west street through a wetland area. The approaching roads on each side of the bridge have a pavement width of 24 feet and the total surface width, including the shoulders is 27 feet wide. Therefore, the shoulders are`1.5 feet wide on each side of the pavement. The roadway embankment has slopes of approximately 2H:1 V on each side. The slopes continue until they reach the wetland on each side of the road. The area is fairly well developed, except for the wetlands, at this time which reduces the likelihood of increased traffic volumes. Widening of the existing street would require filling of the wetlands. This will not occur due to the constant traffic volumes in the area and the impacts on the wetlands. Given the constraints of the existing wetlands, the design standards developed by MnDOT are difficult to comply with. Therefore, we outline the following points of justification for the requested variance: l. Substandard Streets: The streets in the area of the bridge are substandard compared to current MnDOT standards due to the wetlands. The approaching streets on each side of the bridge are approximately 24 feet in width and will continue to be that width in the . • future. The proposed bridge width is consistent with the approach roads. 2. Avoid Severe Environmental Imnacts: Widening of the bridge and the approach roadway would significantly impact the adjacent wetlands. Minimizing the amount of roadway width will limit the environmental impacts of the project by reducing the amount of fill that would be placed in the wetland. Minimizing the amount of filling of the wetland will increase the chances of receiving permits from environmental agencies. Impacts of the Variance Economic—The variance would allow a narrower bridge to be constructed. The narrower bridge would be less costly to construct which is a savings for the funding source which is anticipated to be the State Transportation Fund. The narrower bridge would not have any negative economic impact on the adjacent property owners. . . Social—The variance requested for the proposed bridge would not have any social impacts. Safetv—The variance for the proposed bridge will not significantly impact the safety of the public. The proposed bridge is about 2 feet wider than the existing bridge. Therefore, the wider bridge will improve the safety of the site as compared to the existing conditions. Environmental—The variance for the proposed bridge would have positive environmental • impacts. The variance would significantly reduce the amount of wetland area that would need to be filled by maintaining the same approach roadway width. • Mr. Dan Erickson May S, 2003 Minnesota Department of Transportation � 9 � � Page 3 • Effectiveness of the Variance �` The variance would still allow the bridge to be replaced which is in poor condition. Severe deterioration of the steel beams has occurred at the abutments. This deterioration will continue. The new bridge will have a design loading�of HS25 as specified in the MnDOT Bridge Design � Manual. Effects on Adiacent Lands . The variance would reduce the affects on adjacent lands which are wetlands. By conshucting a narrower bridge, the amount of fill placed in will be reduced. Number ofPersons Affected The proposed variance would not have an affect on any of the bridge users. Safetv Considerations The bridge would be approximately two feet wider than the existing bridge, four feet wider than the pavement of approach roads and one foot wider than the approach roads and shoulders. The bridge will be wider than the approach road and shoulders and therefore would not compromise the safety of the users. Vehicular users and emergency services will benefit from a new bridge with a higher load • canying capacity than the existing bridge. The bridge width as requested by the variance will not impact the safety of the vehicular users and emergency services. After reviewing this information, please call me at (651) 604-4895 to discuss.
