O � O , . • - � � : CITY of ORONO � � ; � ��� �G~' ��� RESOLUTION OF THE CITY COUNCIL �kESSOg' NO. � � � � A RESOLUTION REQUESTING A VARIANCE FROM MINNESOTA ' RULES FOR STATE AID OPERATIONS CHAPTER 8820 WHEREAS,the City Council of the City of Orono is preparing construction plans for the replacement of the West Ferndale Road Bridge over Browns Bay Channel, Existing Bridge No. L8854, which is considered deficient according to Mn/DOT's standards; and WHEREAS,the City Council of the City of Orono, its citizens, a.nd city staff believe that . the minimum design standards set forth by Minnesota Statutes as applicable to the proposed replacement of Bridge No. L8854 create an undue hardship; and • WHEREAS, said hardship is further explained in the attached supplementary letter from the City Engineer; and NOW THEREFORE, BE IT RESOLVED that the Orono City Council, located in Hennepin County, Minnesota, hereby respectfully submits a request for a variance to the Commissioner of Transportation for Minnesota Rules for State Aid Operations,Chapter 8820.9920, Geometric Design Standazds; Rural and Suburban Undivided;New or Reconstruction Projects, as they apply to the proposed West Ferndale Road bridge replacement project located in the City of Orono, so as to allow the following: 1: 11-foot Traffic Lane Widths and .2-foot Shoulder�1Vidths; in lieu of the minimum . � 12-foot traffic lanes and four foot shoulder widths required; 2. A 26-foot bridge roadway width; in lieu of the minimum 36-footwidth required; 3. The Council further agrees to defend at its sole cost and expense any action or proceeding begun for asserting any claim of whatever character arising as a result of the granting of the variance. No. 152-080-01 Our File No. 139-03-132 � Dear Dan: • I am writing regarding the variance that the City of Orono will be requesting for the bridge replacement. Once we have an opportunity to discuss the variance,the City Council will consider a resolution regarding the variance. � The project in question involves replacing an existing 22-foot wide bridge in Orono. The bridge serves primarily local residents that are traveling to or from CSAH 15 to the west of the bridge. East of the bridge, Ferndale Road continues to downtown Wayzata. Included with this letter are some photos of the project area and a map showing the project location. � . Variance Requested � � MnDOT design standards for rural bridges calls for a minimum of 12-foot lane widths and 4-foot shoulders. The curb to curb width of the bridge is the sum of the lanes width and shoulder widths plus four feet. This would require a minimum curb to curb width on the bridge of 36 feet. We are requesting a variance from Rule 8820.9920 to allow two 12-foot lane widths and 2-foot shoulders. The specific variances requested are: � 1. Two 11-foot wide traffic lanes and 2-foot wide shoulders on each side in lieu of the � minimum 12-foot wide traffic lanes and 4-foot wide shoulders required; and • 2. Fax: G51-G3G-1311 Mr. Dan Erickson May S, 2003 Minnesota Department of Transportation page 2 � � � � • Yariance Jicstification �' Ferndale Road is located on the north side of residences on the shore of Lake Minnetonka, i.e. the residences are between Ferndale Road and Lake Minnetonka. In the area of the bridge, wetlands and a lagoon are located on the�north side of the road. Ferndale Road has narrow shoulders, approximately 1.5 feet, on each side. Outside of the shoulders, the slopes go down to the yards or the wetlands. Tlie area is fairly well developed at this time which reduces the likelihood of increased traffic volumes. Widening of the existing street would require filling of the wetlands and lagoon. This will not occur due to the constant traffic volumes in azea and the impacts on the wetlands. � Design standazds for much of the public infrastructure serving the region have necessarily been compromised to suit the topography. Given the constraints of the existing land use and wetlands, the design standards developed by MnDOT are difficult to comply with and aze out of character. Therefore,we outline the following points of justification for the requested variance: . . _ l. Substandard Streets: Tlie streets in the�area of the bridge are�severely substandard�due ' to the land use and wetlands. The approaching streets on each side of the bridge are slightly over 20 feet in width. The legal posted speed of both approaches is XX mph. A narrow bridge in this setting is consistent with the driving comdor. .. • 2. Avoid Severe Environmental Imnacts: Widening of the bridge and the approach roadway would significantly impact the adjacent wetlands and lagoon. Minimizing the amount of roadway width will limit the environmental impacts of the project and increase the chances of receiving permits from environmental agencies. 3. Retain Character of the Area: As described in the introduction of this section, the Ferndale Road Bridge exists in a quite residential area. We believe that the variance requested will assist us in retaining the character of the area. Imnacts ofthe Yariance Economic—The variance would allow a narrower bridge to be constructed. The narrower bridge would be less costly to construct which is a savings for the funding source which is antici�ated to be the State Transportation Fund. The narrower bridge would not have any negative economic . impact on the adjacent property owners. Social—The variance requested for the proposed bridge would not have any social impacts. Safetv—The variance for the proposed bridge will not significantly impact the safety of the public. The proposed bridge is about 4 feet wider than the existing bridge. Therefore, the wider bridge will improve the safety of the site as compared to the existing conditions. • Environmental—The variance for the proposed bridge would have positive environmental impacts. The variance would significantly reduce the amount of wetland area that would need to be filled by maintaining the same approach roadway width. The City of Orono has performed temporary repairs to the bridge to increase its load carrying capacity. Severe deterioration of the steel beams has occurred at the abutments and �midspans. This deterioration will continue. The new bridge will have a design loading of HS25 as specified in the MnDOT Bridge Design Manual. � � Effects on Adiacent Lands -- The variance would reduce the affects on adjacent lands. Some of the adjacent property owners are built out close to the edge of the roadway. By constructing a narrower bridge, the impacts on the adjacent lands will be reduced. Number ofPersonsAffected . The proposed variance would not have an affect on any of the bridge users. Safetv Considerations . ..... - - _. ._----------.__ . _ ... ere are some-pedesfrians�arid bicyclists in the area. The bridge would be approximately 4 feet� � ' wider than the existing bridge, six feet wider than the pavement approach roads and three feet wider than the approach roads and shoulders. The bridge will be wider than the approach road .and shoulders and therefore would not compromise the safety of the pedestrians and bicyclists. • Vehicular users and emergency services will benefit from a new bridge with a higher load cariying capacity than the existing bridge. The bridge width as requested by the variance will not . impact the safety of the vehicular users and emergency services.
