An application will not be considered complete or placed on any meeting agendas until this form is complete and submitted to the City . Minnesota State Statutes Section 394.27 , Subdivision 7 requires that a hardship be demonstrated in order for a variance to be granted. The hardship must be unique to the property as variances run with the land and not the land owner. Personal and economic situations are not considered valid hardships . In order for an application to be heard by the Planning Commiss ion and City Council a hardship having merit must be demonstrated . HOW DO I PROVE A HARDSHIP? This form has 12 points outlining the basis City staff uses to determine if a hardship exists and how the variance will affect the surrounding community. To prove a hardship , address all the relevant points listed below and answer them as clearly as possible. Since you are requesting the code exception, you have the burden of proving that the variance is justified. The information the City receives is what is used in determining a denial or approval recommendation . If you leave something out it will not be considered. Hardship Statement Should you feel the hardship cannot fully be described in the above criteria, describe the unique hardship, practical difficulty or unusual property conditions preventing compliance with Zoning O rdinance requirements in the following lines (attach additional sheets if necessary): ,tee dtl2ch~d hok (7 : c.· City of Orono -Variance Application and Hardship Description 1513 Bay Ridge Road Jeff and Cara Ziebarth January 1 7, 2007 Hardship/Description of Unusual Conditions We are requesting variances for the above mentioned property to include: • Side Yard Setback • Hardcover Existing Conditions The existing lot is approximately 42,000 square feet and roughly 115' wide by 400' long. The existing home does not fall within side yard setbacks within the zoning area and designated at 30'-0". The north-side of the existing home is 11.1 feet from the north property line. The south-side attached shed of the existing home is 5.7 feet from the south property line. All other setbacks of existing hoe are in compliance with setback guidelines The existing hardcover for this property varies in percentage across each zone. O' -75' Zone includes Shoreline Drive/County Road 15 and is 45% hardcover and unchangeable. Hardcover in the 75' -250' Zone is 32.4%. Hardcover in the 250' -500' Zone is 20.3% and includes Bay Ridge Road which is unchangeable. Proposed Changes and Required Variances We are proposing the following changes and additions to 1513 Bay Ridge Road: 1. Side Yard Setback -Removal of existing shed and side yard concrete sidewalk on the south side of existing home. This will increase the setback to the south property line to 8.4 feet and also enhance drainage around the side yard property. 2. Hardcover -Removal of driveway and courtyard paving to reduce overall hardcover in the 75' -250' Zone. We are also proposing smaller decks and reduced retaining wall area. In summary we are reducing hardcover in this zone from 32.4% existing to 26.6% proposed (6% reduction) 3. Proposed re-grading along the north property line to create a swale tying into new retaining wall, creating controlled drainage along the north property area. 4. A new roof structure that will provide addition living space. Roof structure will bear on existing perimeter walls to remain. No variances should be required for this addition since it falls within existing house footprint and height zoning. The existing home will remain one story tall with liveable area within the roof structure. 5. A new 8' x 22' -8" addition on the east side of the home. We are also proposing excavation in this area to allow this to be a walkout condition. This addition falls within the common lakeshore setback line. 6. A new 4' x 23' -6" covered porch area on the east side of the home. This also falls within the common lakeshore setback line. 7. A new 22'-8" x 23 '-6" garage extension. We are proposing this addition maintain the existing south line of the current home. This new addition would be within 8'-5" of the south property line. 8. Type of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this section. Subd. 2. Information required to be given individual. An individual asked to supply private or confidential data concerning himself shall be informed of: (a) the purpose and intended use of the requested data within the collecting state agency, political subdivision, or statewide system; (b) whether he may refuse or is legally required to supply the requested data; (c) any known consequence arising from his supplying or refusing to supply private or confidential data; and (d) the identity of other persons or entities authorized by state or federal law to receive the data. This requirement shall not apply when an individual is asked to supply investigative data, pursuant to section 13.82, subdivision 5, to a law enforcement officer. The commissioner of revenue may place the notice required under this subdivision in the individual income tax or property tax refund instructions instead of on those forms. Subd. 3. Access to data by individual. Upon request to a responsible authority, an individual shall be informed whether he is the subject of stored data on individuals, and whether it is classified as public, private or confidential. Upon his further request, an individual who is the subject of stored private or public data on individuals shall be shown the data without any charge to him and, if he desires, shall be informed of the content and meaning of that data. After an individual has been shown the private data and informed of its meaning, the data need not be disclosed to him for six months thereafter unless a dispute or action pursuant to this section is pending or additional data on the individual has been collected or created . The responsible authority shall provide copies of the private or public data upon request by the individual subject of the data . The responsible authority may require the requesting person to pay the actual costs of making, certifying, and compiling the copies. The responsible authority shall comply immediately, if possible, with any request made pursuant to this subdivision, or within five days of the date of the request, excluding Saturdays, Sundays and legal holidays, if immediate compliance is not possible. If he cannot comply with the request within that time, he shall so inform the individual, and may have an additional five days within which to comply with the request, excluding Saturdays, Sundays and legal holidays. Subd. 4 . Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or private data concerning himself. To exercise this right, an individual shall notify in writing the responsible authority describing the nature of the disagreement. The responsible authority shall within 30 days either: · (a) correct the data found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or incomplete data, including recipients named by the individual; or (b) notify the individual that he believes the data to be correct. Data in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data . The determination of the responsible authority may be appealed pursuant to the provisions of the administrative procedure act relating to contested cases.
