Applicant was present. Planning Commission questioned whether the applicant intended to build on this 1-' ;,perty themselves and they were informed that they d170 not but their intention was to finally clarify wheLher the City deemed this lot buildable for a year-round home. They presently live at the subject property seven months of t'ie year but because of age return to a warm-r climate in the winter. Planning Commission reviewed the need to set a new structure 75' from the lakeshure. The applican questioned that requirement as tine neighboring houses are no more than 35'. Planning Commission stated that for the past five years no new construction has been allowed within the 75' setback. Gregg Hannah moved to recommend approval of the lot area variance finding the hardship of no adjacenL land being available and the existing cabin is connected to sewer, conditioned upon: 1) Any new structure must be constructed without any setback variances. 2) Any new structure must be designed to meet a hardcover limitation of 1,538 s.f. 3) Prior to issuance of building permit, the Shed and existing structure must be removed. Motion seconded by Jabbour. Vote: Ayes (6), Nays (0). Motion passed unanimously. Mr. Nyquist was present. Planning Commission questioned the applicant as to need for expansion on ground level since the majorlty of the addition involved the second story. Mr. Nyquist explained that the family living area was cramped and small and the first floor expansion would "s(piare off" the existing dining and living room area. It was noted at this point that the applicant had made every attempt to live within the setback requirements. MINUTES OF A PLANNING COMMISSION MEETING HELD ON JUNE 25, 1979 PAGE 5 Adams moved to recommend approval of the hardcover variance as requested, but that proposes' accessory steps from the dining area cannot extend past the front line of the existing home (43' setback from the lake). Motion seconded by Hammerel. Vote: Ayes (6), Nays (0). Motion passed unanimously. Robert Mitchell represented the applicant. He advised that the Spring Hill Conference Center will buy the 10-acre parcel including the main house and Lhe caretaker house which are proposed for a "live in" use. Wilson advised that although this is a large lot, metes and bounds division, a surveyor will have to certify the setbacks for the existing structures. Staff will advise Mr. Mitchell if that could be accomplished by a simple certification of existing structures or if each structure must be separately described and located on the survey. Planning Commission advised that the existing septic systems would have to be inspected by staff. Staff was instructed to check on the question of using both structures as "live-in" uses and to determine the timing of notifying the Spring Hill Conference Center of the need for amending the original Conditional Use Permit filed with the City. Planning Commission gave conceptual approval to the proposed metes and bounds subdivision and set a Public Information Meeting for July 23, 1979. Mr. Glenn Cook, City Engineer, presented the City Council with a progress report for the -or-~ruction of the ring route. Mr. Glenn Cook, City Engineer, presented plans from the State of tlinnesota Highway Department regarding proposed changes at the intersection of Highway #12 and Old Crystal Bay Road. Discussion followed concerning the number of lanes that are proposed at the intersection. The consensus was that one right -turn lane, one left -turn lane:, and one through lane each way would be sufficient to handle traffic at that location. The Orono School District will hold a public information rieetinq on August 27, 1979 concerning the proposed project.
