Inspector. The density study showed teat

consisted of two lots and one large parcel
at tine end of the point, the residences
in Baldur Park consisted of oie lot corre-
sponding to the subject lot in size and width.
Discussion was not ;field on what length of
time a variance was good for and w;iether
a ( nditional use permit could be issued
in lieu of a variance. It was brought out
that a residence was a permitted use and
as such, could not be conditioned. it was
noted that the next item on the agenda was
a variance on lot size and widt;i granted in
19bS. Some people bought the property an'
were old to apply for a variance so they
could be issued a building permit.

by sewer, that approval be recommended.

Mr. Veilleux has applied for i lot width and lot
area variance for Lot 16, Block 1 f Baldur Park.
The previous owner, John 1-irsun, received approval
for a similar application in March, 1972. The
site plan, as approved by the Planning Commission,
will require no setback variances.
Planning Commission Minutes - January 14, 1980
Hannah moved, to recommend approval of the variance
request in accordance with site plan submitted
with the condition that the house be moved to
accommodate proposed decK, noting all future:
construction must not encroach lakeshore setback

Mabusth asked the applicant for the proposed hours of
operation? Applicant stated that they would be open
from 6:00 AM to 6:30 or 7:00 PM 7 days a week.
The applicant was asked about other sales that he would
have in the shop. Applicant stated that he would have
the same inventory plus gas and also cigarettes and
soft drinks.
Applicant stated that they had a 4 year lease and that
they could consequently operate a bait shop at two
locations.
Hammerel moved to table Paul Fahlin's application
until the neighbors are notified.

Mabusth stated that the inly response from the neighbors
was that they wanted to ..now if there would be a two
story house. Applicant explained that it would be a
two story basement walkout.
Mabusth explained that staff would take he avetaac

Dr. Posnick seeks a lot area and lot width variance to permit
construction of a new home. At one time a summer residence
bad existed on the site and was removed in December of 1971
because of its unsafe conditions. The lot has 'peen in 5inale
separate ownership for many years - prior to 1Q67. The proposal
would create a residential site consistent with the pattern
of development of surrounding neic•hborhood.
None of the property owners notified attended the action meeting
at the Planning Commission. Ted Boer called my office to
state that a two story structure would impede his view of the
lakeshore to the south of his home (across Baldur Park Road
to the rear of his house - not the lakeshore view to the front).
I advised fir. Boer that is long as the structure does not exceed
the 30' height standard, a two story structure would be allowed.

the additional drainage that would result fror, the new
construction. Staff advised that drainage concerns would be
addressed during the building plan review but that special
considerations would be given to the severe slopes along the
east line of the property that drop within a few feet of his
home.
The applicant has been advised that the proposed deck and
principal structure must meet the average lakeshore setback
of the existing houses on the abuttina lots. Staff would
stake the setback line for both structures. In ad.ition,
Posnick was advised that 5' of additional right of way for
Raldur Park Road would be sought by the City because the
travelled road extends into the southern portion of the lot.

At the Planning Commission meeting of November 16, 1981, the
Planning Commission made the followi.nq recommendation:
To recommend approval of the lot area and lot width variance
of Dr. Steven Posnick based on the followina findings:
1 - Lot 16, Block 1, Raldur Park has been in single
separate ownership prior to 1967.
2 - The proposed building site is consistent with the
pattern of development of the surrounding neiahborhood.
3 - There is no additional land available to combine with
subject property.
4 - There have been no objections from the neighbors as
far as the buildability of the lot.
5 - Lot area and lot width variance applications have been
approved for the property back in 1-30-80 and 3-20-72.
such approval is subject to the following conditions:
1 - Improvements on the site (to include Frtios, dri-ewa}s,
etc.) may not exceed 2,14 sf of hardcover.
2 - No setback variances will be granted to the required
building envelope.
3 - All structures must meet average lakeshore setback
of houses on abutting lots - staff to designate setback
line.
4 - Special consideration be given in location of driveway
and garage in limiting unnecessary hardcover.
5 - Prior to issuance of a building permit, applicant must
furnish the city a quit claim deed, deeding 5' of
additional right of way for Baldur Park Road.
