Existing Von -Conforming Lot and Hou,.e
This district is zoned as follows: Area - 1/2 acre (21,780 sq. ft.), Width - 100
ft., Lake Setback - 75 ft., Side Setback - 10 ft.
Mr. Molde is requesting approval to construct a second story expansion on his
existing residence which is currently non -conforming in lot area width and lake
and side setbacks.
The following variances would be necessary for approval:
Area - approximately 13,000 sq. ft.
Width - 50 ft.
Lake Setback - 13 ft.

This proposal would not increase the existing hardcover area or percentage. The
enclosed survey indicates the location with no increase in house area. The enclosed
sketch for hour expansion indicates the second story only with a 20 ft. height
limit.
I see no prohlem Here, but we might consider applicant's obtaining letter of no
objection from immediate neighbor.

The projected location for disposal of the spoils was the ►,ain
concern of the Commission. Orono has ndopted a policy to deny
previous applications for disposal of spoils within 1,000 ft.
of the shoreline.
After a lengthy discussion, Hassel moved, Hannah seconded, to
table this application with the request that a detailed soils
map and detailed plan for dredging be submitted with the under-
standing that the dredging and spoils deposit will not violate
Ordinance J125, and with the understanding that the Kid -cat
dredging method will operate from the environmental standpoint
as represented. The Planning Commission gives coaceptrialapproval
to going forward Arid getting this date with the understanding
that approval of the projected spoils disposal site would be
determined After careful review of all reports documenting
advantages frr)m project and essurance that project vr)uM not
adversely effect the quality of the water. Proposed disposal
site should be marked.

Mr. Butterfield presented proposal. The survey (Continued)
submitted with the proposal is somevhat vague.
The Commission interpreted the survey to indicate
the existing front yard setback to be 24 ft. The
proposes; five font foyer would reduce this setback
to 19 ft. A variance of 81 ft. would be required.
The Planning Commission recommended approval of
the variances.

Butler moved, Pesek seconded, to approve the variance
request of Loren Butterfield, 3925 Watertown Road,
per the Planning Commission recommendations. Motion,
Ayes (5) - Nays (0).

Administrator, entered into the record the 1428 Baldur Park Road
following information concerning a variance #327

dated October 13, 1977, which states:

Mr. Molde was present. Commission recommended
approval subject to combination of three sub-
standard parcels he now owns (Parcels 8, 17 & 18).
Justifications:
1. Proposal does not increase hardcover.
2. Condition eliminates two substandard lots.
Mr. Molde was informed by Commission that
recommended combination would eliminate second
substandard building site.

Mr. Alan Olson, Assistant Building & Zoning
Administrator, entered into the record the follow-
ing information concerning Tonka West Development,
2477 Shadywood Road, dated October 24, 1977,
which states:
The City Council approved plans subject to County
approval of relocated driveway access, staff
approval of building code requirements and engineer's
review and approval of drainage. Staff to review
assessment requirements for the next meeting.
Staff - October 26, 1977 - Assessment Review
The existing building was built in 19F9 on Tract B,
RLS 88. The sewer was connected in 1969, water
in 1973. Tracts A & B are not combined and are
shown under separate ownership, but are both
included on the site plan of this addition. The
addition will be w-.thin Tract B.
