PROPERTY HISTORY
Registered !and.
Lots 6 b 7 were originally in common ownership by Smith fanily.
The property contained a main house (now Power's residence on lot 6) and the lake
cabin (mostly on lot 7).
Lot 6 was sold in 1946, with access easements over lot 7. Smith continued to use
the cabin for summer use.
Lot 7 was sold in 1959 and a new house constructed (now Tobin residence)
This sale created the landlocked Smith Lakeshore oarcel including walkway easements.
This sale was prior to adoption of the Orono Zoning Code (The area was zoned
"Residential" but no performance standards existed for lot size, etc.)
Thus the cabin has been occupied seasonally since at least 1946, and the lot has
been it's present size and configuration since 1959.
All three are separate tax parcels, the Smith parcel is non -homestead classification.

PROPERTY RESTRICTIONS
The 1959 deed creating the Smith parcel i,,cluded a restriction:
"No structure may be erected with a height greater than the attitude of the surface
of the ground (as previously existinfl) which extends in a Northeasterly direction
from the most Southwesterly pW ion of the embankment uresently located nn said
part of lot 7."

Lot 6 has a 12'X90' deep driveway easement over lot. 7,Smith parcel has a 10' wide X
224' deep easement "for in, egress and driveway rvyi)oses over lot 7.
Smith parcel has an additional 30' wide x 25' long "ea.,event and right of way for
parking of automobiles" along the Dunwoody edge of lot 7.

UTILITIES
The Smith cabin is served with telephone, electricity, anti natural nas.
The Smith cabin receives water from a private well that is now located on Power's
lot 6. The Smith cabin has a located .about 15ft fr-Im thc�l snore.
There is likely little or no drainfield. It is failing by outflow and by backing
up into the cabin when overused.
The Powers and Tobin residences are both served by and connected to City water
and City sewer.
BUILDING
The Smith cabin consists of a walk -out style concrete block basement about 2 ft.
above lake level plus a wood -framed, log -sided main floor. The front entry is at
a level about 112 way down the embankment. The roof is approximately level with
the top of the embankment.
Both levels are finished, but.i.ieiirrr there is no internal stairway between the
floors.
The overall size is about 30ft. X 26ft.; 720 square feet per floor.
The cabin has a livingroom, kitchen, bedroom, and bath on the main floor Dlus
finished living space in the basement.
The cabin is heated with a gas furnace n•
The 1980 tax records list a market value + the structure at $9,380 and the land
at $13,104; total $22,484.
NEIGHBORHOOD
There are several other "screen houses" or boathouses alona the shore in the
vicinity of the Smith cabin. None of the others nav livinv fariiities and none
are occupied.
