Olson, City Planner <br />PROPERTY HISTORY <br />Registered !and. <br />Lots 6 b 7 were originally in common ownership by Smith fanily. <br />The property contained a main house (now Power's residence on lot 6) and the lake <br />cabin (mostly on lot 7). <br />Lot 6 was sold in 1946, with access easements over lot 7. Smith continued to use <br />the cabin for summer use. <br />Lot 7 was sold in 1959 and a new house constructed (now Tobin residence) <br />This sale created the landlocked Smith Lakeshore oarcel including walkway easements. <br />This sale was prior to adoption of the Orono Zoning Code (The area was zoned <br />"Residential" but no performance standards existed for lot size, etc.) <br />Thus the cabin has been occupied seasonally since at least 1946, and the lot has <br />been it's present size and configuration since 1959. <br />All three are separate tax parcels, the Smith parcel is non -homestead classification. <br />PROPERTY SIDE <br />60 ft. wide on Lakeshore <br />73 ft. deep at deepest part <br />Area is apprcximately 4000 sq. ft. =.09 acre. <br />PROPERTY RESTRICTIONS <br />The 1959 deed creating the Smith parcel i,,cluded a restriction: <br />"No structure may be erected with a height greater than the attitude of the surface <br />of the ground (as previously existinfl) which extends in a Northeasterly direction <br />from the most Southwesterly pW ion of the embankment uresently located nn said <br />part of lot 7." <br />r'ASEMENTS <br />Lot 6 has a 12'X90' deep driveway easement over lot. 7,Smith parcel has a 10' wide X <br />224' deep easement "for in, egress and driveway rvyi)oses over lot 7. <br />Smith parcel has an additional 30' wide x 25' long "ea.,event and right of way for <br />parking of automobiles" along the Dunwoody edge of lot 7. <br />Smith parcel has a 10' X MY easement. for Minnenasco service ,ver lot h. <br />UTILITIES <br />The Smith cabin is served with telephone, electricity, anti natural nas. <br />The Smith cabin receives water from a private well that is now located on Power's <br />lot 6. The Smith cabin has a located .about 15ft fr-Im thc�l snore. <br />
