Re: Sewer Connection - 2477 Dunwoody Avenue
Dear Mr. Smith:
We are in receipt of your letter of November 10, 1979. It is the
opinion of the City Engineer, Glenn Cook, that your property can be
served by a grinder pump and section of force main attached to a
gravity sewer line leading across your neighbor's lot. According
to our as -built maps, a sewer stub extends to near your neighbor's
property line. (See attached letter from Engineer and sketch.)
Your statement that you should not be forced to connect to sewer
since it has not been brought to your property is partially correct.
The stub is not at your property line, however, it is as close as
the City can get without obtaining an easement. In our opinion.
you have two choices: 1) you may make the complete installatic.
from your house to the street, obtain an easement from your neighbor
and incur all costs yourself; or 2) upon your refusal to do this,
the City will obtain an easement and install the lateral to your
property line assessing you directly for all costs involved including
materials, labor, legal, engineerinq and administrative costs. In
either case the City will provide you with a pump and tank. From past
experience, the cost to you of having the City bring the lateral to
your lot will undoubtedly be greater than if you have it done yourself.
t suspect that the courts would require the City to extend the lateral
to your property, assess you for it, and you would have to connect to
it immediately when it became available. It has been our intent thus
far to avoid costly legal action if at all possible. However, with
only about 15 properties remaining to be connected out of over 1,400
where sewer is available, we would like to finish *ie connections early
in 1980.
Please let us know as soon as possible as to your plans for connection.
The connection must be made! It is your -choice whether to do it yourself
or to have the City resort to court orders to have it done.
