9. 2003 COMPREHENSIVE ANNUAL FINANCIAL REPORT -KEN MALLOY
Ken Malloy, of the City's auditing firm , presented an overview of the 2003 Comprehensive Annual
Financial Report . He indicated that the audit was completed in June and provides the City with a
tool for reviewing its financial records and testing its compliance with state laws and regulations.
Other than one minor finding, which was the use of public funds for employee recognition, Malloy
complimented the City on its great job of keeping on top of state rules and regulations.

Application Summary: The applicants are requesting the following :
1. An average lakeshore setback variance and a 75 ' -250 ' zone hardcover variance in
order to replace an existing 13 ' x 24 'deck on the lake (east) side of their home ; and
2. A 75 ' -250 ' zone hardcover variance in order to construct a 2-stall garage over
existing hardcover ( driveway) and to construct a covered entrance over existing
hardcover (grade-level porch); and
3. A side setback variance in order to construct a 2-stall garage 10 ' from the side lot line
where a 30' setback is required and a 9 .9' setback is existing.
Planning Commission Recommendation
On August 16 , 2004 , Planning Commission voted 6-0 to recommend approval of the average
lakeshore setback and side setback variances. Additionally, the Planning Commission voted 6 -O
to recommend denial of the hardcover variance and requested the applicant reduce the 75 ' -250 '
zone hardcover to 25% or 4,908 s.f.. The applicant has agreed to reduce the 75' -250' zone
hardcover to be in conformance with the 25% requirement.

WHEREAS, John Charles Holm and Susan Marie Kerber, husband and
wife (hereinafter "the applicants") are the owners of the property located at 1485 Bay
Ridge Road within the City of Orono (hereinafter the "City") and legally described as
follows:
Tracts F and M , Registered Land Survey No. 192 , Subject to
easement for County Road No. 15 , Hennepin County, Minnesota
(hereinafter the "property"); and
WHEREAS, the applicants have made application to the City of Orono
for a variance to Orono Municipal Zoning Code Section 78-305 Subdivision B to allow a
garage addition to be constructed 1 O' from the side lot line where a 30' setback is
normally required ; and
WHEREAS, the applicants have made application to the City of Orono
for a variance to Orono Municipal Zoning Code Section 78-1279 to allow an existing
deck to be reconstructed within the average lakeshore setback ; and
WHEREAS, the applicants have made application to the City of Orono
for a variance to Orono Municipal Zoning Code Section 78-1288 Subdivision B to allow
a garage addition to be constructed and an existing deck to be rebuilt resulting in
hardcover within the 75' -250' setback of 5,448 s.f. or 27% where 26% currently exists
and 25% is normally required.
NOW, THEREFORE BE IT RESOLVED by the City Council of
Orono , Minnesota:
FINDINGS

1. This application was reviewed as Zoning File #04-3043.
2. The property is located in the LR-IA, One Family Lakeshore Residential
Zoning District which requires a minimum lot area of 2 acres and a
minimum lot width of200'.
3. The Planning Commission reviewed this application at a public hearing
held on August 16, 2004 and recommended approval of side setback and
average setback variances but denial of the hardcover variance based on
the following findings:
a. The property 33 ,300 s.f. or 0.76 acre in area and has 112' -104' in
width.
b. No additional land is available for acquisition by the applicants to
make the property conforming in area or width.
c. The property is served with municipal sewer.
d. The property is similar in size to many of the existing developed lots
in this neighborhood.
e. The average setback variance will have no impact on lake views
enjoyed by the neighboring property owners.
f. The side setback variance will allow construction of an attached
garage at a 10' setback where a 9.9'setback currently and will have no
negative impacts on the open space or character of the neighborhood.
g. The applicant's request for a hardcover variance in order to increase
the hardcover within the 75' of the OHWL should be denied as there is
no hardship to support the variance.
h. The applicant has indicated an ability and willingness to reduce
hardcover in the 75 ' -250' zone down to the 25% allowed level.
4. The City Council has considered this application including the findings
and recommendation of the Planning Commission, reports by City staff,

comments by the applicants and the public , and the effect of the proposed
variance on the health , safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are
peculiar to it and do not apply generally to other property in this zoning
district ; that granting the variance would not adversely affect traffic
conditions , light , air nor pose a fire hazard or other danger to neighboring
property; would not merely serve as a convenience to the applicants, but is
necessary to alleviate a demonstrable hardship or difficulty; is necessary to
preserve a substantial property right of the applicants ; and would be in
keeping with the spirit and intent of the Zoning Code and Comprehensive
Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings , the Orono City Council hereby
grants a variance to Orono Municipal Zoning Code Section 78-305 Subdivision B to
allow a side setback of 10' where 30' is normally required for the construction of a new
attached garage and a variance to Orono Municipal Zoning Code Section 78-1279
Subdivision 6 to allow an existing deck to be reconstructed within the average lakeshore
setback, and denies a variance to Municipal Zoning Code Section 78-1288 for hardcover
in excess of the allowed 25% in the 75' -250 ' zone subject to the following conditions:
1. Council approval is based on the site plan submitted by the applicants and
annotated by City staff, attached to this Resolution as Exhibit A. Any
amendments to the site plan which are not in conformity with City codes will
require further Planning Commission and City Council review.
2. Hardcover in the 0-75' zone shall not increase above the level of 59% 4,280 s.f.
(C .S.A.H. 15). Hardcover in the 75-250' zone shall be limited to 4 ,908.5 s.f. or
25% per the proposed plan and hardcover allowance summary as depicted on
Exhibit A. Applicants are advised that any future requests to increase hardcover
or change the nature of existing/approved hardcover shall require City approval ,
and increases in hardcover will not likely be approved without concurrent
reduction in existing hardcover.
3. Applicants shall remove all plastic or fabric liner material from the decorative
landscape beds on the property to ensure their permeability as non-hardcover
surfaces .

4. Required remo v als of structure and hardcover shall be completed by the footing
inspection.
5. Authorities granted by this resolution run with the property not with the
applicants , but are permissive only and must be exercised by obtaining a building
permit for the new construction within one year of the date of Council approval ,
or the variance will expire on that date (August 23 , 2005).
6. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a misdemeanor.
7. The undersigned applicants have read, understood and hereby agree to the terms
of this resolution and on behalf of the applicants and the applicants ' heirs ,
successors and assigns , hereby agree to the recording of this resolution in the
chain of title of the property .

Rahn inquired whether a double car garage was being constructed .
Holzem stated it is a single car garage with a double-wide driveway to give visitors room to park.
Holzem indicated the old survey was submitted to the City prior to her approval and has been
revised to a single car garage and a double-wide driveway.
Curtis inquired what the distance is from the roadway to the property line for this neighborhood .
Gaffron stated to his recollection the residence located down the street is located 13 feet from the lot
line and another six or eight feet to the actual pavement of the road. Gaffron stated a 15-foot setback
would give you approximately 20 feet from the garage door to the actual traveled road.
Bremer moved, Leslie seconded, to recommend approval of Application #04-3041, lot area and
lot width variances, a creek setback variance, a rear street setback, side setback variances,
a hardcover variance within the 0-75' setback zone, and a hardcover variance within the
75'-250' zone in order to construct a new 864 square foot single-family residence at the property
located at 3407 Eastlake Street. VOTE: Ayes 6, Nays 0 .

John Holm, Applicant, was present.
Curtis stated the applicants have applied for an average lakeshore setback variance and a
75 '-250' zone hardcover variance in order to replace an existing 13' by 24' deck on the east side of
their home . In addition, a 75' -250' zone hardcover variance and a side setback variance are needed
in order to construct a two-stall garage over existing hardcover. Curtis indicated the applicants are
also applying for a 75' -250' hardcover variance in order to construct a covered entrance over
existing hardcover .
Staff is recommending approval of the variances with the condition that the hardcover within the
75' -250' zone shall not increase above the existing level of 26 percent or 5056 square feet.
Holm indicated he has nothing to add to Staffs report.
There were no public comments regarding this application.
Rahn stated he does not have a problem with this application , noting the applicants are removing
existing driveway hardcover in order to construct a garage and there is no further encroachment into
the side yard setback.
Jurgens inquired whether the patio depicted on the plan would be constructed.

Holm indicated their architect drew in the patio but there would not be any changes to the existing
pa tio.
Jurgens inquired whether it was possible to reduce the hardcover by 1 percent in the 75 ' -250' zone
to reach 25 percent.
Curtis stated the proposed sidewalk indicated on the plan is no longer proposed, which would reduce
the hardcover.
Holm explained there are a few options to reduce the hardcover, such as reducing the sidewalk,
moving the turnaround off to the right, or reducing the size of the garage. Holm indicated he is not
opposed to reduc ing it to 25 percent.
Rahn suggested the applicant decide which option he would like to do.
Jurgens questioned whether the 75' -250' hardcover variance would still be required in order to
construct a covered entrance if the applicant reduces the hardcover elsewhere.
Curtis stated the applicant would still need a hardcover variance unless the Planning Commission
is requiring the applicant to reduce the hardcover to 25 percent.
Jurgens cmmnented if the applicant is required to reduce the hardcover to 25 percent, then that would
eliminate the two hardcover variances in the 7 5' -250 ' zones.
Bremer inquired whether the applicant understood what the Planning Commission was recommending.
Kempf stated the applicant has the option of adding the sidewalk if he reduces the driveway.
Holm stated he would like some turnaround .
Jurgens noted approximately 150 square feet wou ld need to be removed .
Gundlach stated one percent is approximately 14 7 .5 square feet.
Jurgens moved, Kempf seconded, to recommend approval of Application #04-3043,
approval of an average lakeshore setback variance and a 75' -250' zone hardcover
variance in order to replace an existing 13' by 24' deck on the east side of their home,
and a side setback variance in order to construct a two-stall garage 10 feet from the side lot line
where a 30 foot setback is required and a 9.9 foot setback is existing, for the property located at
1485 Bay Ridge Road. VOTE: Ayes 6, Nays 0.

Sec . 78-1279. Placement of structures on lots .
(6) Average lakeshore setback. No principal or accessory structure shall be located
closer to the lakeshore than the average distance from the shoreline of existing residence
buildings on adjacent lots; except that this does not apply to stairways, lifts , landings and
lockboxes . Further, the average lakeshore setback shall apply only to classified lakes and
shall not apply to tributaries. The average lakeshore setback line shall be a straight line
connecting the most lakeward protrusions of the residence buildings on the immediately
adjacent lakeshore lots.
Sec. 78-1288. Hard cover limitations.
(a) No hard cover or impervious surface shall be placed, located or
constructed within 75 feet of the ordinary high water level of any lake or tributary, except
for stairways, lifts, landings and lockboxes as regulated elsewhere in this Code .
(b) Between 75 feet and 250 feet of the OHWL, there shall be no greater than
25 percent hard cover. Between 250 feet and 500 feet of the OHWL there shall be no
greater than 30 percent hardcover. Between 500 feet and 1,000 feet of the OHWL there
shall be no greater than 3 5 percent hardcover.

John Holm & Susan Kerber are the property owners and applicants at 1485 Bay Ridge
Road. The applicants wish to replace in-kind a rotted deck on the east side of their home,
add a covered entry on the west entrance and construct a 660 s.f. garage addition to their
existing home. Their home currently encroaches into the 30' side setback on both of the
side lot lines, and in order to construct the garage addition a side setback variance is
required. Their 380' x 104' property is located within the LR-IA Zoning District.

Side Yard Setback Variance
The north side of the home is currentl y located as close as 9 .9 ' from the side lot line
tapering to 12' at its most conforming corner. The applicants are proposing to construct
their attached garage (including the roof overhang) no closer to the side lot line than 1 O'.
Hardcover Variance
The garage is proposed to be constructed over existing driveway hardcover , and the deck
will not increase in size as it is proposed to be reconstructed in-kind . The property
currently has 26 % or 5,056 s .f. of hardcover within the 75 ' -250 ' setback zone ; the
applicants are proposing a net increase of 1.9% or 392 s.f.. The increase in 75' -250 '
hardcover could easil y be eliminated by reconstructing the driveway parking area so that
more ofit is in the 250'-500' zone.

Half of the existing home , including the subject deck , is located within the average
lakeshore setback. The shoreline runs at an angle to the properties along this portion of
CSAH 15 and the neighboring homes are staggered such that the property to the south of
the applicants ' is entirely behind the applicants' home . The proposed deck is completely
blocked from view of the property owner to the south by the applicants' home.
Hardship Statement
Applicant has completed the Hardship Documentation Form attached as Exhibit B , and
should be asked for additional testimony regarding the application .
Hardship Analysis
In considering applications for variance, the Planning Commission shall consider the effect of the
proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic
conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in
the surrounding area. The Planning Commission shall consider recommending approval for variances
from the literal provisions of the Zoning Code in instances where their strict enforcement would cause
undue hardship because of circumstances unique to the individual property under consideration, and
shall recommend approval only when it is demonstrated that such actions will be in keeping with the
spirit and intent of the Orono Zoning Code.
Staff finds that with respect to the average lakeshore setback variance the angle of CSAH
15 and the staggering of the homes along the lake , the reconstruction of the existing deck
will have minimal impact on the lake views from the neighboring properties. Also, due
to the location of the existing home and the narrowness of the lot there is hardship for the
side setback variance as if the garage were required to meet the 30' setbacks on both
sides it would have to be constructed directly in the middle of the existing home blocking
an existing porch and the main entry .
However, staff does not find that a hardship exists for which to grant the hardcover
variance and the applicant should be required to relocate the driveway parking area
hardcover so as not to exceed the current 75'-250' hardcover level.

Staff Recommendation
Planning Staff recommends approval of the average lakeshore setback and side setback
variances, and denial of the hardcover variance request. The applicants' should be
required to not exceed their existing level of hardcover within the 75'-250' setback zone.

HARDSHIP DOCUMENTATION FORM
This form is a required submittal for ALL variance applications. An application
will not be considered complete or placed on any meeting agendas until this form is
complete and submitted to the City.
Minnesota State Statue Section 394 .27, Subdivision 7 requires that a hardsh ip be
demonstrated in order for a variance to be granted . The hardship must be unique to the
property as variances run with the land and not the land owner. Personal and economic
situations are not considered valid hardships. In order for an application to be heard by
the Planning Commission and City Council a hardship having merit must be
demonstrated .
HOW DO I PROVE A HARDSHIP?
This form has 12 points outlining the basis City staff uses to determine if a hardship
exists and how the variance will affect the surrounding community . To prove a hardship ,
address all the relevant points listed below and answer them as clearly as possible .
Since you are requesting the code exception, you have the burden of proving that the
variance is justified. The information the City receives is what is used in determining a
denial or approval recommendation. If you leave something out it will not be considered.

HARDSHIP DOCUMENTATION FORM
This form is a required submittal for ALL variance applications. An application
will not be considered complete or placed on any meet ing agendas until this form is
complete and submitted to the City.
Minnesota State Statue Section 394 .27, Subdivision 7 requires that a hardship be
demonstrated in order for a variance to be granted. The hardship must be unique to the
property as variances run with the land and not the land owner. Personal and economic
situations are not considered valid hardships. In order for an application to be heard by
the Planning Commission and City Council a hardship having merit must be
demonstrated .
HOW DO I PROVE A HARDSHIP?
This form has 12 points outlining the basis City staff uses to determine if a hardship
exists and how the variance will affect the surrounding community. To prove a hardship,
address all the relevant points listed below and answer them as clearly as possible .
Since you are requesting the code exception, you have the burden of proving that the
variance is justified. The information the City receives is what is used in determining a
denial or approval recommendation . If you leave someth ing out it will not be considered .

In accordance with M .S. 13.04, Subd. 2, "Rights of subjects of data", we would like to inform you "
that your request for a permit or license from the City of Orono or any of its departments may
require you to furnish certain private or confidential information .
You are notified that:
1. The information you furnish will be used to determine your qualification for the permit or
license requested.
2 . You may refuse to supply data, but refusal may require that the City deny the permit or
license .
3. The information may be shared with other local, state or federal agencies to the extent
necessary to process the permit or license.
4 . If your requested permit or license requires Council action to approve, some information
may become public.
5. You have certain rights under M.S. 13 .04 (see following page) to review private data on
yourself.
6. Your full name is required to process this application or permit.

Sec .13.04 RIGHTS OF SUBJECTS OF DATA
Subdivision 1. Type of data. The rights of individual on whom the data is stored or to
be stored shall be as set forth in this section . ·
Subd. 2 . Information required to be given individual. An individual asked to supply
private or confidentia l data concerning himself shall be informed of: (a) the purpose and
intended use of the requested data within the collecting state agency, political subdivision, or
statewide system; (b) whether he may refuse or is legally required to supply the requested data ;
(c) any known consequence arising from his supplying or refusing to supply private or
confidential data ; and (d) the identity of other persons or entities authorized by state or federal
law to receive the data . This requirement shall not apply when an individual is asked to supply
investigative data, pursuant to section 13.82 , subdivision 5, to a law enforcement officer.
The commissioner of revenue may place the notice required under this subdivision in the
individual income tax or property tax refund instructions instead of on those forms .
Subd . 3. Access to data by individual. Upon request to a responsible authority , an
ind ividual shall be informed whether he is the subject of stored data on individuals , and whether
it is classified as public, private or confidential. Upon his further request, an individual who is
the subject of stored private or public data on individuals shall be shown the data without any
charge to him and, if he desires, shall be informed of the content and meaning of that data .
After an individual has been shown the private data and informed of its meaning, the data need
not be disclosed to him for six months thereafter unless a dispute or action pursuant to this
section is pending or additional data on the individual has been collected or created . The
responsible authority shall provide copies of the private or public data upon request by the
individual subject of the data. The responsible authority may require the requesting person to
pay the actual costs of making , certifying , and compiling the copies .
The responsible authority shall comply immediately , if possible , with any request made
pursuant to this subdivision, or within five days of the date of the request, exclud ing Saturdays ,
Sundays and legal holidays , if immediate compliance is not possible . If he cannot comply with
the request within that time, he shall so inform the individual, and may have an additional five
days within which to comply with the request , excluding Saturdays , Sundays and legal holidays .
Subd . 4 . Procedure when data is not accurate or complete. An individual may
contest the accuracy or completeness of public or private data concerning himself. To exercise
this right, an individual shall notify in writing the responsible authority describing the nature of
the disagreement. The responsible authority shall within 30 days either: (a) correct the data
found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or
incomplete data , including recipients named by the individual ; or (b) notify the individual that he
believes the data to be correct. Data in dispute shall be disclosed only if the individual 's
statement of disagreement is included with the disclosed data.
The determination of the responsible authority may be appealed pursuant to the provisions of
the administrative procedure act relating to contested cases .
