A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZONING CODE
SECTIONS 78-305 & 78-1288
FILE NO. 06-3216
WHEREAS, John C. Holm and Susan M. Kerber, husband and wife (hereinafter
"the applicants") are the owners of the property located at 1485 Bay Ridge Road within the City
of Orono (hereinafter the "City") and legally described as follows:
Tracts F and M, Registered Land Survey No 192, Hennepin County, Minnesota
(hereinafter the "property"); and
WHEREAS, the applicants have made application to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-305 to allow a side setback of 1 O' where
30' is normally required and 9.9' is currently existing in order to construct an attached garage;
and
WHEREAS, the applicants have made application to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-1288 to allow 59% (4,280 s.f.) hardcover
within the 0-75' zone where 0% is normally allowed and 59% currently exists; and 25%
hardcover within the 75' -250' zone where 26% currently exists and 25% is normally allowed in
order to constrnct a covered entry and attached garage.
NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File 06-3216.
2 . The property is located in the LR -lA Lakeshore Residential Zoning District
which requires a minimum lot area of 2.0 acres and a minimum lot width of 200'.
3. The Planning Commission reviewed this application at a public hearing held on
August 21 , 2006 and recommended approval of variances based on the following
findings:

a. The property is 33,300 s.f. or 0.76 acre in area and has 112' -104' in width.
b. The lot is substandard in area and a residence has existed on the property for
many years. No additional land is available for acquisition by the applicants to
make the property conforming in area or width.
c. The property is served with municipal sewer and is similar in size to many of
the existing developed lots in this neighborhood.
d . The side setback variance will allow construction of an attached garage at a
10' setback where a 9.9'setback currently exists and will have no negaiive
impacts on the open space or character of the neighborhood.
g. The applicant has indicated an ability and willingness to reduce hardcover in
the 75' -250' zone down to the conforming 25% level.
h. The same variances requested now were approved by the City via Resolution
No. 5223 in 2004, but the applicants were not able to complete all the
elements of the approved project prior to variance expiration.
4. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments by
the applicants and the public, and the effect of the proposed variance on the
health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variance would not adversely affect traffic conditions, light, air nor pose a fire
hazard or other danger to neighboring property; would not merely serve as a
convenience to the applicants, but is necessary to alleviate a demonstrable
hardship or difficulty; is necessary to preserve a substantial property right of the
applicants; and would be in keeping with the spirit and intent of the Zoning Code
and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants a
variance to Orono Municipal Zoning Code Section 78-305 to allow a side setback of 10 ' where
30' is normally required and 9 .9' is currently existing and Section 78-1288 to allow 59% (4,280

s.f.) hardcover within the 0-75' zone where 0% is normally allowed and 59% currently exists;
and 25% hardcover within the 75'-250' zone where 26% currently exists and 25% is normally
allowed in order to construct a covered entry and attached garage.
1. Council approval is based on the building plans and site plan submitted by the applicants
and annotated by City staff, attached to this Resolution as Exhibits A & B. Any
amendments to the building plans and site plan which are not in conformity with City
codes will require further Planning Commission and City Council review .
2. Hardcover in the 0-75' zone shall not increase above the level of 59% or 4,280 s.f.
(C.S.A.H. 15). Hardcover in the 75-250' zone shall be limited to 4,908 .5 s.f. or 25% per
the proposed plan and hardcover allowance summary as depicted on Exhibit A.
Applicants are advised that any future requests to increase hardcover or change the nature
of existing/approved hardcover shall require City approval, and increases in hardcover
will not likely be approved without concurrent reduction in existing hardcover.
3. Applicants shall comply with all of the City Engineer's recommendations and an
approved grading plan must be submitted prior to issuance of a building permit.
4. Applicants shall remove all plastic or fabric liner material from the decorative landscape
beds on the property to ensure their penneability as non-hardcover surfaces.
5 . Required removals of structure and hardcover to be removed shall be completed prior to
the footing inspection for the garage and/or the new entry.
6 . Authorities granted by this resolution run with the property not with the applicants, but
are permissive only and must be exercised by obtaining a building permit for the new
construction within one year of the dale of Council approval, or the vmiance will expire
on that date (May 29, 2008).
7. Violation of or non-compliance with any of the terms and conditions of this resolution
shall constitute a violation of the zoning code, shall automatically terminate any authority
granted herein , and shall be punishable as a misdemeanor.
8. The undersigned applicants have read, understand and hereby agree to the terms of this
resolution and on behalf of the applicants and the applicants' heirs, successors and
assigns, hereb y agree to the recording of this resolution in the chain of title of the

7:00 o 'clock p.m.
Dave Runkle , 2684 Casco Point, addressed the City Council regarding the demolition of a house in their
neighborhood approximately one year ago and the removal of a number of trees along with the
demolition. Runkle stated there remains a deep hole where the house once stood and that it really should
be filled in .
White stated he has also observed that problem and concurred that it should be filled in. White noted the
area is not fenced off either.
Mattick noted the City can use a statutory process for requiring the hole to be filled in and that a
hazardous building action similar to Item No. 16 on tonight's agenda can be prepared for the next council
meeting.

Todd and Michelle Schaible, Applicants, were present.
Turner stated the applicants are requesting variances to allow construction of an addition to the street side
of their residence. The applicants are requesting a hardcover variance in the 0-75-foot zone to allow 12
percent hardcover and a hardcover var iance in the 75-250-foot zone to allow 39 percent hardcover . In
addition, an average lakeshore setback variance is required to place the addition closer to the lake than the
average lakeshore setback.
Turner illustrated on the overhead the average lakeshore setback line and the location of the existing
house. The entire house is forward of the average lakeshore setback. The house was constructed prior to
the adoption of the average lakeshore setback ordinance . The proposed house on the lot to the north does
not change this. The house to the south is unusually far from the lake because of the topography of that
Jot. It is also about 14 feet higher than the applicants' house and separated by a band of trees. There are
also trees along the north property line.
Staff noted there is a minor increase of 31 square feet hardcover in the 75-250 foot zone. Of the 691
square foot area that would be covered by the addition, 4 72 square feet is sidewalk. The paver walkway
in front of the house consisting of 108 square feet and 80 square feet of the driveway would be removed.
The applicants have indicated that the retaining wall would be difficult to remove due to the substantial
slope but they are proposing to remove a portion of the driveway and the paver walkway.
Planning Staff recommends approval of the average l akeshore setback variance and approval of a
modified 0-75-foot hardcover variance.
Bremer commented one of the roles of the Planning Commiss ion is to look at the property as a whole and
to recommend ar eas where hardcover can be removed wherever possible. Bremer inquired wh ether the
applicants had anything to add to Staffs report.
Mr. Schaible indicated he does not.
Bremer opened the public hearing at 6 : 11 p.m.

Bremer closed the public hearing at 6: 11 p .m.
Rahn stated the on ly concern he has is wi th the amount of hardcover proposed for the driveway, and
recommended that the driveway near the garage doors be reduced.

Application Summary:
John Holm & Susan Kerber received variances in 2004 in order to replace a rotted deck on the east (lake)
side of their home, add a covered entry porch on the west entrance and construct a 660 s .f. garage addition
to their existing home. Their home encroaches into the 30' side setback on both of the side lot lines , and in
order to construct the garage addition as proposed a side setback variance is requested. They have
constructed the deck but prior to obtaining permits for the garage and porch additions the variance approval
resolution expired . The applicants have applied for the following renewal variances:
1. A 75' -250 ' zone hardcover variance in order to construct a 2-stall garage over existing hardcover
(driveway); and
2. A side setback variance in order to construct a 2-stall garage IO ' from the side lot line where a 30 '
setback is required and a 9 .9' setback is existing; and
3. A 75' -250' hardcover variance to construct a covered entrance over existing hardcover (grade-
level porch).
Planning Commission Recommendation
On August 21, 2006 , Planning Commission voted 4-0 to recommend approval of the variances .
Planning Staff Recommendation
Staff has been awaiting revised plans meeting the City Engineer's recommendations. At this time staff is
satisfied that the engineering issues can be addressed and has drafted language into the Resolution
requiring revised plans be submitted prior to issuance of a building permit. Therefore staff recommends
approval of the variances per the attached Resolution .

recommendation of the Planning Commission, reports by City staff, comments by
the applicants and the public, and the effect of the proposed variance on the
health, safety and weJfare of the community.
5 . The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variance would not adversely affect traffic conditions , light , air nor pose a fire
hazard or other danger to neighboring property; would not merely serve as a
convenience to the applicants , but is necessary to alleviate a demonstrable
hardship or difficulty; is necessary to preserve a substantial property right of the
applicants; and would be in keeping with the spirit and intent of the Zoning Code
and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings , the Orono City Council hereby grants a
variance to Orono Municipal Zoning Code Section 78-305 to allow a side setback of 1 O' where
30 'is normally required and 9 .9' is currently existing and Section 78-1288 to allow 59 % (4 ,280

s.f.) hardcover within the 0-75' zone where 0% is normally allowed and 59% currently exists;
and 25% hardcover within the 75' -250' zone where 26% currently exists and 25% is normally
allowed in order to construct a covered entry and attached garage.
1. Council approval is based on the building plans and site plan submitted by the applicants
and annotated by City staff, attached to this Resolution as Exhibits A & B. Any
amendments to the building plans and site plan which are not in conformity with City
codes will require further Planning Commission and City Council review.
2. Hardcover in the 0-75' zone shall not increase above the level of 59% 4,280 s.f.
(C.S.A.H. 15). Hardcover in the 75-250' zone shall be limited to 4 ,908.5 s.f. or 25% per
the proposed plan and hardcover allowance summary as depicted on Exhibit A.
Applicants are advised that any future requests to increase hardcover or change the nature
of existing/approved hardcover shall require City approval , and increases in hardcover
will not likely be approved without concurrent reduction in existing hardcover.
3. Applicants shall comply with all of the City Engineer's recommendations and an
approved grading plan must be submitted prior to issuance of a building permit.
4. Applicants shall remove all plastic or fabric liner material from the decorative landscape
beds on the property to ensure their permeability as non-hardcover surfaces.
5. Required removals of structure and hardcover to be removed shall be completed prior to
the footing inspection for the garage and/or the new entry.
6. Authorities granted by this resolution run with the property not with the applicants, but
are permissive only and must be exercised by obtaining a building permit for the new
construction within one year of the date of Council approval, or the variance will expire
on that date (May 29, 2008).
7. Violation of or non-compliance with any of the terms and conditions of this resolution
shall constitute a violation of the zoning code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.
8. The undersigned applicants have read, understand and hereby agree to the terms of this
resolution and on behalf of the applicants and the applicants' heirs, successors and
assigns, hereby agree to the recording of this resolution in the chain of title of the
property.

John Holm & Susan Kerber received variances in 2004 in order to replace a rotted deck
on the east (lake) side of their home, add a covered entry on the west entrance and
construct a 660 s.f. garage addition to their existing home. Their home encroaches into
the 30' side setback on both of the side lot lines, and in order to construct the garage
addition as proposed a side setback variance is requested. They have constructed the
deck but prior to obtaining permits for the garage and porch additions the variance

The north side of the home is currently located as close as 9.9' from the side lot line and
tapers 12' at its most conforming corner. The applicants are proposing to construct their
attached garage (including the roof overhang) no closer to the side lot line than 1 O'.
Hardcover Variance
The applicants are proposing to construct an attached garage and covered porch entry
which are both proposed to be constructed over existing non-structural hardcover. The
property currently has 26% or 5,156 s.f. of hardcover within the 75'-250' setback zone;
the applicants are proposing to relocate the parking area of their driveway into the 250' -
500' zone to eliminate the need for a hardcover variance within the 75' -250' zone.
Hardship Statement
If the Planning Commission desires the applicants should be asked for hardship testimony
regarding the application.
Hardship Analysis
In considering applications for variance, the Planning Commission shall consider the effect of the
proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic
conditions, light and air, danger of fire, risk to the public safety, and the effect 011 values of property in
the surrounding area. The Planning Commission shall consider recommending approval for variances
from the literal provisions of the Zoning Code in instances where their strict enforcement would cause
undue hardship because of circumstances unique to the individual property under consideration, and
shall recommend approval only when it is demonstrated that such actions will be in keeping with the
spirit and intent of the Orono Zoning Code.
Staff finds that regarding the location of the existing home and the narrowness of the lot
there is hardship for the side setback variance. If the garage were required to meet the
30' setbacks on both sides it would have to be constructed directly in the middle of the
existing home blocking an existing porch and the main entry.

Staff Recommendation
Planning Staff recommends approval of the side setback variance to construct the
attached garage. The applicants' should not exceed their 25% hardcover within the 75'-
250' setback zone. The applicants will also be required to comply with all of the

Sec.13.04 RIGHTS OF SUBJECTS OF DATA
Subdivision 1. Type of data. The rights of individual on whom the data is stored or to
be stored shall be as set forth in this section.
Subd. 2. Information required to be given individual. An individual asked to supply
private or confidential data concerning himself shall be informed of: (a) the purpose and
intended use of the requested data within the collecting state agency, political subdivision, or
statewide system; (b) whether he may refuse or is legally required to supply the requested data;
(c) any known consequence arising from his supplying or refusing to supply private or
confidential data; and (d) the identity of other persons or entities authorized by state or federal
law to receive the data. This requirement shall not apply when an individual is asked to supply
investigative data, pursuant to section 13.82, subdivision 5, to a law enforcement officer.
The commissioner of revenue may place the notice required under this subdivision in the
individual income tax or property tax refund instructions instead of on those forms.
Subd. 3. Access to data by individual. Upon request to a responsible authority, an
individual shall be informed whether he is the subject of stored data on individuals, and whether
it is classified as public, private or confidential. Upon his further request, an individual who is

the disagreement. The responsible authority shall within 30 days either: (a) correct the data
found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or
incomplete data, including recipients named by the individua l; or (b) notify the individual that he
believes the data to be correct. Data in dispute shall be disclosed only if the individual's
statement of disagreement is included with the disclosed data.
The determination of the responsible authority may be appealed pursuant to the provisions of
the administrative procedure act relating to contested cases.

WHEREAS, Jolm Charles Holm and Susan Marie Kerber, husband and
wife (hereinafter "the applicants") are the owners of the property located at 1485 Bay
Ridge Road within the City of Orono (hereinafter the "City") and legally desc1ibed as
follows:
Tracts F and M, Registered Land Survey No. 192, Subject to
easement for County Road No. 15, He1mepin County, Minnesota
(hereinafter the "property"); and
WHEREAS, the applicants have made application to the City of Orono
for a variance to Orono Municipal Zoning Code Section 78-305 Subdivision B to allow a
garage addition to be constructed 1 O' from the side lot line where a 30' setback is
nomrnlly required; and
WHEREAS, the applicants have made application to the City of Orono
for a variance to Orono Municipal Zoning Code Section 78-1279 to allow an existing
deck to be reconstructed within the average lakeshore setback; and
WHEREAS, the applicants have made application to the City of Orono
for a vaiiance to Orono Municipal Zoning Code Section 78-1288 Subdivision B to allow
a garage addition to be constrncted and an existing deck to be rebuilt resulting in
hardcover within the 75' -250' setback of 5,448 s.f. or 27% where 26% currently exists
and 25% is nomially required .
NffW, THEREFORE BE IT RESOLVED by the City Council of
Orono, Minnesota:

FINDINGS
1. This application was reviewed as Zoning File #04-3043.
2. The property is located in the LR-lA, One Family Lakeshore Residential
Zoning District which requires a minimum lot area of 2 acres and a
minimum lot width of 200'.
3 . The Pla1ming Commission reviewed this application at a public hearing
held on August 16, 2004 and recommended approval of side setback and
average setback variances but denial of the hardcover variance based on
the following findings:
a. The property is 33,300 s.f. or 0.76 acre in area and has 112' -104' in
width.
b. No additional land is available for acquisition by the applicants to
make the property confom1ing in area or width.
c. The property is served with municipal sewer.
d. The property is similar in size to many of the existing developed lots
in this neighborhood.
e. The average setback variance will have no impact on lake views
enjoyed by the neighboring property owners.
f. The side setback variance will allow construction of an . attached
garage at a 10' setback where a 9 .9'setback currently exists and will
have no negative impacts on the open space or character of the
neighborhood.
g. The applicants' request for a hardcover variance in order to increase
the hardcover within 7 5' of the OHWL should be denied as there is no
hardship to support the variance .
h. The applicants have indicated an ability and willingness to reduce
hardcover in the 75' -250' zone down to the 25% allowed level.

4. The City Council has considered this application including the findings
and recommendation of the Planning Commission, repo1is by City staff,
comments by the applicants and the public, and the effect of the proposed
variance on the health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are
peculiar to it and do not apply generally to other prope1iy in this zoning
district ; that granting the variance would not adversely affect traffic
conditions, light, air nor pose a fire hazard or other danger to neighboring
property; would not merely serve as a convenience to the applicants, but is
necessary to alleviate a demonstrable hardship or difficulty; is necessary to
preserve a substantial propeliy right of the applicants; and would be in
keeping with the spirit and intent of the Zoning Code and Comprehensive
Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
grants a variance to Orono Municipal Zoning Code Section 78-305 Subdivision B to
allow a side setback of 10' where 30' is nonnally required for the construction of a new
attached garage and a variance to Orono Municipal Zoning Code Section 78-1279
Subdivision 6 to allow an existing deck to be reconstructed within the average lakeshore
setback , and denies a variance to Municipal Zoning Code Section 78-1288 for hardcover
in excess of the allowed 25% in the 75' -250' zone subject to the following conditions:
1. Council approval is based on the site plan submitted by the applicants and
annotated by City staff, attached to this Resolution as Exhibit A. Any
amendments to the site plan which are not in confom1ity with City codes will
require further Planning Commission and City Council review .
2 . Hardcover in the 0-75 ' zone shall not increase above the level of 59% or 4,280 s.f.
(C.S.A.H. 15). Hardcover in the 75-250' zone shall be limited to 4,908.5 s.f. or
25 % per the proposed plan and hardcover allowance summary as depicted on
Exhibit A Applicants are advised that any future requests to increase hardcover
or change the nature of existing/approved hardco v er shall require City approval,
and increases in hardcover will not likely be approved without concurrent
reduction in existing hardcover.

3. Applicants shall remove all plastic or fabric liner material from the decorative
landscape beds on the property to ensure their pem1eability as non-hardcover
surfaces.
4. Required removals of structure and hardcover shall be completed by the footing
inspection.
5. Authorities granted by this resolution run with the property not with the
applicants, but are pennissive only and must be exercised by obtaining a building
permit for the new construction within one year of the date of Council approval,
or the variance will expire on that date (August 23 , 2005).
6. Violation of or non-compliance with any of the te1111s and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
tenninate any authority granted herein, and shall be punishable as a misdemeanor.
7. The undersigned applicants have read, understood and hereby agree to the tenns
of this resolution and on behalf of the applicants and the applicants' heirs ,
successors and assigns, hereby agree to the recording of this resolution in the
chain of title of the property.

We have reviewed the revised survey for the proposed garage construction and associated grading at 14 85
Bayridge Road dated 8-14-06. We have the following comments with regards to engineering matters:
• Existing contours should be shown in all areas where grading will occur. Specifically, contours
should be provided to the south and west of the proposed garage, including the driveway . In
addition, proposed contours should be provided in all areas to be disturbed, including the
proposed turnaround area adjacent to the driveway.
• A swale should be graded to the north of the proposed garage in order to maintain drainage on the
subject property.
• The proposed grading to the northeas t of the existing house exceeds the maximum allowable 3 : 1
slope. The grading should be re vi sed to show slopes of less than 3: 1.
