Mayor Jabbour stated an article will be appearing in the Sun Sailor regarding the Dakota Line , which
contains some inaccurate i nformat ion . Jabbour stated in order to respond to the article , he will be

interviewed by the Sun Sailor on Wednesday .
Mayor Jabbour recommended that during the process of selecting a new police chief, the City invite
the Hennepin County Sheriff to sit in on the process in order to gain his input.
Moorse indicated there will probably be six or seven finalists, with that number being reduced down
to three that will be appearing before the City Council.
Sansevere commented he would like to be debriefed on who the semi-finalists are as well as the
final applicants.
Mayor Jabbour requested that the City Council members be provided with a copy of all the
applications submitted for the police chief position.
Mayor Jabbour stated he has met with Channel 11 regarding the remnants of the Great Woods and
issues relating to Spring Hill , which will air sometime in July. Jabbour noted that the C ity of Orono
has approximately 1,000 acres in park land currently.
Mayor Jabbour stated the Consolidation Committee will continue to meet throughout the summer and
is planning to address as many civic and church groups as possible regarding the merger. Jabbour
expressed a concern regarding relocation of the Long Lake Fire Station , noting that Orono's City
Code does not allow another city to construct a public facility in the city .
Kelley commented he attended Buckhorn Days where he received a large number of inquiries
regarding the consolidation .
Sansevere stated in his opinion a large number of citizens in Orono are not opposed to the merger,
but that there appears to be some opposition in Long Lake.
Mayor Jabbour indicated the Consol idation Committee will also be sending a letter and a packet of
information relating to the merger to the various civic and church groups as well as arranging
neighborhood meetings to discuss the issues with as many residents as possible . Jabbour stated
he would like the City Council members to be available for questions, noting that there is some
misinformation that needs to be addressed .
Sansevere commented boaters who use the area near Big Island are still unhappy w ith the placement
of buoys in that area.
Mayor Jabbour noted the buoys were placed in that area due to safety concerns.
Kelley commented a final decision on the location of the new fire station will be a difficult one. Kelley
stated the two main issues involved with the new fire station relate to the location and the cost.
Flint expressed a concern relat i ng to the recycling program and the continuing problem of finding
recycled material along the streets following pickup . Flint indicated he has spoken with
Amelia Krueger and the owner of the recycling company in an attempt to resolve this issue. Flint
stated the problem is not entirely the fault of the recycling company but also comes about from the
residents not taking ample steps to insure that their recycled goods do not blow away.
Gappa stated in his view part of the problem is a result of inadequate equipment and that the City
could perhaps request better equipment with the new contract. Gappa stated the tarps are

The Council voted 4 to Oto permit the property owners of 1449 Bay Ridge Road to proceed with the
reconstruction of their residence and directed Staff to draft a resolution for adoption at the June 26,
2000 meeting.
Review
The City Council adopted, on consent, Resolution No. 4416 for Daniel and Judith McAthie to grant
variances to permit construction of an addition to the garage and the addition of a second story to an
existing one level home at 1449 Bay Ridge Road. The contractor, Michael Hayes Homes, had
applied for and received a building permit to begin construction on May 15th. After beginning the
project the contractor determined a small portion of the foundation on the back of the house would
need to be replaced because it was cracked . Also, some of the joists were rotten requiring the entire
house to be removed, except the foundation. During a recent inspection Staff had noticed the house
was removed. Subsequently, Staff has placed the Building Permit on hold. The contractor has stated
some alteration of the foundation will be required to stablize and bring the foundation to existing
code, and some of the foundation to the back of the house will have to be replaced. The contractor
has stated most of the existing foundation can be used for the house.
COUNCIL ACTION REQUESTED

Variances-Resolution No. 4473
Peterson moved, and Sansevere seconded, to approve Resolution No. 4473 granting a ,.
Conditional Use Permit per Municipal Zoning Code Section 10.03, Subdivision 21 to allow
grading within 5 feet of a lot line, and a Variance to Section 10.22, Subdivision 2 and
Section 10.56, Subdivision 16(L)(2) to permit construction of a new residence.
Vote: Ayes 4, Nays 0.
4. #2557 Daniel and Judith McAthie, 1449 Bay Ridge Road-Variance Review
Weinberger reported that the applicants were granted variances in January for the addition of a
second story to their existing house. The approval was for an addition to the existing house.
Staff found on a recent visit that the house had been removed from its foundation and placed the
Building Permit on hold. The building contractor found that part of the foundation would have
to be replaced and that many of the joists were rotted and should be replaced to ensure
compliance with the State Building Code. The applicants intend to use most of the existing
foundation and would construct the new house based on the plans approved by the Council per
Resolution No. 4416.
Weinberger requested direction from the Council to either: 1) permit construction to continue
based on the intent of the variance approvals understanding that no exterior alterations are
proposed for this plan, which would limit the size of the house and staff were comfortable with
the plan; 2) advise the applicant to submit a new Land Use Application which would require
variances to be granted for new construction, and either granting a variance for lakeshore setback
again, or requiring the building be moved to meet the average lakeshore setback, which could
change the exterior of the house.
Mr. McAthie stated his intent is to only do what they originally proposed. His contractor stated
that they did not expect to have to remove the house , but as they worked they discovered more
and more rotted floor joists. He stated that he has to warranty his products for ten years and can't
build on a bad foundation .
Mayor Jabbour stated that there are large differences between this application and the house on
County Road 15, which had a similar sequence of events, but also included structure within the
0-75 foot zone. Barrett asked that staff draft a resolution listing the reasons why it is appropriate
to allow the applicant to proceed with plan 1.
Flint moved, and Sansevere seconded, to allow the applicant to continue based on plans
approved by the Council per Resolution 4416 and direct staff to prepare a
resolution to present to the Council at their next meeting for adoption listing the

PARK COMMISSION COMMENTS-PAULINE BOUCHARD, REPRESENTATIVE
Bouchard stated that the June meeting had been canceled, so there was no new business to
discuss. She mentioned that there would be a proposal regarding development near Saga Hill
coming to the Commission next week that they will be carefully considering.

Review-Resolutions No. 4474 and 4475
Mayor Jabbour requested to dispense with the formal presentation, as the Council was familiar
with the application. Flint stated that he did not want this item added to the Consent Agenda
because he was concerned with the packet referring to plans that have not yet been received, the
trash being located next to the sidewalk, and he wondered if the 9 parking spaces near the pond
could be left out.
Weinberger stated that staff had concerns with the trash receptacle location. Also, they received
grading plans for the property, which indicated grading right up to 3 mature trees. Staff
suggested they use a retaining wall instead of grading in order to avoid disturbing the root
systems of the trees. He also stated they do not have the legal descriptions required to adopt a
rezoning ordinance at the meeting, which would require the property owners to grant an
extension.
Mr. Wally Klus stated they have done the legal descriptions and could get them in to staff right
away. He stated he is eager to correct any issues and start work.
Weinberger stated the property now known as Navarre Lane should be rezoned to B-5 to be
consistent with the zoning of the remainder of the property. Mayor Jabbour asked if it could stay
a residential zone since it is only being used for the retention pond. Barrett stated that would be
acceptable, and the Council could take action on the resolutions regarding the application.
Mr. Klus's architect stated they could move the trash receptacle and hide it in a nook in the
retaining wall . Mr. Klus stated they intend to put in the 9 parking spaces that Flint had
questioned as necessary.
Flint moved, and Peterson seconded, to approve Resolution No. 4474 granting variances to
Orono Municipal Zoning Code Sections 10.56 Subdivision 16(L), Conditional Use Permits
per Section 10.03, Subdivisions 19-21, and approving the issuance of a Building Permit to
Walfred Properties for the property located at 2380 Shadywood Road per Municipal
Zoning Code Section 10.44, Subdivision 2 to permit commercial development of the
property with the condition that the applicant work with Staff to relocate the trash
receptacle away from the pedestrian access trail and save the mature trees identified in the
northeast corner of the property.

After-the-Fact Conditional Use Permit per Municipal Zoning Code Section 10 .03,
Subdivision 19-21 to permit excavation of greater than 500 cubic yards for construction of
a pond.

Wendy Bottenberg stated that the Planning Commission passed the plan unanimously, but staff
asked the item not be placed on the Consent Agenda so that the Council could review the memo
from Mike Gaffron, which points out the staffs concerns .
Mr. Gehring stated that he has worked hard to minimize and reduce hardcover on the property.
The new application meets side yard setbacks and they are within the 15% structural hardcover,
and have brought the hardcover in the 75-200 foot zone to 26.7%. He wants to build his new
house 42 feet from the lakeshore because that is the average lakeshore setback. It would keep
him in alignment with the other 5 neighboring properties. He also stated that they sit at the
bottom of a hill and have drainage issues . His neighbors have supported his application. If he
moves his house back, he will have sight line issues because of his neighbors' houses and it
would also create privacy issues with the neighbors.
Gaffron stated that when the Palms rebuilt, they were originally given a variance for an addition
at the 39 foot line, but when they found their foundation was unstable, they were forced to move
back to the 50 foot line. Staff is proposing that the Gehring house be set back at the 50 foot line .
They agree that the 75 foot line creates drainage issues for the applicant. But if the house were to
be located closer to the shore than 50 feet, it would result in large houses sitting too close to the
lakeshore, which would be inconsistent with the City's goals.
Sansevere asked Mr. Gehring what his issue was with moving the house from the 42 foot line to
the 50 foot line. He responded that moving the house back creates lake view

This letter is in response to our recent phone conversation regarding construction of a new residence
at 1449 Bay Ridge Road. The building permit for your property has been put on hold to review the
variance approvals granted on January 24 , 2000 per Resolution No. 4416. Based on a site inspection
by Staff it has been determined the entire structure and a portion of the existing foundation has been
removed. The variance approval assumed only the roof would be removed from the existing
structure and a second story would be added . Also a small portion of foundation would be added
to accommodate for the alteration to the garage.
The City has typically considered projects that require removal of structures and/or alteration to an
existing foundation as new construction. Based on this premise, a new house would be required to
meet the provisions of the Zoning Ordinance or to apply for additional variances for lot area and lot
\vidth, as the lot does not meet the minimum requirements for the LR-1 A zoning district. Variances
would also by required to permit new construction to occur within the average distance of the
adjacent residences from the lakeshore and within 30' of the side property lines.
As discussed, we will place this item on the City Council agenda for June 12, 2000. The meeting
will be held at the City Council Chambers located at 2750 Kelley Parkway beginning at 7:00 p.m.

Mayor Jabbour stated as it relates to the new Highway 12 corridor, the Attorney General
has decided that Long Lake's approval, because it was conditional, is not an approval but
rather a denial. Jabbour stated he has been working with the Mayor of Long Lake to get
it approved .

Boyer stated due to the narrowness of Rest Point Road and the lack of parking available
on the street, the house and garage need to be located further back to accommodate a
car in the driveway.
Stoddard commented he would be willing to approve a variance to the front yard setback ,
but that the Applicants need to comply with the 15 percent structural coverage limit.
Stoddard suggested this application be tabled to allow the Applicant time to revise his plans.
Stoddard stated the Applicant probably will not be allowed to construct a patio or walkway
to the lake.
Mrs. Cavender stated the patio is located off to the side .
Nygard noted the patio is still located within the 0-75' setback.
Smith recommended the Applicants attempt to adhere to the 15 percent structural coverage
limit and relocate the house closer to the road .
Kluth indicated the number one issue is the structural coverage , with the 15 percent needing
to be complied with. Kluth stated he would like to see the hardcover under the 25 percent
limit as well due to environmental concerns. Kluth noted the 0-75' setback is the most
critical as it relates to hardcover due to the impact to the lake.
Hawn stated it appears the Planning Commission would like the Applicants to adhere to the
15 percent structural coverage limit. Hawn inquired whether the Applicants would be willing
to extend the 60 day review period should the Plann i ng Commission table this application .
Weinberger indicated City Staff will continue to work with the Applicants.
Stoddard commented the front yard setback should be compatible with the other houses in
the neighborhood, and suggested the Appl i cants cons ider locating the house 35 feet from
the lake.
Smith commented she would like to see the house 35 to 40 feet from the lake .
Stoddard i nquired whether the Applicants wou ld like the Planning Commission to table their
application.
Mr. Cavender requested their application be tabled.

Bottenberg stated the Applicants are requesting variances to permit the addition of a garage

and living space to the existing residence. They are proposing to raise the roof of the existing
structure for additional living space on the second story. The Applicants are also proposing
to enlarge the garage by approximately 350 square feet and reducing the size of the turn-around
in the driveway.
Bottenberg noted the amount of hardcover in the 75-250' setback will be reduced by 495 .5
square feet, or 2 .43 percent, for a total hardcover in the amount of 5,745.5 square feet or
28.27 percent. Bottenberg stated the amount of structural coverage is below the allowable
limit.
Botten berg stated the residence was constructed at its present location in 1967, and now
requires variances for side yard setback and average lakeshore setback. The Applicants
are requesting a variance for the second story addition to encroach 20 feet into the average
lakeshore setback and a variance to permit a 10.62' setback to the north property line and
a 9.93' setback to the south property line where 30' setback is required.
City Staff is recommending approval of variances for side yard setback, average lakeshore
setback and hardcover in the 75-250' setback area .
Hawn inquired whether a variance to height is required on this application.
Bottenberg stated the height of the proposed structure is not an issue .
Mr. McAthie stated they are looking to update their residence . McAthie stated their neighbors
are in support of this project.
Bottenberg commented City Staff has received a phone from Michael Johnson, 1461 Bay Ridge
Road and Kent Whitworth, 1425 Bay Ridge Road , indicating the ir support of this project.
There were no public comments.
Kluth inquired where the hardcover was being reduced .
Mr. McAthie stated they removing some decking and a sidewalk located in the front.
Kluth moved, Hawn seconded, to recommend approval of Application #2557,
Judith and Daniel McAthie, 1449 Bay Ridge Road, granting of variances to side
yard setback, average lakeshore setback, and hardcover in the 75-250' setback
area to pennit the addition of a garage and living space to the existing residence.

structure for additional living space on the second story . The Applicants are also proposing
to enlarge the garage by approximately 350 square feet and reducing the size of the turn-around
in the driveway.
Bottenberg noted the amount of hardcover in the 75-250' setback will be reduced by 495 .5
square feet, or 2 .43 percent, for a total hardcover in the amount of 5,745 .5 square feet or
28.27 percent. Bottenberg stated the amount of structural coverage is below the allowable
limit.
Bottenberg stated the residence was constructed at its present location in 1967, and now
requires variances for side yard setback and average lakeshore setback. The Applicants
are requesting a variance for the second story addition to encroach 20 feet into the average
lakeshore setback and a variance to permit a 10 .62' setback to the north property line and
a 9.93' setback to the south property line where 30' setback is required .
City Staff is recommending approval of variances for side yard setback, average lakeshore
setback and hardcover in the 75-250' setback area .
Hawn inquired whether a variance to height is required on this application .
Bottenberg stated the height of the proposed structure is not an issue .
Mr. McAthie stated they are looking to update their residence . McAthie stated their neighbors
are in support of this project.
Bottenberg commented City Staff has received a phone from Michael Johnson, 1461 Bay Ridge
Road and Kent Whitworth, 1425 Bay Ridge Road , indicating their support of this project .
There were no public comments .
Kluth inquired where the hardcover was being reduced .
Mr. McAthie stated they removing some decking and a sidewalk located in the front.
Kluth moved, Hawn seconded, to recommend approval of Application #2557,
Judith and Daniel McAthie, 1449 Bay Ridge Road, granting of variances to side
yard setback, average lakeshore setback, and hardcover in the 75-250' setback
area to permit the addition of a garage and living space to the existing residence.

Boyer stated due to the narrowness of Rest Point Road and the lack of parking available
on the street, the house and garage need to be located furthe r back to accommodate a
car in the driveway.
Stoddard commented he would be willing to approve a variance to the front yard setback,
but that the Applicants need to comply with the 15 percent structural coverage limit.
Stoddard suggested this application be tabled to allow the Applicant t ime to revise his plans .
Stoddard stated the Applicant probably will not be allowed to construct a patio or walkway
to the lake.
Mrs. Cavender stated the patio is located off to the side .
Nygard noted the patio is still located within the 0-75' setback.
Smith recommended the Applicants attempt to adhere to the 15 percent structural coverage
limit and relocate the house closer to the road.
Kluth indicated the number one issue is the structural coverage, with the 15 percent needing
to be complied with. Kluth stated he would like to see the hardcover under the 25 percent
limit as well due to environmental concerns . Kluth noted the 0-75' setback is the most
critical as it relates to hardcover due to the impact to the lake.
Hawn stated it appears the Planning Commission wou ld like the Applicants to adhere to the
15 percent structural coverage limit. Hawn inquired whether the Applicants would be willing
to extend the 60 day review period should the Planning Commission table this applicat ion.
Weinberger indicated City Staff will continue to work with the Applicants .
Stoddard commented the front yard setback should be compatible with the other houses in
the neighborhood, and suggested the Applicants consider locat ing the house 35 feet from
the lake.
Smith commented she wou ld like to see the house 35 to 40 feet from the lake.
Stoddard inquired whether the Applicants would like the Planning Commission to table their
application .
Mr. Cavender requested their application be tabled.
Stoddard moved, Kluth seconded, to table Application #2556, Barbara and Collins
Cavender, 1405/1395 Rest Point Road, Variances, to allow the Applicants time to

SignatureSec.13.04 RIGHTS OF SUBJECTS OF DATA
Subdivision 1. Type of data. The rights of individual on whom the data is stored or
to be stored shall be as set forth in this section.
Subd. 2. Information required to be given individual. An individual asked to supply
private or confidential data concerning himself shall be informed of: (a) the purpose and
intended use of the requested data within the collecting state agency, political subdivision, or
statewide system; (b) whether he may refuse or is legally required to supply the requested data;
(c) any known consequence arising from his supplying or refusing to supply private or
confidential data; and ( d) the identity of other persons or entities authorized by state or federal
law to receive the data. This requirement shall not apply when an individual is asked to supply
investigative data, pursuant to section 13.82, subdivision 5 , to a law enforcement officer.
The commissioner of revenue may place the notice required under this subdivision in
the individual income tax or property tax refund instructions instead of on those forms.
Subd. 3. Access to data by individual. Upon request to a responsible authority, an
individual shall be informed whether he is the subject of stored . data on individuals, and
whether it is classified as public, private or confidential. Upon his further request, an
individual who is the subject of stored private or public data on individuals shall be shown the
data without any charge to him and, if he desires , shall be infom1ed of the content and meaning
of that data. After an individual has been shown the private data and informed of its meaning,
the data need not be disclosed to him for six months thereafter unless a dispute or action
pursuant to this section is pending or additional data on the individual has been collected or
created. The responsible authority shall provide copies of the private or public data upon
request by the individual subject of the data. The responsible authority may require the
requesting person to pay the actual costs of making, certifying, and compiling the copies.
The responsible authority shall comply immediately , if possible, with any request made
pursuant to this subdivision, or within five days of the date of the request, excluding Saturdays,
Sundays and legal holidays, if immediate compliance is not possible. If he cannot comply with
the request within that time , he shall so inform the · individual , and may have an additional five
days within which to comply with the request, excluding Saturdays , Sundays and legal holidays.
Subd. 4. Procedure when data is not accurate or complete. An individual may
contest the accuracy or completeness of public or private data concerning himself. To exercise
this right, an .individual shall notify in writing the responsible authority describing the nature
of the disagreement. The responsible authority shall within 30 days either: (a) correct the data
found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or
incomplete data, including recipients named by the individual; or (b) notify the individual that
he believes the data to be correct. Data in dispute shall be disclo s ed only if the individual's
statement of disagreement is included with the disclosed data.
The determination of the responsible authority may be appealed pursuant to the
provisions of the administrative procedure act relating to contested cases.
