The City of Orono is required to notify you within fifteen (15) business days as to the status of your
application for a Setback Variance for property at 1449 Bay Ridge Road. Below is a list of items the City
of Orono is requesting to complete our review:
1. Two (2) original scaled copies of the certificate of survey and a reduced copy (11 'xl 7' or
smaller) indicating the following:
a. setback zones from the OHWL of Lake Minnetonka,
b. the existing house and the proposed garage,
c. all proposed hardcover and any hardcover to be removed,
2. Hardcover for the 75 to 250 zone calculated by your surveyor .
Application # 09-3406 is incomplete. If you wish to proceed with your application please submit the

Your application for a permit to build a detached garage at 1449 Bay Ridge Road is denied based on Planning
Director Mike Gaffron's finding that the proposed garage would have a negative impact on neighboring
properties because the yards adjacent to Bay Ridge Road are maintained as formal front yards. Unless the
proposed garage were placed close enough to the principal structure that it appeared to be attached to the house
it would be out of character with the rest of the Bay Ridge Road neighborhood. Also , the proposed location
does not satisfy the 30-foot side setback requirement.
The specific code sections are :
1. 78-1, Definitions: Through lot means a lot which has a pair of opposite lot lines abutting two
substantially parallel streets, and which is not a corner lot. On a through lot, both street lines shall be
front lot lines for applying this chapter.
2. 78-1431 : Accessory buildings and structures on through lots , specifies that all accessory buildings and
structures on through lots located in R districts shall meet the following requirements :
(1) The building or structure shall meet the principal building setbacks that are established
under sections ... 78-305 ....
(2) No negative impacts to adjacent neighbors or public right-of-way result in the placement of
the building or structure, determined at the discretion of the planning director.
Should the planning director determine that item (2) above cannot be met an accessory structure or
building may be permitted by conditional use permit if the planning commission determines no negative
impacts result in the placement of the building or structure. The planning commission may apply
reasonable conditions as part of the approval.

HARDSHIP DOCUMENTATION FORM
This form is a required submittal for ALL variance applications. An application will not be considered
complete or placed on any meeting agendas until this form is complete and submitted to the City .
Minnesota State Statutes Section 394 .27 , Subdivision 7 requires that a hardship be demonstrated in ·order for a
variance to be granted . The hardship must be unique to the property as variances run with the land and not the
land owner. Personal and economic situations are not considered valid hardships. In order for an application to
be heard by the Planning Commission and City Council a hardship having merit must be demonstrated .
HOW DO I PROVE A HARDSHIP?
This form has 12 po ints outlining the basis City staff uses to determine if a hardship exists and how the variance
will affect the surrounding community . To prove a hardship , address all the relevant points listed below and
answer them as clearly as possible .
Since you are requesting the code exception , you have the burden of proving that the variance is justified .
The information the City receives is what is used in determining a denial or approval recommendation . If you
leave something out it will not be considered .
Please address each of these hardship criteria as they relate to the request, if they do not apply, write NIA in the
space provided:
1. "The property in question cannot be put to a reasonable use if used under conditions allowed by the official
controls ."
2. "The plight of the landowner is due to circumstances unique to his property not created by the landowner."
3. "The variance , if granted , will not alter the essential character of the locality."
4 . "Economic considerations alone shall not constitute an undue hardsh ip if reasonable use for the property
exists under the terms of the Zoning Chapter."
5. "Undue hardship also includes , but is not limited to , inadequate access to direct sunlight for solar energy
systems . Variances shall be granted for earth sheltered construction as defined in Minnesota Statutes ,
Section 116J .06, Subd. 2 , when in harmony with this Chapter."
6 . "The Board of Appeals and Adjustments or the Council may not permit as a variance any use that is not
permitted under this Chapter for property in the zone where the affected person 's land is located."

7 . "The Board or Counc il may permit as a variance the temporary use of a one-family dwelling as a two-family
dwelling ."
8. ''The special conditions applying to the st ructure or land in question are peculiar to such property or

10 . ''The gran t ing of the application is necessary for the preservation a nd en j oyment of a substantial property right
of the applicant."
11 . ''The granting of the proposed variance will not in any way impair health , safety , comfort , morals , or in any
other respect be contrary to the intent of the Zoning Code ."
12 . "The granting of such variance will not mere ly serve as a convenience to the appl icant , but is necessary to
allev iate demonstrable hardship or difficulty ."

IIardship Statement
We originally requested a building permit placing the outbuilding 20+ feet off the Ridge
Road border of the property, which application was denied on October 23, 2007. At that
time we were asked to push the outbuilding back closer to the house to be consistent with
the large front yards of the neighborhood. We are now requesting a variance to place the
outbuilding as close to the house as possible while meeting the 250' setback from the
lake. The variance for the 1 O' setback that we are requesting is in an attempt to push the
outbuilding as far as possible from an existing 36' diameter ash tree, to give it the best
chance of survival..
