NO. 4075 Van Zomeren explained the applicant wants variances to side yard, given the 2 acre zoning with substantial setbacks, in order to add a second story. The Planning Commission voted to approve the requested variances . Kruger said he was also considering adding a garage. Jabbour said the Council will only act on what is currently presented to Council. Van Zomeren said the existing structure does not meet requirements, and Kruger has a structural engineer that recommended new foundation improvements. The Council discussed if there should be a certain percentage of foundation that deems the entire foundation should be replaced, and if the entire foundation was replaced, should the house be moved. Van Zomeren said currently applicants are not required to do structural reports before applying for a variance. She went on to explain the variance will expire in one year and the building permits w~mld have to be applied for in that year. She also explained that 10 feet are needed between structures ifhe does build a garage, and that 35% could be in hardcover without a variance in the setback area within the shoreland setback. Jabbour moved to approved Resolution #4075, with applicant retaining appropriate structural engineer findings as appropriated. Kelley seconded. Vote: Ayes 5, Nays 0. (#6) #2357 KENT WHITWORTH, 1425 BAY RIDGE ROAD -CONDITIONAL USE PERMIT AND VARIAN CE Van Zomeren reported the applicant is requesting a hardcover variance, lakeshore variance and conditional use permit to build a retaining wall adjacent to County Road 15. The conditional use permit is required because it involves grading within 5 feet of the property line. The Planning Commission recommended this project with the following concerns: that the City would get an accurate survey, a drawing of the retaining wall, along with hardcover calculations, the materials used are similar to a wall existing adjacent to the property and consistent with the area, the -trees over 6 inches be preserved, and appropriate approval needed by Hennepin County is obtained. The problem is there are no numbers available. Peterson asked how it got as far as it did without the necessary numbers. 6 ' ORONO CITY COUNCIL MEETING MINUTES FOR MAY 11, 1998 (#6) #2357 KENT WHITWORTH, 1425 BAY RiDGE ROAD -Continued Whitworth explained the 10 ' 3" height is shown in the variance request and it is a 3 tier wall, 10 1/2 feet above the road. He said the wall was needed for safety, and the existing retaining structure was damaged in 1987. Kelley questioned the eastbound sitelines, and the restrictions on vegetation. Whitworth explained the sitelines would not change, and he would present a landscape plan once the wall was built. Kelley moved to ask the staff to prepare a resolution in favor of the applicant with the needed numbers, and Peterson seconded. Vote: Ayes 5, Nays 0. (#7) #2358 RANDY & MARIE STAFFANSON, 1422 PARK DRIVE -VARIANCE - REQUEST TO GO DIRECTLY TO COUNCIL ON MAY 26, 1998 The applicant was not present, and Van Zomeren explained they are planning not to proceed with the variance, due to the high cost of estimates. The applicant would like to replace the garage in its present location requiring a side yard variance, and it would come through the Planning Commission again. Van Zomeren asked if it was possible to re-notice in the newspapers immediately, to be considered at the next Council meeting for the side-yard variance, and the City Attorney replied if you have new variances, the public hearing could be held at the Council meeting. Short recess for Executive Session. (#4) #2308 BROOK PARK REALTY, 3760 SHORELINE DRIVE -Continued Jabbour moved to move off the table, and Goetten seconded. Vote: Ayes 5, Nays 0. Jabbour suggested a draft of an agreement to go back to two options: 1) Applicant to do road, and receive 30 units, or 2) do 20 units, wait for road from other party, and when road is done get 10 more units. --·· The City Attorney stated not all developments would necessarily support the road, but it should be extended as a policy matter. Jabbour said the assurances the applicant has are up to the applicant. Either the applicant puts the road through, or waits for the road to be put through. Gleason asked if properties 3 and 4 adjacent to these are residential. Jabbour replied yes, residential. The City would like to have a park there. He went on to say if the density credit is not granted by Council, the parcels could still have 10 units. Flint moved, and Kelley seconded to adopt Ordinance No. 175, 2nd Series enacting a moratorium on development in the LR-lC-1 zoning district, expiring on November 16, 1998. There is existing hardcover (stairway and partial walls)in the 0'-75' setback, however, no information was provided. The proposed retaining wall may encroach into the 0'-75' setback. A more detailed drawing is needed to determine the amount of hardcover and the extent of any encroachment. STATEMENT OF HARDSHIP The applicant has noted on the application that the topography and county road is a hardship. He has also informed staff that he is concerned about his children playing in the backyard near the steep slope. The adjacent properties have retaining walls that were rebuilt after erosion damage from 1987 storms. The applicant wants to build a wall similar to the adjacent walls. (SEE EXHIBITS). This property is a comer lot that meets lot area and lot width requirements. Ju..oo~A Criteria for Determining Undue Hardship 1. The property in question cannot be put to a reasonable use if used under conditions allowed by the official controls. The property can continue to be used/or a residence. The applicant has stated his concern about safety for his children and the desire to have a wall similar to the adjacent properties. # 2357 Kent and Susan Whitworth 1425 Bay Ridge Road 4/20/98 page---3 2. The plight of the landowner is due to circumstances unique to his property not created by the landowner. The need for a variance is created by the location of the steep slope and the roadway. 3. The variance , if granted , will not alter the essential character of the locality . The hardcover variance will allow the construction of a retaining wall that is aesthetically compatible with the adjacent property's walls. However, the purpose of the shoreland ordinance is to encourage natural vegetation and ground cover instead of retaining walls along the shoreland and in the lakeshore setback. 6. The special conditions applying to the structure or land in question are peculiar to such property or immediately adjoining property. The properties in this area have lakeshore yards that are separated by County Rd. 15. Stairways are needed to access the lakeshore . The question of a retaining wall vs. a natural steep slope with vegetation needs to be discussed. 7. The conditions do not apply generally to other land or structures in the district in which said land is located. The standards apply to all other lots in this zoning district that have lakeshore yards with steep slopes that are separated by roads . 8. The granting of the application is necessary for the preservation and enjoyment of a substantial property right of the applicant. The applicant shall provide the Planning Commission with testimony to the necessity of having a retaining wall to protect his property rights. 9 . The granting of such variance will not merely serve as a convenience to the applicant, but is necessary to alleviate demonstrable hardship or difficulty. The variance would be a convenience to the applicant if approved as proposed. No hardship exists due to the lot configuration or setback requirements. ISSUES The survey does not precisely indicate where the wall will be located, its overall height, or total amount of hardcover. The encroachment , if any, into the 0'-75' setback also is not clear. Grading # 2357 Kent and Susan Whitworth 1425 Bay Ridge Road 4/20/98 page---4 within 5' of the property line requires a conditional use permit which has not been applied for or properly noticed to adjacent property owners. If the wall is located on the County right-of-way or if the wall needs will be constructed from the County Rd. 15 side, Hennepin County must review and approve it. No information has been submitted by the applicant from the County. Staff has been unsuccessful in securing the County's comments prior to printing of the staff report. The Zoning Code is clear in its purpose and intent in dissuading vegetative cover and tree removal in the shoreland setback. STAFF RECOMMENDATION Staff recommends that the Planning Commission review the information submitted and provide the applicant with direction regarding whether they would favor encroachment into the 0'-75' setback. If so, then the Commission should direct the applicant to prepare a survey and engineered drawing of a retaining wall with a landscaping plan. Applicant should also contact Hennepin County and provide staff with the County' recommendation. The Planning Commission should then table this application until the applicant is able to provide the required information. The applicant shall also provide a written statement that he agrees to a 60 day extension. Type of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this section. Subd. 2. Information required to be given individual. An individual asked to supply private or confidential data concerning himself shall be informed of: (a) the purpose and intended use of the requested data within the collecting state agency, political subdivision, or statewide system; (b) whether he may refuse or is legally required to supply the requested data; ( c) any known consequence arising from his supplying or refusing to supply private or confidential data; and ( d) the identity of other persons or entities authorized by state or federal law to receive the data. This requirement shall not apply when an individual is asked to supply investigative data, pursuant to section 13.82, subdivision 5, to a law enforcement officer. The commissioner of revenue may place the notice required under this subdivision in the individual income tax or property tax refund instructions instead of on those forms. Subd. 3. Studies have shown that sediments , oils, and debris carried into the lake from highly urbanized areas have a detrimental impact on the quality of water in the lake . The intent of Orono's ordinance is to ensure that rainfall run-off will be cleansed by filtering through grassed or vegetated yard areas before entering the lake .
