The applicant proposes a two-story rear addition to his recently remodeled
home for additional living area for his growing family. The addition
consists of a family room on the first floor and a tx�droorf. and bath on
the second. My concern in this current. rroposal is they age and condition
of the existing garage. Although the ap, , ican•_ does not include a new
garage in the proposal, our review must in.-•ude the inevitable request.
The existing garages is 24.15' X 14' or 339.1 sq. ft. A minima::, sized
two -car garages at 22' X 24' equals 528 aq. ft. in area for an increase of
199.9 or 190 sq. ft. of hardcover. A 4w increase in hardcover and with
the current proposal, a total hardcover variance increase of 12% Ire"mber
there is an existing 3% excess of hardcover).

The Planning Commission may ask for trade-offs - removal of screened
structure in front yard - reduce size of addition --. The p:oposal is
certainly consistent with the recently improved lots on Baldur Park.
A new garage will also require approval of garage setback variance.
Planning Commission may recommend approval of the following variances
if doors face away from street. Side yard 3' setback = variance 7',
street setback 5'-10' = variance of 25' or 20'.
Staff Recommendation:
to approvo Mike Sieklocha's hardcover variance application for a 15' X 25'
addition creating a hardcover variance increase of 8" and to further
approve a future 22' X 24' two -car garage with an additional hardcover
variance of 4%, with setback variances as follows:
Side setback variance of 7'
Street setback variance of 20'
Approval is based on fo-.lowing findings:
1. Improvements consistent with other properties on Baldur Park
2. No additional land available
3. No detrimental .affects to the public health, safety and welfare
4. Continue to improve property values in the neighborhood
Appro.al is based on the following conditions:

recommend approval of the metes and bounds
subdivision request of Richard Ogle, ?755

1. Applicant submit a copy of easement
agreement qranting existing dock ownership to
Parcel B.
2. Parcel A & Parcel B may have one dock each
either on lagoon nr main lake.
3. New dock on Parcel A must meet all LMCD
standards.
4. Variance setback approved for permanent
existing dock - ramp to dock must be relocated so
that direct access is via Parcel B.

noted in the record that Mr . Ammerman has Oad a
variance granted for property he owns at 3458
North Shore Drive and during that review for a
garage setback variance, problems with backing
out were not noted.

Members advised that in approving the proposed addition, the Commission
would recommend to Council that no future hardcover variances be granted
for the property.
Staff asked the Planning Commission to consider the removal of the screened
gazebo (154 sq. ft.) in the lakeshore yard. Planning Commission felt it
was not necessary to require the removal of the structure but agreed that
the s*.r�icture be formally recognized as a non -conforming structure and
subjeri. to all pertinent ordinances.
Planning Commission recommendation: to approve Mike Sjeklocha's hardcover
variance application for a 15' X 25' addition creating a hardcover variance
increase of 8% based on the following findings:

Whereas, Mike Sjekl.ochli is the owner (hereafter "owner") of
property located within the City of Orono (hereafter "City") at 1424
Baldur Park Road legally described as Lot 9, Block 1, Baldur Park
(hereafter "property"); and
Whereas, the owner has applied to the City for a variance to
municipal zoning code section 34.511 t(, allow a 15' X 25' rear addition
to his existinq residence resulting in an increase of 375 square feet of
hardcover over the allowed amount of 1,163 square feet of hardcover for
the property within the 75'-250' setback area as allowed by Section
34.510.

Findings
1. This application was reviewed as zoning file no. 745.
2. The property is located in the LR-IC Single Family Lakeshore
Residential zoning district.
3. The proposed addition is to be no larger than 15' X 25' , two
st:,ries high.
4. The Orono Planning Commission reviewed this application on
May 16, 1983, and recommended approval of the variance as
requested based upoi. the following findings:
a) The proposed addition is consistent with the
improvements to existing residences on other properties on
Baldur Park.
b) No additi,,nal land is avallal .
c) The location and use of the addition will not be
detrimental to the public health, safety and welfare nor
have a detrimental effect on the surrounding property
values.
d) The proposed variance applicat-ion does not require any
other variances to the municipal zoning code

5. The City Council has r-onsidered this application including
the findings and recommendations of the Planning Commission,
reports by City staff, comments by the owner and other interested
persons, and the effect of the proposed variance on the health,
safe'.y and welfare of the community.
4;. The City Council finds that the conditions existing on this
property are pecuiiar to it and do not apply generally to other
property in this zoning district: that granting the variance
would not adversely effect traffi- conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would
not merely serve as a convenience to the owner, but is necessary to
alleviate ademonstrable hardship or difficulty; is necessary to
preserve a substantial property right :,f the owner; and would be
in keeping with the spirit and intent of the zoning code and
comprehensive plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City 7ouncil hereby grants a
variance to Section 34.510 to allow the construction of a 15' X 25'
addition to the rear/street side of the principal structure and
approves an increase of 375 square feet of hardcover within the '75'-
250' lakeshore setback area over the allowed amount of hardcover at
1,163 square feet per Section 34.5111, subject to the following
conditions:
1. The 11' X 14' screened structure ,ra ed w?thin 0-75' of the
,,ikeshore is A non -conforming structure and subject to all
per*inont sections of the Orono Zoninq Code.
2. The City will grant no future variances to this property.
3. Nuthorities granted by this variance run with the property
not with the owner, but are permissive only and must be exercised
by application for a building permit within one year of the date of
Council approval, or this virianr.e will expire on that hate (June
13, InS4).
4. Violation of or noncompliance with any of the terms and
conditions of this variance shall constitute A violation of the
zoning code, shall automatically terminate any authority granted
herein, and shall be punishable as a misdemeanor.
