A RESOLUTION GRANTING A VARIANCE TO SECTION 10.22, SUBDIVISION 1(B), AND SECTION 10.56, SUBDIVISION 16(C)(�, � GRANTING A CONDITIONAL USE PERMIT � " PER SECTION 10.03, SUBDIVISION 19 FILE NO. 02-2853 WHEREAS,Russell Schumer and Judy Florestano,(hereinafter"the applicants")are the owners of the property located at 955 Tonkawa Road within the City of Orono(hereinafter"the City") and legally described as follows: Lot 5,Block 1,Vasa Park,Hennepin County,Minnesota,(�ereinafter"the propert}�') and , WHEREAS,the applicants have applied to the City for variances to Municipal Code • Section 10.22,Subdivision 1(B)and Section 10.56,Subdivision 16(C)(6)to pernut an encroachment of 42' to construct a new residence on the property and 62' to construct a lakeside pool into the average lakeshore setback;and a conditional use permit to allow land alteration of greater than 500 cubic yards to be brought onto the site per Section 10.03, Subdivision 19. WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on November 18, 2002, at which time all persons desiring to be heard conceming this application were given the opportunity to speak thereon. NO`V, THEREFORE, BE IT RESOLVED by_the City Council of Orono, Minnesota: � ° � FINDINGS � 1. This application was reviewed as Zoning File#02-2853. 2. This property is located in the LR-1B Zoning District,where 1 acre is the minimum lot area. The property consists of approximately 3.4 acres. . 3. The Orono Planning Commission reviewed this application on November 18,2002 • Page 1 of 7 � O� - • 0 �: � � �. The Planning Commission made the following findings of fact: • A. The proposed residence is set further from the lake than the old residence. B. The lot and adjacent lots are heavily wooded. - C. The proposed residence and lakeside pool will not obscure neighboring properties views. D. The proposed residence meets hardcover, lot coverage by structures and � height requirements. E. The sewer line prohibits the proposed residence from being located further • . back on the property(towards the road). 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air,nor pose a - fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants,but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. . 6. The City Council finds that granting a conditional use permit to allow land alteration � of more than 500 cubic yards of fill to be brought onto the property will not to be detrimental to the health,safety or general welfare of the public,would not adversely � affect light, air nor pose a fire hazard or other danger to neighboring properties,nor ' will it depreciate surrounding property values and that the proposed level of use of the property will be in keeping with the intent and objectives of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER,AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Municipal Code Section 10.22, Subdivision 1(B) and Section 10.56, Subdivision 16(C)(6)to permit an encroachment of 42' to construct a new residence on the property and 62' to construct a lakeside pool into the average lakeshore setback; and a conditional use permit to allow land alteration of greater than 500 cubic yards to be brought onto the site per Section 10.03, Subdivision 19. Approval is subject to the follo�ving conditions: 1. Council approval is based on the site plan submitted by the applicant attached to this resolution as Exhibit A. Any amendments to the site plan may require • further Planning Commission and City Council review. � 2. The applicant shall submit a final grading plan to City Engineer for review prior � to issuance of the building permit. 3. The applicant shall obtain a land alteration permit from the city prior to hauling � fill to the site. 4. The applicant must contact Minnehaha Creek Watershed District for an erosion control permit. 5. Erosion control measure shall be taken by installing a silt fence around the construction area upon receiving permit from City and MCWD and prior to any � land alteratiori activity. Applicants and their contractors shall follow the"Best � Mana�ement Practices for Protection of Water Quality in Urban Areas." 6. A route map shall be provided to the city prior to the start of construction showing which county/city street are to be used. 7. The applicant shall televise the sewer between the north and south lot lines prior to any grading activity and again after the proj ect is complete. • Page 3 of 7 � t O� � � • O ,'�. � O � . �. The applicant shall provide the City with a new easement for the existing sewer and shall take appropriate action to vacate the existing unused easement. - � 9. Authorities granted by these variances and conditional use permits run with the property not with the applicants,but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or these variances will expire on that date(December 9, 2003). 10. Violation of or non-compliance with any of the terms and conditions of these variances and conditional use permits shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanar. � � 11. The undersigned applicants have read, understood and hereby agrees to the terms • of this resolution and on behalf of themselves, their heirs, their successors and assigns,hereby agree to the recording of this resolution in the Chain of Title of the property.
