Moorse stated it is not just the PUD, it is the Comp Plan Amendment language where the City would lay out those parameters so it is not a wide-open amendment. Gaffron stated to the applicant that the rezoning goes hand-in-hand with the PUD. Staff will begin drafting text for the amendment and begin to draft language for a zoning ordinance to reflect specific uses and bring it back to the Council on April 12, 2004. This item will come back to the Council at the April 12 meeting and then go to the Planning Commission for rezoning. Staff will continue to work with the applicant to resolve any outstanding issues . The hardcover variance is not an uncommon request for this neighborhood. The city code 78-1403 allows the applicant structural coverage on their lot of 15% or 1500 square feet, whichever is greater. The 1500 square foot footprint consists of29% hardcover within the 75'-250' zone. With the addition of the d1iveway, minimum sidewalk and deck all meeting setbacks of the zoning district, this brings the property to 44.98% hardcover within the 75 '-250' zone with having zero percent hardcover in the O' -7 5' zone. As the size of the lot serves as the hardship in this situation, planning department staff recommends approval of the variances as requested. Chair Smith said it looks like driveway access looks adequate and is asking Curtis if she agrees. The property has reached maximum hardcover and the city doesn't want applicants coming back asking for more driveway. Staff responded that it is a two-car wide driveway that tapers at the road. There were no public comments. Bremer stated this application should be used as a model. Bremer moved, Rahn seconded to approve Application #04-2990, Patrick and Loring Kaveney, 1444 Baldur Park Road approving the requested variances for lot area, lot width and hardcover and according to the application numbers and find that the hardship here is the lot width. VOTE: Ayes 7; nays 0 8. #04-2991 PAT FLEMING, 4760 NORTH ARM DRIVE W. VARIANCE (8:05-8:10 P.M.) Pat Fleming, the applicant was present. Curtis stated that the Fleming property is located within the RR-lB, two-acre minimum zoning district. The applicant is requesting variances from the 50' front yard setback requirement as well as a variance from City Code 78-1435, which requires detached garages and accessory structures to be located behind the principal building setback. A creek bed runs down the side of the "L" shaped property with the home and the existing driveway on the eastern half. Septic systems soil treatment areas are located directly behind the home to the north. Therefore, due to topographic features, the location of the septic system and the orientation of the home on the property satisfy that there is a hardship to allow for the detached garage to be located in the front of the principal building. Staff, however, does not find a hardship for the encroachment of the required 50' front yard setback. Chair Smith inquired about the letter from neighbor Dick Rudd and if there was any impact on this application. Gaffron stated the neighbor to the n01ih was concerned if the survey was correct. The survey has been deemed correct. The prope1iy has been to1Tensed and where the lot line is indicated is correct. The fence is on the applicant's lot line. No comments from the public. Mabusth moved, seconded by Fritzler the approval of Application #04-2989, 1100 Townline Road, approving a 2-lot subdivision of some 13.79 acres within the five-acre zoning district of the city. Each lot meets and exceeds the area requirement except for the lot width and the lot width has been found to be adequate by the staff. It is on a dead end road and consistent with the lot widths of the adjacent properties within the five-acre zone. Also, this approval is based on findings of satisfactory septic testing for these two rural lots, having both the primary and alternate site. This approval is subject to the following conditions: 1. Implementation of the recommendations of the City Engineer. 2. Implementation of the recommendations of the Minnehaha Creek Watershed District. 3. Submission and approval of the final plat. 4. Subject to standard fees and dedication of required easements. 5. Review by the Park Commission prior to City Council review. No trail is shown on the roadway . Patrick and Loring Kaveney are the property owners of 1444 Baldur Park Road. The property is 0.19 acre located within the LR-IC half-acre zoning district. The applicants are requesting lot area, lot width, and hardcover variances in order to construct a new residence at 1444 Baldur Park Road on a lot 8600 square feet in area and 4 7 feet wide where 21,780 square feet of area and 100 feet of width are nom1ally required. Hardcover variance is requested in order to construct a 1,500 square foot home, 582 square foot driveway, 127 square foot sidewalk, and a minimal 121 square foot deck. A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTION 78-282, 78-350 SUBDIVISION B, AND SECTION 78-1288 SUBDIVISION B FILE NO. 04-2990 WHEREAS, Patrick Kaveney & Loring Kaveney, husband and wife (hereinafter "the applicants") are the owners of the property located at 1444 Baldur Park Road within the City of Orono (hereinafter the "City") and legally described as follows: Lot 4, Block 1, Baldur Park, Hennepin County, Minnesota (hereinafter the "property"); and WHEREAS, the applicant has made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-282 and 78-1288 to allow hardcover within the 75' -250' setback zone of 44.98% or 2,330 s.f. where 25% is normally allowed. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #04-2990. 2. The property is located in the LR-IC Single Family Zoning District, which requires a minimum lot area of 21,780 s.f. (1/2 acre) and a minimum lot width of 100'. 3. The Planning Commission reviewed this application at a public hearing held on March 15, 2004 and recommended approval of variances based on the following findings: Page 1 of 5 a. No additional land is available for acquisition by the applicants to make the property conforming in area or width. b. The property is served with municipal sewer. A single family residence has existed on the property for many years. c. A new single family residence can be constructed on the property meeting all setbacks and requiring only a hardcover variance. d. Because the property is less than 10,000 s.f. in area it is allowed a 1,500 s.f. structural footprint absent other factors. Construction of a 1,500 s.f. home accounts for 29% of hardcover within the 75'-250' setback zone. e. The applicants have proposed minimal driveway, walk, and deck in order to limit the magnitude of the hardcover excesses. f. The size of the proposed residence and magnitude of hardcover variance is consistent with other approved development in the neighborhood. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicant and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Page 2 of 5 Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Section 78-282 and 78-1288 and 78- 350 Subdivision B to allow construction of a new single family residence and hardcover within the 75'-250' zone of 2,330 s.f. or 44.98% where 25% is normally allowed subject to the following conditions: 1. Council approval is based on the site plan submitted by the applicant and annotated by City staff, attached to this Resolution as Exhibit A. Any amendments to the site plan which are not in conformity with City codes will require further Planning Commission and City Council review. 2. Hardcover in the 0-75' zone shall not increase above the 0%. Hardcover in the 75-250' zone shall be limited to 2,330 s.f. or 44.98% per the proposed plan and hardcover allowance summary as depicted on Exhibit A. Applicant is advised that any future requests to increase hardcover or change the nature of existing/approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concurrent reduction in existing hardcover. 3. Applicant shall remove all plastic or fabric liner material from the decorative landscape beds on the property to ensure their permeability as non-hardcover surfaces. 4. Required removals of structure and hardcover shall be completed before the footing inspection. 5. The lowest floor of the house shall be established no lower than the Regulatory Flood Protection Elevation of 932.5' MSL. 6. Prior to building permit issuance, the applicant shall supply sufficient site elevations and grading and drainage information to satisfy the City Engineer that there will be no encroachment or filling of the floodplain and that all drainage shall be handled so far as to not cause drainage problems for this residence or the neighborhood. 7. Authorities granted by this resolution run with the property not with the applicant, but are permissive only and must be exercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the variance will expire on that date (March 22, 2005). Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 9. The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of the applicant and the applicant's heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the property. Hard cover limitations. (a) No hard cover or impervious surface shall be placed, located or constmcted within 75 feet of the ordinary high water level of any lake or tributary, except for stairways, lifts, landings and lockboxes as regulated elsewhere in this Code. The applicant is permitted a 1,500 s.f. footprint. However, due to the size of the lot and the area within the 75'-250' zone, this footprint accounts for 29% of hardcover within this zone. Hardship Statement Applicants have completed the Hardcover Documentation Form attached as Exhibit B, and should be asked for additional testimony regarding the application. Hardship Analysis In considering applications for variance, the Planning Commission shall consider the effect of the proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. The Planning Commission shall consider recommending approval for variances from the literal provisions of the Zoning Code in instances where their strict enforcement would cause undue hardship because of circumstances unique to the individual property under consideration, and shall recommend approval only when it is demonstrated that such actions will be in keeping with the spirit and intent of the Orono Zoning Code. Upon his further request, an individual who is the subject of stored private or public data on individuals shall be shown the data without any charge to him and, if he desires, shall be informed of the content and meaning of that data. After an individual has been shown the private data and informed of its meaning, the data need not be disclosed to him for six months thereafter unless a dispute or action pursuant to this section is pending or additional data on the individual has been collected or created. The . responsible authority shall provide copies of the private or public data upon request by the individual subject of the data. The responsible authority may require the requesting person to pay the actual costs of making, certifying, and compiling the copies. The responsible authority shall comply immediately, if possible, with any request made pursuant to this subdivision, or within five days of the date of the request, excluding Saturdays, Sundays and legal holidays, if immediate compliance is not possible. If he cannot comply with the request within that time, he shall so inform the individual, and may have an additional five days within which to comply with the request, excluding Saturdays, Sundays and legal holidays. Subd. 4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or private data concerning himself. To exercise this right, an individual shall notify in writing the responsible authority describing the nature of the disagreement. The responsible authority shall within 30 days either: (a) correct the data found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or incomplete data, including recipients named by the individual; or (b) notify the individual that he believes the data to be correct. Data in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data. The determination of the responsible authority may be appealed pursuant to the provisions of the administrative procedure act relating to contested cases.
